The City Cor?rmission met in regular session,Mayor Dudley and Commissioners Hedges and
Coonse voting aye on roll call.
Moved by Dud.ley,seconded by Hedges, that the minutes of the regular meeting of Tuesday,
February 14th,1928, be approved as read;carried,Dudley,Hedges and Coonse voting aye on
roll call.
Moved by Dudley,second.ed by Coonse, that this being the time for receiving bids for the
city printing for 1928, and the Republic Publishing Company being the best bid,said
contract was awarded to them at the same price as for the year 1927 ;carri.ed,Dud.ley,
Hedges and Coonse voting aye on roll call.
Moved by Coonse, seconded. by Dudley, that this being the tune fo.r the hearing on
Resolution No-B-1045, for paving Eighteenth Avenue South- from West Chestnut Street "' to
Division Street and Bell Street from Eighteenth Avenue south to Seventeentl Avenl?e'
south, and there being no objections in writing or otherwise to said improvement,,or
any part thereof; it is ordered that the ordinance creating a local improvement distric
be laid on the table for one week;carried,Dudley,Hedges and Coonse voting aye on r6l1
call.
Moved by Coonse, seconded by Hedges, that this bein,? the time for the hearing on
Resolution No.B -1046 for paving Second Avenue south from 71est Yakima Avenue to West'
Walnut Street, and there being no objections in writing or otherwise to said improvemen
or any part thereof; it is ordered that the ordinance creating a' Local Improvement -
District be laid on the table for one week;carried,Dudley,Hedges and Coonse voting aye
on roll call.

The jCity Commission met 'pursuant to adjournment, Mayor Dudley and Commissionerc.

RESOLUTION NO.B -1047: THEREAS, the City of Yakima has in its possession certain personal
property now at and upon the property of the City of Yakima upon which is being con-
structed a reservoir for the City `eater System, which said personal property is as herei -
after described in the form of notice set out in this, resolution; and
WHEREAS, 'the City of Yakima does not desire to retain said property or to
exercise any control of said property;
NOW,THEREFORE, HE IT RESOLVED -BY =, CITY COMMISSION OF THE CITY OF YAKIMA, F'
WASHINGTON: that the following notice as hereinafter set out be served by the City Clerk
of the city of Yakima,Vlashington, upon Harry Boyer,Walter O.Boyer, and Grady and.
Velikanie and Richards,G.ilbert & Conklin, thei "r attorneys, said notice being as follows,
to -wit:

Referring to your communication dated the 23rd day of February,1928, ad.d.rebse
to the Honorable. Mayor and. City Commissioners of the City of Yakima,Washington:
We are instructed by the City Commission of the City of Yakima'Washington, to
inform you that the Commission has no objection to your taking immediate possession of
and. removing the following personal property nog, at and upon the property of the City of
Yakima upon which is being constructed a reservoir for the City Water System,to -wit:
Your contractors' equipment consisting of concrete mixers,hoisting rigs with
accessories, steel. cables, motors, transporting machihery, pumps,derricks,woodworking
machinery with accessories, field office furniture and fixtures, and all other tools and
appliances belonging to you and located as aforesaid;
Together with the office building,cement storehouse No.l, bunkers, hoisting
tower, cement storehouse No..2,oil house, blacksmith shop, runway to regulating tower,
all runways that are made up and. on reservoir roof, and. all miscellaneous loose lumber
and lumber in cribbing around the reservoir;
Also all cement and. cement sacks and other material not in place;
and you are instructed to remove the same within a period. of (10) days from the date
hereof, as the City is desirous of proceeding with the work.
You are further
possession of and use all
the same.
You are further
use all reinforcing steel
for the regulating tower,
property of the City, and
advised that the City insists upon its rights to maintain
forms for concrete work, and you are instructed not to'disturb
advised that the City insists upon its right to retain and -
also the roof for the r.egulating tower, platform and railing
and also all vitrified. sewer pipe, which we contend are the
which you are instructed. not to disturb.
We note your statement that your demand is made at this time as the , basi s upo
.which to found an action. This permission to remove the property designated is given
without any waiver of any existing rights of the City and without admission that you
'have a legal right to recover possession of said property or the value thereof.
