Roll Call Present: Council: Mayor Paul George, presiding, Council Members Ron Bonlender, • Dave Edler, Neil McClure, Mary Place, Bernard Sims, and Susan Whitman County: Commissioners Ron Gamache & Jesse Palacios (until 4:08 p.m.) Staff: City Manager Zais, City Attorney Paolella and City Clerk Roberts 2. Invocation /Pledge of Allegiance Council Member McClure gave the invocation offering special thanks and a moment of silence for Lance Corporal Leo Tapias and the troops serving in Iraq. Council Member Edler led the Pledge of Allegiance. 3. Open Discussion for the Good of The Order /Special Presentations Council Member Bonlender reported that the first Cruising- The - Avenue event was a great success. The next one is scheduled for July 8 and 9 with the Low Riders. Mayor George announced that the inaugural bus service to Union Gap will be tomorrow, June 29 at 11:00 a.m. from the Transit Center. He also reported that during the first week of the new service to Selah there were 685 riders A. Proclamations: • 500 Year Anniversary of Queen Elizabeth I's birthday Mary Place read a proclamation declaring the month of July as Queen Elizabeth 1 month in the City of Yakima. • Washington State Department of Transportation — 1 - 90 Project Larry Mattson and Randy Giles from the Department of Transportation gave a report on the 1 -90 Snoqualmie Pass East Project. The Executive Summary will be presented at hearings in Ellensburg, Snoqualmie Summit, and in Seattle. The comment period is June 10 to August 5 Council Member Sims suggested the video presentation be run on YPAC giving citizens an opportunity to understand what the options are. B. Special presentations: Mayor George presented the Well City Award to Wellness Chairman Nicole Nunn. Yakima received it during the AWC Conference last week. He also took this opportunity to praise Council Member Place for her work as AWC President this past year. C. Citizen service requests None 174 JUNE 28, 2005 D. Consideration of appointments to boards and commissions (if any) None To accommodate schedules, Mayor Paul announced that Item No. 20 would be reviewed at this point in the meeting. 4. Consent Agenda Mayor George referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Item No. 12 was deferred to the July 5 meeting. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. SIMS MOVED AND WHITMAN SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *A. Audience Participation Lynne Kittelson, 305 North 9 Street, announced the fire trucks that are being donated to Morelia, Mexico, are finally leaving Yakima tonight at 7:30 p.m. from Station 95. PUBLIC HEARINGS 6. Joint Public Hearing with Yakima County Commissioners to consider an amendment to Title 15 of the Municipal Code pertaining to the placement of manufactured homes within the City of Yakima A. Consideration of Resolution imposing a moratorium within the City limits on the placement of manufactured homes Bruce Benson, Supervising Planner, advised that last year the State of Washington passed a law to treat manufactured homes the same as site built homes effective July 1, 2005. The state did indicate certain requirements could be placed on the manufactured homes; it has to be new (never before titled), set upon a permanent foundation, be in compliance with local design standards, and be thermally equivalent to site built homes. Because this is an amendment to Title 15, the City Zoning Ordinance, a public hearing was held by the Regional Planning Commission (RPC). At the conclusion of that meeting, the Commission adopted written recommendations and findings. They recommend approval of the conditions as set forth in the draft ordinance. They also asked to modify item #2 to delete the end of 2 175 JUNE 28, 2005 the sentence that reads "load bearing or decorative ". They recommend a committee be established to review the issue of design standards for residential construction in the Yakima area. This group would make recommendations to the RPC and Council for consideration and adoption. Council discussed requirements for manufactured homes versus site built, and neighborhood covenants. Phil Hoge, County Planning, said that the County and City share an urban area zoning ordinance and that is what is to be amended today. It is hoped that language for the ordinance could be agreed upon and then each entity would adopt their own ordinance with shared language. • Mayor George opened the public hearing Sandy Lloyd, 5501 West Arlington, referred to the Congdon rezoning process and how Phil Lamb, the then current Hearing Examiner, gave a stipulation for the area where she lives on Arlington. That stipulation was that across from them there should be two rows of R -1 single - family homes that "mirror" what is across the street. If there are no manufactured homes on her side, she questioned how they could be allowed on the other side. She said Seattle has local design standards, we don't, and she urged the City to quickly get them. She feels that manufactured homes will not blend and supports the moratorium. Council Member Place asked if creating design