The City Commission-met in regular session, Mayor Stratton and Commissioners Washburn
and Clark present on roll call.
Moved by Stratton, seconded by Clark that the minutes of the regular meeting of Monday,
January 4, 1932 be approved as read: carried, Stratton, Washburn and Clark voting aye
on roll call. --
Moved by Stratton, seconded by Clark that this being the time for receiving bids for
purchasing a fire pump for the Fire Department; it is ordered that the bid of the North-
western Fire Apparatus Company in the sum of $1,358.00 be accepted as the lowest and
best bid: carried, Stratton, Washburn and Clark voting aye on roll call.
Moved by Clark, seconded by Washburn that this being the time for the hearing on the
assessment roll in Local Improvement District No. 499, and there being no protests in
writing or otherwise to said assessment roll or any part thereof; it is ordered that
the ordinance confirming said assessment roll and every part thereof be passed as finall
read: carried, Stratton, Washburn and Clark voting aye on roll call.
ORDINANCE NO. B -24, entitled, "An Ordinance-confirming the assessment roll coverin
Local Improvement District No. 499, as created and. established by Ordinance No. B- g of
the Ordinances of the City of Yakima ", was introduced by Clark and read by the City Cler

reading and read by title only: carried, Stratton, Washburn and Clark voting aye on
roll call.

RESOLUTION NO. C -31, WHEREAS, negotiations have been carried on between the City of
Yakima and the Highway Department of-the State of Washington, looking toward the deed-
ing by the City of Yakima to the. State of Washington of a right of way for the portion
of said. highway known as State Road No. 5 - Oa.k Flat to Carmack Bridge, and State Road
No. 5 - Yakima to Nelson Bridge; and also for the making of an agreement between the
City of Yakima and the State of Washington, acting through the Director of Highways and
the Governor, referred to as the Highway Department, relative to a portion of said
highway known as State Road No. 5 - Yakima to Nelson Bridge, 'as the same affects an
irrigation reservoir-and a portion of the municipal water supply line near Painted Rocks,
belanging to the City of Yakima; and,
It appearing that said negotiations have culminated in a complete
understanding being reached between the City of Yakima and said Highway Department and
that it is necessary, in carrying out said agreements, that certain documents, as here-
inafter referred to, be executed;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA that the Mayor and the City Clerk of the City of Yakima are hereby
authorized and directed to execute, in behalf of the City of Yakima, that certain con-
tract, in triplicate, bearing date the 11th day of December, 1931, referring to said
irrigation.reservoir' and a portion of the municipal water supply line near Painted Rocks
as affected -by State Road No-. 5 - Yakima to Nelson Bridge. Also, said officers are
hereby authorized and directed to execute, on behalf of the City of Yakima, as grantor,
to the State of Washington, as grantee, that certain deed bearing date the 11th day of
January, 1932, describing that certainparcel of land, situate in Yakima County, State
of Washington, and described as follows, to -wit:
Beginning at the southwest corner of Section 10, Town-
ship 13 North, Tange 18, E.W.M.; thence north 0 006' west
along the west line of Section 10 a distance of 1397.4
feet to a point on the center line of State Road No. 5,
thence north 59 °58' west for a distance of 1102 feet to the
true point of beginning; thence south 0 1006' east a distance
of 34.7 feet; thence north 59 °58' west a distance of 75.4 -
feet; thence north 30 002' east a distance of 10 feet; thence
north 59058' west a distance of 230 feet; thence south 300
02' west a distance of 30 feet; thence north 59 058' west a
distance of 14 feet; thence north 0 006' west a distance of
130.1 feet; thence south 59058' east a distance of 334.0
feet; thence south 0 006' east a distance of 72.3 feet to
the true point of beginning, containing 0.666 acres, more
or less.
Also, said officers are hereby authorized and directed to execute,
in behalf of the City of Yakima, as grantor, to the State of Washington, as grantee,
that certain-'deed bearing date the 11th day of January, 1932, deeding that certain strip
of land 100 feet wide, (except as may be hereinafter specified), being 50 feet on the
northerly side and 50 feet on the southerly side of the center line of said road as
surveyed over and across the following described property, to -wit:
Southwest quarter of Northwest quarter of Section 35;
Southeast quarter of Northeast quarter, northwest quarter
of northeast quarter, northeast quarter of northwest quarter
of Section 34; Southeast quarter of Southwest quarter,
southwest quarter of southwest quarter of Section 27; all
in Township 15 North, Range 16, E.W.M., excepting that, from
Engineers Station 22 -00 to Station 23 -00, it shall be 70
feet wide on the north side of said center-line.
Except, also, that the width of right of way from En-
gineer's.Station 23 -00 to Station 30 -00 shall be 40 feet

wide on the southerly side of said center line.
It is expressly understood and agreed that the grantee
will protect all water rights accruing to the grantor and
will, in no wise, divert the water from the source of in-
take of the Yakima Municipal Water System between Engineer's
Station 23 -00 and Station 30 -00.

RESOLUTION NO. 0-32, A RESOLUTION authorizing the sale of Lot 10, Block 125, Town of
North Yakima, now Yakima, to Emilie Laurent.
WHEREAS, the City of Yakima is the owner of the following described
real property situated in Yakima, Yakima County, Washington, to -wit:
Lot 10, Block 125, Town of North Yakima,
now Yakima, -
according to the official plat thereof now on file and of record in the office of the
Auditor of YakimaCounty, Washington, by reason of a deed therefor issued by the Treasur-
er of the County of Yakima, State of Washington, to said City of Yakima, on sale of said
property for delinauent taxes, and
WHI EREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to Emilie Laurent upon the terms and conditions hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY_ COMMISSION OF THE CITY
OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby authorized
to be sold to Emilie Laurent for the total sum of Two Hundred Sixty and 00 /100 ($260:00)
Dollars, payable as follows: the sum of Fifty Two and 00 /100 052.00) Dollars in cash
upon the execution of the contract herein authorized and the balance of Two Hundred
Eight and 00 /100 ($208.00) Dollars in monthly payments of Six and 00 /100 ($6.00) Dollars,
beginning February 15, 1932, and continuing until the entire amount has been paid. All
deferred payments to bear interest at the rate of six (6j'a) per cent per annum payable
monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said. premi-
ses, and the Mayor and City Clerk os said City are hereby authorized and directed to
enter into a contract in duplicate with said purchaset� under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable pro -
visions requiring any buildings upon said premises to be insured at the expense of the
second parties in a solvent insurance company satisfactory to first party as its inter-
est may appear and shall contain a provision that in case.of destruction of or damage
to any buildings or improvements on -said premises such damage or loss shall be the loss
of second parties and shall not be a ground for rescission of said contract; and said
contract shall also contain a suitable provision providing for forfeiture thereof upon
failure of second party to make any payment of principal, interest, taxes or assessments
therein provided for when same shall become due or delinquent, notice of such forfeiture
to be for 30 days and service thereof to be by serving same personally upon second party
or by mailing to them at Yakima, Washington, and a'further provision shall be placed
therein that upon final payment of said principal and interest and taxes and assessments
the first party shall convey said premises to second party by a good and sufficient Quit
Claim Deed conveying all the interest said City of Yakima has now in said premises; and
the further provision shall be contained in -said contract against the assignment of
second party without the consent of first party had and obtained.
