Roll Call Present: Mayor Patricia Byers, presiding,Assistant Mayor Holly Cousens and Councilmembers Kay Funk, Brad Hill (attending via speakerphone), Eliana Macias (attending via speakerphone) and Jason White (attending via speakerphone and present at 5:44 p.m.) Staff: Acting City Manager Scott Schafer, City Attorney Sara Watkins and City Clerk Sonya Claar Tee Absent: Councilmember Soneya Lund (excused) 2. Pledge of Allegiance Mayor Byers led the Pledge of Allegiance. 3. Interpreter Services Mayor Byers introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order Councilmember Funk pointed out some procedural problems she believes occurred over the last two meetings, specifically the use of the word germane, which she would like discussed at the study session on Council Rules of Procedure.Assistant Mayor Cousens stated members have a right to call a point of order, which the Mayor rules on and can be appealed. She noted a Robert's Rules reference guide members have regarding calling a point of order. A. Proclamations i. National Health Center Week proclamation Mayor Byers proclaimed August 8-14, 2021, as National Health Center Week and Yakima Neighborhood Health CEO Rhonda Hauff and Board Chairman Don Hinman accepted the proclamation. B. Presentations/ Recognitions/ Introductions i. Introduction of Jennifer Ferrer-Santa Ines, Director of Finance and Budget Acting City Manager Schafer introduced Jennifer Ferrer-Santa Ines as the City's Finance and Page 1 of 5 366 Budget Director. 5. Council Reports A. Discussion of an application for a grant for a feasibility study for an anaerobic digester MOTION: Funk moved and Cousens seconded to direct staff to apply for a grant to conduct a Feasibility Study on possible waste reductionlmanagement with the use of anaerobic digester. The motion carried by unanimous vote, Lund absent. 6. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and Funk seconded to approve the consent agenda. The motion carried by unanimous vote, Lund absent. A. Approval of minutes from the July 20, 2021 City Council regular meeting and July 27, 2021 City Council study session B. Project Completion and Contract Acceptance for Arlington Stormwater Improvements Project SW2522 C. Project Completion and Contract Acceptance for the Wastewater UV Slide Gate Replacement Project#WP2525 D. Resolution authorizing an Interagency Agreement with the Washington Traffic Safety Commission for School Zone Rectangular Rapid Flashing Signage at Roosevelt Elementary and McKinley Elementary Schools RESOLUTION NO. R-2021-100,A RESOLUTION authorizing an Agreement with the Washington Traffic Safety Commission for School Zone Rectangular Rapid Flashing Signage at Roosevelt Elementary and McKinley Elementary Schools. E. Resolution ratifying the declaration of an emergency and authorizing execution of all applicable contracts for the labor and materials to replace 340 linear feet of failed sanitary sewer collection pipe RESOLUTION NO. R-2021-101,A RESOLUTION ratifying the declaration of an emergency and authorizing execution of all applicable contracts for the labor and materials to replace 340 linear feet of failed wastewater collection pipe. F. Resolution ratifying the declaration of an emergency and authorizing the rental of a biosolids dewatering centrifuge for the Wastewater Treatment Plant RESOLUTION NO. R-2021-102,A RESOLUTION ratifying the declaration of an emergency Page 2 of 5 367 and authorizing the rental of a biosolids dewatering centrifuge for the City's Wastewater Treatment Plant. G. Resolution authorizing an Agreement with Infrastructure Management Services for the Pavement Condition Index(PCI) of the City's streets RESOLUTION NO. R-2021-103,A RESOLUTION authorizing a Professional Services Agreement with Infrastructure Management Services to provide a Pavement Condition Index (PCI) rating for the streets within the City of Yakima. H. Resolution extending the existing Operations and Maintenance Agreement with the Yakima Area Arboretum RESOLUTION NO. R-2021-104,A RESOLUTION extending the existing Operations and Maintenance Agreement with the Yakima Area Arboretum 7. Public Comment Colleen Anderson, City resident, spoke in favor of a feasibility study for an anaerobic digester. The following individuals spoke in favor of a Charter amendment prohibiting a local income tax: Peter Marinace, City resident; Chris Cargill, non-resident and Eastern Washington Director at Washington Policy