standards would require a Comprehensive Plan amendment. Mr. Benson did not think so, but would look into it further. Ken Harper, legal counsel for the City, said looking into design standards would be breaking new ground and would receive a lot of resistance. We cannot have design standards that are unique to manufactured homes. It is not a matter of having design standards to achieve some control over manufactured homes, but what design standards would this community want to support on an area -wide basis. Our legislators have passed a law allowing manufactured homes to be interspersed with site built homes. They have said the City of Yakima and the County can no longer have standards that apply to manufactured homes in a discriminatory manner. They cannot be treated differently; they cannot be zoned differently from stick built homes. We do treat them differently. We say for all the other types of manufactured homes that don't meet these standards we will continue to have the exact codes on the books we have now. If you fall within the specific parameters of this state law, your choice is to nullify the existing ordinance and progress on design standards. We want to make sure we have something in place when the state statute preempts our local ordinances. Maud Scott, Southeast Yakima, said they previously had a ruling by the Hearing Examiner in her neighborhood when an apartment owner tried to put in a mobile home. The Hearing Examiner ruled against it because it did not blend with the character of the neighborhood that were all custom - built, stick frame homes, dating back to the late 19 She asked how this provision of putting manufactured homes on any lot would work with that ruling in a neighborhood like hers. She prefers postponing this in some legal manner until we develop some protection for quality of construction and life throughout the city. Council Member McClure asked if there could be design standards at a neighborhood level. Mr. Harper said that was possible. He also explained that a moratorium is effective upon passage and is designed to be effective until the ordinance goes into effect, or 60 days, whichever comes first, subject to being 3 176. JUNE 28, 2005 extended by Council. The Council's moratorium power granted by GMA allows for 60 days without a public hearing. To extend the moratorium would require a public hearing. Rockey Marshall, 805 North 16th Avenue, although a member of the Regional Planning Commission, personally urged the City Council to adopt the ordinance and create a committee to look at standards, Mike Murphy, 4411 Snow Mountain Road, spoke in support of the ordinance and, again, addressed the need to clean up the city. • Mayor George closed the public hearing City Clerk Roberts noted that correspondence from Connie Little and Wilma Koski had been received and added to the record. The City Clerk read the ordinance by title; PLACE MOVED AND BONLENDER SECONDED TO PASS THE ORDINANCE. The motion carried by unanimous roll call vote. COMMISSIONER PALACIOS MOVED AND COMMISSIONER GAMACHE SECONDED TO PASS THE ORDINANCE WITH AN EFFECTIVE DATE OF JULY 1, 2005 AND TO ALSO ADOPT THE REGIONAL PLANNING COMMISSION'S RECOMMENDATIONS. The motion carried. Mr. Harper clarified that the City's motion did not include the Regional Planning Council's proposed recommendations. He said he had advised the RPC that it may not be appropriate as the local municipality cannot prohibit what the state law permits. COMMISSIONER PALACIOS WITHDREW HIS ORIGINAL MOTION AND MOVED TO STAY CONSISTENT WITH THE CITY'S ORDINANCE AND NOT INCLUDE THE RPC'S RECOMMENDATION OF STRIKING THE WORDS "LOAD BEARING AND DECORATIVE ". Commissioner Gamache seconded and the motion carried. ORDINANCE NO. 2005 -29, AN ORDINANCE concerning regulation of the placement of manufactured homes within the City of Yakima and amending Yakima Municipal Code section 15.04.120. (County Ordinance No. 6 -2005) The County Commissioners were excused at 4:08 p.m. After a short recess, the meeting reconvened at 4:25 p.m. The City Clerk read the resolution on the moratorium. SIMS MOVED AND PLACE SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2005 -95, A RESOLUTION of the City Council of the City of Yakima, Washington, adopting a sixty -day moratorium on the filing and acceptance of development applications for, and the location of, mobile homes and manufactured homes; exempting land uses for which a development application was pending upon the effective date of this resolution or which were legally in existence at such time; providing that the moratorium shall be in effect for sixty days, through August 27, 2005; and providing that violation of the moratorium is a misdemeanor. 