A RESOLUTION ratifying the declaration of an emergency and authorizing the City
Manager to execute all applicable contracts for the replacement of
the chlorine generation cell in the Chlorine Generator at the Water
Treatment Plant.
WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima
Municipal Code Chapter 1 80 provide that the City Council may declare an emergency
dispensing with the necessity for bidding for services, material, and equipment and
supplies costing more than $25,000; and
WHEREAS, the chlorine generator cell has failed; and
WHEREAS, City of Yakima staff has disassembled the unit and analyzed the
components and determined the unit is failing; and
WHEREAS, the generator cell is not repairable; and
WHEREAS, the water treatment plant disinfection process is compromised; and
WHEREAS, the City Council finds that it is in the best interest of the City to
declare an emergency and authorize the execution of all necessary documents to
replace the chlorine generation cell for the chlorine generator at the water treatment
plant, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
An emergency is hereby declared and the City Manager is hereby authorized to
execute the purchase and all necessary documents to replace the chlorine generation
cell for the chlorine generator at the water treatment plant without calling for bids.
ADOPTED BY THE CITY COUNCIL this 1 day of October 2013.

SUMMARY EXPLANATION
The chlorine generator cell in the water treatment plant chlorine generator is rapidly failing and
� must be replaced This cell has a useful life of about 5 to 7 years before requiring replacement.
The current cell is 9 years old The replacement was being budgeted for and anticipated for the
2014 year However the replace must occur this fall.
Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1 80
provide that the City Council may declare an emergency dispensing with the necessity for
bidding for services, material, and equipment and supplies costing more than $25,000 The
generation cell costs some $47,000 plus tax and shipping