Center; Verlynn Best, Greater Yakima Chamber of Commerce; and, Representative Chris Corry. PUBLIC HEARINGS 8. Public Hearing and Ordinance on the Shoreline Master Program Periodic Update Joseph Calhoun, Planning Manager, briefed Council on the item. Mayor Byers opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the ordinance by title only. MOTION: Cousens moved and Funk seconded to pass the ordinance. The motion carried by unanimous vote, Lund absent. ORDINANCE NO. 2021-015,AN ORDINANCE amending the City of Yakima Shoreline Master Program, YMC Title 17. DEPARTMENT ITEMS 9. Ordinance amending the 2021 Budget for the City of Yakima; and increasing the Convention Center Fund 170 revenue budget with a $500,000 allocation from the American Rescue Plan Act (ARPA) Fiscal Recovery Funds (First Reading) Jennifer Ferrer-Santa Ines, Finance and Budget Director, briefed Council on the ordinance stating this is a first reading and will be brought back at the next meeting for passage. The City Clerk read the ordinance by title only. Page 3 of 5 368 AN ORDINANCE amending the 2021 Budget for the City of Yakima; and increasing the Convention Center Fund 170 revenue budget with a $500,000 allocation from the American Rescue Plan Act(ARPA) Fiscal Recovery Funds. 10. 2020 City of Yakima Transportation Benefit District Annual Report Acting City Manager Schafer reviewed the 2020 City of Yakima Transportation Benefit District Annual Report and answered questions from Council members. MOTION: Cousens moved and Funk seconded to accept the report. The motion carried by unanimous vote, Lund absent. 11. Yakima Police Department red light camera report Lieutenant Jim Moore provided a report on red light and speed camera enforcement and answered questions from Council members. Captain Shawn Boyle answered questions regarding the number of light duty officers and length of time an officer is typically in light duty status. 12. Requested Charter change language that would prohibit a local income tax City Attorney Watkins reported at the last Council business meeting, staff was directed to bring this issue to tonight's meeting. She noted some concerns with the resolution as there was not sufficient time to vet the issue. City Clerk Claar Tee noted the resolution was corrected from what was presented in the agenda packet and read the resolution by title only.After Council discussion, MOTION: Hill moved and Cousens seconded to call for the question. The motion carried by unanimous vote, Lund absent. MOTION: Cousens moved and Hill seconded to adopt the corrected resolution. The motion carried by a 4-2 vote, Funk and Macias voting no, Lund absent. RESOLUTION NO. R-2021-105,A RESOLUTION providing for the submission to the qualified electors of the City of Yakima at an election to be held on November 2, 2021, of a Proposition on whether Articles VII of the Charter of the City of Yakima should be amended to add new Section 7 establishing that there shall be no local income tax on residents within the City of Yakima, with exceptions; and requesting the Yakima County Auditor to submit the Proposition to the voters on the regular municipal general election to be held November 2, 2021. 13. Appointment of Members to Pro/Con Committees City Attorney Watkins reported the City issued a press release for community members interested in being on a pro/con committee; however, there has been no interest. 14. Other Business A. Executive session to consider acquisition of real estate under RCW 42.30.110(1)(b) MOTION: Cousens moved and Hill seconded to adjourn to Executive Session for up to 15 minutes to discuss acquisition of real estate under RCW 42.30.110(1)(b). The motion carried by unanimous vote, Lund absent, and adjourned at 7:06 p.m. Executive Session was held and adjourned at 7:20 p.m. when the meeting reconvened. Page 4 of 5 369 B. Other Business MOTION: Cousens moved and Byers seconded to schedule a public hearing to modify the Transportation Benefit District list. After Council discussion, the motion carried by unanimous vote, Lund absent. MOTION: Byers moved and Hill seconded to direct the City Manager to move forward with signing a real estate purchase and sale agreement. The motion carried by unanimous vote, Lund absent. 15. Adjournment MOTION: Cousens moved and Macias seconded to adjourn to the next Council business meeting on August 17 at 5:30 p.m. at City Hall. The motion carried by unanimous vote, Lund absent.