4 177. JUNE 28, 2005 7. Public Hearing to consider an amendment to the Six -Year TIP for 2005 -2010 Kay Adams, City Engineer, explained that as projects get funded, amendments are made to line up with state and federal guidelines. He then outlined the 12 amendments that had been supplied to Council for review. Council Member Place noted that a County -wide pathway system connecting the Greenway, the Powerhouse Pathway, and Cowiche Canyon is not on the list and she would like it added. Council Member McClure suggested bundling the Naches rail spur in as well. Discussion covered the areas that were on the County's project list that have since been annexed into the city. Funding problems for those projects were discussed. Council Member Sims expressed concern that the citizens would be upset if these projects don't get done. Chris Waarvick, Public Works Director, suggested we take the initiative to contact the County and try to figure out a way to handle these projects. Council Member Sims wanted to re- establish a committee and include Council Member McClure on it to begin addressing these issues. • Mayor George opened the public hearing Shelly Hull, 419 Viewmont Drive, explained how, after 26 years of working with the County, their area was finally a high priority on the County's six -year plan and they were very close to getting their road paved, but now the annexation is taking place. She then described an e-mail she had received from Vern Redifer from the County dated June 17 that explained their priority rating system and funding issues. He said they would agree to go ahead with the paving if the City will assume the debt. As of July 10 this road will be annexed and comes off the County's road plan. She commented that the City's standards for paving gravel roads is inferior to what the County standards were, e.g. double shot rather than curbs gutters lighting like the rest of the road that is already completed. The residents are frustrated; this is a health and safety issue. During the annexation process they were assured, as part of the City, they will receive comparable, if not better, services. The residents are asking the City to honor those promises and are requesting the City proceed with the plans of paving these roads and meet the existing standards at either end of these roads. Council Member McClure said he wants to make sure the City's newest residents • are treated with respect and receive the services we promise to all of our citizens. We have promised double shot to make sure these roads are not dusty. Council Member Sims again emphasized that a City Council subcommittee needs to address this issue for this and other previously annexed areas. Lynne Kittelson, 305 North 9 Street, referred to items that had previously been submitted by the Bicycle /Pedestrian Committee. She requested those items be put back into the plan. She was assured they would be in the next plan amendment. She also asked when North 4 Street would be put on the list as it is in poor condition. • Mayor George closed the public hearing The City Clerk read the resolution by title only; PLACE MOVED AND McCLURE SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. 5 178 JUNE 28, 2005 RESOLUTION NO. R- 2005 -96, A RESOLUTION to amend the Six -year Transportation Improvement Program (STIP) for the period of 2005 through 2010 to include projects affecting the City's Transportation Plan. 8. First of two public hearings to consider: A. Adoption of the Six -year Transportation Improvement Program (STIP) for years 2006 to 2011, and to amend the Metropolitan Transportation Plan; and B. Amendment of the Yakima Urban Area Comprehensive Plan Capital Facilities Element to incorporate the adopted Six -year Transportation `Improvement Program (STIP). Kay Adams, City Engineer, explained that this is the standard update that is done every year to incorporate the capital facilities plan element. Council Member Place spoke about adding the Naches trail along the railway and the connectors and would also like to see improvements to the 16 Avenue crossing to the Greenway. She would also like to see something that included the Painted Rocks, although she wasn't sure they are within the city limits. Council Member Place also asked for a subcommittee meeting to be set up. • Mayor George opened the public hearing Lynne Kittelson, 305 North 9 Street, again asked about the list submitted from the Bicycle /Pedestrian Committee. It was noted some of the items were separately listed. Council Member Sims said the frontage road going through the previous Boise Cascade property, although a County construction project, could possibly be a joint one as it will come through the city limits. • Mayor George closed the public hearing CITY MANAGER'S REPORTS 9. Consideration of Resolution declaring a City -owned Washington State Flag surplus and authorizing its donation to Corporal Tapia serving in Iraq Mayor George read an e-mail the City received from Corporal Leo Tapia who is on his second tour in Iraq. Corporal Tapia requested a flag from his home, the City of Yakima, to fly to show what they are fighting for. Mayor George also read Sonya Brandt's response about the city flag not being possible but that we had a retired Washington flag that has become surplus and we would send it to him at Council's expense. The City Clerk read the resolution by title only; SIMS MOVED AND EDLER SECONDED, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2005 -97, A RESOLUTION declaring one used flag as surplus and donating it to Corporal Leo Tapia. 