Moved by Washburn, seconded by -Riley that the following payrolls be allowed and. the City Clerk authorized to issue warrants as follows: City Street $1,265.17; Crusher $347.62; Cemetery $126.00; Cemetery Care $160.00; Park $392.00; Sanitation $782.75; L.I.D. Revolving $267.39; Irrigation $357.03 and Water $732.15: carried, Riley-, Wash- burn and Clark voting aye on roll call.'. Moved by Washburn, seconded by Riley that the following claims be allowed and the City Clerk authorized to issue warrants on the following funds: Current Expense $895.92; City Street $1,134.45; Cemetery $2.63; Fixed Estimate $7.25; Revolving $409.86; Irrigation $608.77; Water $14,992.39; Bond Sinking $35,5 3.96• Crusher $357.56; Water Deposit $387.00; P. Moved by Washburn, seconded by Clark that the City Engineer having reported the com- pletion of.the construction of the irrigation system in Local Improvement District No: 534, in the sum of $15,191.55; it is ordered. that said improvement be a.c.cepted and the City Engineer authorized to.prepare an assessment roll for said district and th.e.City Clerk instructed to give notice of-hearing on said assessment roll.f or Monday, October 23rd, 1939 at 10 o'clock A. Moved by Washburn, seconded by Clark that the City Engineer having reported the com- pletion of the construction of the irrigation system in Local Improvement District No, 538, in the sum of $6,450.53; it is ordered that said improvement be accepted and the City.Engineer authorized to prepare an assessment roll for said district and the City Clerk instructed to give.notice of hearing on said assessment roll for Monday, October 23rd, 1939 at ten o'clock A. M: carried, Riley, Washburn and. Clark voting aye on roll call. Moved by Clark, seconded by Washburn that this bein the time for the hearing on the assessment roll in.Local Improvement District No. 5�7, providing for the construction of curbs and gutters on Barge Street, et al and there being no objections in writing or otherwise to said assessment roll or any part thereof; it is ordered that the or- dinance confirming said assessment roll and every part thereof be passed as finally read: carried, Riley, Washburn and Clark voting aye on.roll call. ORDINANCE N0. B -398, entitled, "AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 547, as created and established by Ordinance No. B -373 of the ordinances of the City of Yakima," was introduced by Clark and read by the City Clerk. Moved by Washburn, seconded by Riley that Ordinance No. B -398 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -399, entitled, "AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 550, as created and established by Ordinance No. B -381 of the ordinances of the City of Yakima ", was introduced by Washburn and read by the City Clerk. Moved by Clark, seconded by Riley that Ordinance No. B -399 be passed to its second reading and read by title only: carried, Riley, Washburn and Clark voting aye on roll call. Delle, a property owner in said district as to the type-of material to be used, being the only objection to said improvement; it is ordered, that the or- dinance creating a local improvement district and proceeding with the work be passed as finally read: carried, Riley, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -400, entitled, "AN ORDINANCE providing for the improvement of property in the City of Yakima,.Washington, by the construction of pipe sewers; establishing a local improvement district;-providing for the method of payment therefor; and creat- ing a, special fund," was introduced by Clark and read by the City Clerk. C -438, A RESOLUTION authorizing the sale of the north 10 feet of Lot 7, and all of Lot.8, Block 57, Black's Addition to North Yakima.(now Yakima), according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County., Washington. WHEREAS, the City of Yakima is the owner of the following de- scribed real property situated in Yakima, Yakima County., Washington, to -wit: The north 10 feet of Lot 7, and all of Lot 9,' Block 57,'Bla.ck's Addition to North Yakima (now Yakima), according to the official plat thereof now on file and of record in the office of the Auditor of Yakima. County, Washington, by reason of deeds therefor issued by Ella. Rogers, Anna Aumiller, and Edith Sandmeyer, County of Yakima, State of Washington, to said City of Yakima, and WHEREAS, it appears to be for the.best interest of said City of Yakima to sell said premises to JOHN E. BEAUTROW, a single man, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE . CITY OF YAKIMA, WASHINGTON: That said above,described premises be and they are hereby author- ized to be sold. to JOHN E. BEAUTROW, a single man, for the total sum of Seven Hundred Fifty and No /100 ($750.00) Dollars, payable as follows: the sum of One Hundred. Fifty and No /100 ($150.00) Dollars in cash upon the execution of the contract herein author- ized and the b alance.of Six _Hundred and No /100 ($$600.00) Dollars in monthly payments of Seventeen and No /100 ($17.00) Dollars, beginning October 29, 1939, and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of six per cent per annum payable monthly with.principal payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or District hereafter created or arising from levies hereafter placed against said prem- ises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable provisions requiring any buildings upon said premises to be insured at the expense of the second parties in a solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case 6f destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of second parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make anh.payment of principal, interest, taxes or assessments therein provided for when same shall become due or' delinquent, notice of such forfeiture.to be for 30 days and service thereof tote by serving same person- ally upon second party or by mailing to them at Yakima, Washington, and a further pro- vision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the * first party shall convey said premises to second party by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained in said con- tract against the assignment of second party without the consent of first party had and obtained.