6 1:7.9; JUNE 28, 2005 10. Consideration of Resolution authorizing execution of intergovernmental agreement with West Valley Fire District #12 regarding transfer of assets Chief Mayo thanked Council for their leadership on this and commented that it is a win /win for people in the area and for the regionalization strategy. The City Clerk read the resolution by title only; BONLENDER MOVED AND McCLURE SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2005 -98, A RESOLUTION authorizing and directing the City Manager to execute an "Amendment to Interlocal Agreement Between The City of Yakima and Yakima County Fire Protection District No. 12 for Use and Maintenance of Fire Station No. 1" to extend the term of the original interlocal agreement through July 31, 2005. 11. Consideration of Resolution authorizing execution of intergovernmental agreement with West Valley Fire District #12 to provide mobile data services Brian Schaeffer, Deputy Fire Chief, explained that this is a resolution for sharing apparatus. We will be extending information services to West Valley to allow mobile data communications. Since we will be sharing their vehicles they will be brought up to the same standards. The City Clerk read the resolution by title only; SIMS MOVED AND PLACE SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2005 -99, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an Information Systems Service Agreement with Yakima County Fire Protection District 12 to provide Mobile Data Services. 12. Approval of the 2004 Annual Police Department Report This item was deferred to the July 5, 2005 meeting. *13. Consideration of Resolution authorizing execution of agreement with the YWCA for domestic violence victim's advocate services RESOLUTION NO. R- 2005 -100, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an Agreement with the YWCA to continue to provide domestic violence services. *14. Consideration of Resolution authorizing execution of professional services agreement with the Yakima Fourth of July Committee RESOLUTION NO. R- 2005 -101, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an agreement between the City of Yakima and the Yakima Fourth of July Committee to provide a fireworks display on the evening of July 4, 2005. *15. Set date of public hearing for July 6 19, 2005 to consider the Eichler -Hess Annexation July 19, 2005 was set as the date of public hearing to consider the Eichler -Hess Annexation, located in the vicinity between South 52 and 64 Avenues. ORDINANCES 20. Consideration of legislation relating to Downtown Future Initiatives Project for 2005: City Manager Zais gave an introductory explanation of the agenda item. This project is the first phase of priority projects set by Council and championed by Senator Deccio. The gas tax package is part of the funding. Chris Waarvick, Director of Public Works, described the contracts covered by resolution. He presented a replica of the plaque down at Kiwanis Park to Senator Deccio and gave a status report on the additional ball field planned for this year. He then spoke about how the Front Street project got started and assured citizens that none of the money will go to benefit the property owners. Only City property will benefit. A. Resolution authorizing execution of amendment to the contract with Huibregtse Louman Associates for engineering services for the Yakima Avenue and Front Street improvement projects The City Clerk read the resolution by title only; PLACE MOVED AND SIMS SECONDED TO ADOPT THE RESOLUTION. B. R- 2005 -103, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an agreement between the City of Yakima and the George H. Pechtel Corporation for project coordination and adjunct staff support services for the North Front Street Historic District and Yakima Avenue Pedestrian Corridor Improvements and all subsequent agreements and amendments, applications and other documents related to the successful furtherance of these projects. C. First reading of Ordinance amending the 2005 budget and appropriating State funds to the CBD Capital Improvement Fund for the Yakima Avenue and Front Street improvement projects (No action required; second reading scheduled for July 5, 2005) An Ordinance amending the 2005 budget and appropriating funds to provide for renovation of public walkways in the downtown area, was read by title only, and laid on the table until July 5, 2005 for a second reading. D. Consideration of appointments to the Downtown Futures Initiatives Oversight Council Committee Chris Waarvick read the names of the people on the committee (29 members, a list is available in the packet). He clarified that it is an advisory (oversight) committee and not a voting committee. SIMS MOVED AND PLACE SECONDED TO APPROVE THE APPOINTMENTS AS LISTED. The motion carried by unanimous roll call vote. *21. Consideration of Legends Casino Grant: A. Motion to accept a $5,000 Grant Council accepted the $5,000 grant from the Yakama Nation's Community Contribution Fund. 9 • 182 JUNE 28, 2005 B. First reading of Ordinance amending the 2005 budget and appropriating . funds to the EMS Fund from the Legends Casino Grant (No action required; second reading scheduled for July 5, 2005) An Ordinance amending the 2005 budget and appropriating funds to purchase grant - funded emergency communication equipment, was read by title only, and laid on the table until July 5, 2005 for a second reading. • *22. Consideration of Ordinance approving the Valleybrook Preliminary Plat located in the vicinity of South 72 and Washington Avenues requested by Zier Orchards, LLC RESOLUTION NO. R- 2005 -104, A RESOLUTION approving a preliminary plat, subject to certain conditions, for a fifty -eight (58) lot subdivision to be located on property (Parcel No. 181332 - 24005) in the vicinity of South 72 Avenue and West Washington Avenue, Yakima, Washington. *23. Consideration of Ordinance amending the Yakima Municipal Code to clarify and reaffirm the sick leave exchange cap for retiring management group employees ORDINANCE NO. 2005-30, AN ORDINANCE relating to personnel; clarifying that the sick leave exchange cap under certain conditions for management employees upon retirement is thirty seven thousand five hundred dollars ($37,500.00); and amending subsection E of Section 2.40.030 of Chapter 2.40 of the City of Yakima Municipal Code to reflect said clarification. *24. Second reading of ordinance amending the 2005 budget for CMAQ funding to provide funding for transit services to the cities of Selah and Union Gap An Ordinance amending the 2005 budget and appropriating funds to provide funding for transit services to the cities of Selah and Union Gap, previously having been read by title only, was brought before the Council for a second reading. ORDINANCE NO. 2005 -31, AN ORDINANCE amending the 2005 budget for the City of Yakima; and making an appropriation of $112,500 within the 462- Transit Operating Fund for expenditure during 2005 to execute a pilot program to extend transit services to the City of Selah and Union Gap. *25. Second reading of Ordinance amending the 2005 budget and appropriating funds for increased Dial -A -Ride program fees An Ordinance amending the 2005 budget and appropriating funds for increased Dial -A -Ride program fees, previously having been read by title only, was brought before the Council for a second reading. ORDINANCE NO. 2005-32, AN ORDINANCE amending the 2005 budget for the City of Yakima; and making an appropriation of $160,000 within the 462 — Transit Operating Fund for expenditure during 2005 to provide for a rate increase in Para - Transit (Dial -a -Ride) services. 10 1 8 3 JUNE 28, 2005 *26. Second reading of Ordinance amending the 2005 budget and appropriating funds for City improvements in the County's 96 Avenue Sewer Project An Ordinance amending the 2005 budget and appropriating funds to provide for the installation of a wastewater interceptor on 96 Avenue, previously having been read by title only, was brought before the Council for a second reading. ORDINANCE NO. 2005 -33, AN ORDINANCE amending the 2005 budget for the City of Yakima; and making appropriations to provide for the installation of a Wastewater Interceptor on 96 Avenue from Unappropriated Fund Balances within various Funds for expenditure during 2005. *27. Second reading of Ordinance amending the 2005 budget and appropriating funds from the Washington Traffic Safety Commission Funds for the purchase of warning signs associated with schools An Ordinance amending the 2005 budget and appropriating funds from the Washington Traffic Safety Commission grant for the purchase of school warning signs, previously having been read by title only, was brought before the Council for a second reading. ORDINANCE NO. 2005 -34, AN ORDINANCE amending the 2005 budget for the City of Yakima; and making an appropriation of $35,086 within the 141 — Street and Traffic Operations Fund for expenditure during 2005 to purchase school warning signs. 28. Other Business A. Consideration of potential adjustment in council members' compensation City Manager Zais explained that, per Council's request, a comparison study was conducted on council salaries around the sate. Any changes would apply in January of 2006 to those newly elected members and the other four will receive the increase following the next election for those positions. Mr. Zais explained the survey /comparisons and potential options were discussed. Council Member Sims suggested this topic should come up for review every two years. Council Member Whitman suggested looking into the possibility of medical insurance as a benefit. City Manager Zais agreed it is timely to look at the entire compensation package as it hasn't been done in twenty years. BONLENDER MOVED AND SIMS SECONDED TO DIRECT STAFF TO PREPARE AN ORDINANCE WITH A NEW PAY SCHEDULE EFFECTIVE JANUARY 1, 2006 AT A RATE OF $900 FOR COUNCIL MEMBERS, $1,125 FOR MAYOR PRO TEM, AND $1,350 FOR MAYOR. EDLER MOVED AND McCLURE SECONDED TO AMEND THE AMOUNTS IN THE MOTION TO $1,075 FOR COUNCIL, $1,350 FOR ASSISTANT MAYOR, AND $1,600 FOR MAYOR.
