Moved by Riley, seconded by Clark, that the minutes of the regular meeting of Monday, April 17th, 1939 and. adjourned meeting thereof be .approved as read.: carried, Riley, and Clark voting aye on roll call, Washburn absent. ORDINANCE NO. B -379, entitled, "AN ORDINANCE fixing the time of delinquency of install- ments of assessments levied for the payment of the cost of .the improvement in. Local Improvement District No. 542, and providing for the issuance of bonds with coupons at- tached for the payment of the unpaid portion thereof ", was introduced by Riley and read by the City Cle -rk.. Moved by Clark, seconded by Riley that Ordinance No. B -379 be passed to its second reading and read by title only: carried, Riley and Clark voting aye on roll call, Washburn absent. C -400, A RESOLUTION authorizing execution of Deed to fractional part of Lot 11, -Block 166 of College Addition to the. City of Yakima. WHEREAS, the City of Yakima is the owner of Lot 10, Block 166, College Addition to Yakima, excepting a fractional_ part in the Southwest corner^ owned by Lawrence A. Watkins and Marion A. Watkins, husband and Txife; and WHEREAS, ' La.wre.nc e A. Watkins and Marion A. Watkins, husband and wife, are the owners of Lot 11, Block 166, College Addition to the City of Yakima, less a fractional part thereof in the Northwest corner which is owned by the City of Yakima; and WHEREAS, it is desired that the City of. Yakima will convey to said Lawrence A. Watkins and wife, its interest in Lot -11,. in return for a. conveyance from said Watkins and .wife to the City of Yakima of their interest in Lot 10, so that the City of Yakima, will have title to all of Lot 10 and said Watkins and wfie shall have title to all of Lot 11; NOW,,THEREFORE,- BE IT RESOLVED THAT THE PROPER OFFICERS OF THE CITY OF YAKIMA BE, and they are hereby authorized to execute and deliver a proper Quit Claim Deed to L. A. Watkins and Marion W. Watkins, husband and wife, of all its interest in' Lot 11, Block 166 of College Addition in return for a Quit Claim Deed from said Watkins and wfie of all their interest in Lot 10, Block 166 of said College Ad- dition to the City of Yakima. C -401, A RESOLUTION authorizing the sale of a. strip of land 12 feet wide and 130 feet long; lying west of and adjacent to Lot -.9, Block 27, ElbArta Addition, and located in the Southwest 1/4 of the Southwest 1/4 of Section 13, Township 1.3 North, Range 18, E. W. M. WHEREAS,'the City of Yakima is the owner of the following descri ed real property situated. in Yakima County, State of Washington, to -wit: .A strip of land 12 feet wide and. 130 feet long .lying west of and adjacent to Lot 9, Block 27, Elberta Addition, and.located in the Southwest 1/4 of the Southwe ct 1/4 of Section 13, Township 13 North, Range 18, E. W. P11. by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima., State of Washington, to said City of .Yakima; on sale of said property for delinquent local improvement assessments, and WHEREAS, it appears to be for the best interest of said City of Yakima. to sell said premises to WILLIAM M. BARTO and DAISY E. BARTO, husband and wife, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said. above described premises be and they are hereby author- ized to be sold to WILLIAM M. BARTO and DAISY E. BARTO, husband.and wife, for the total sum of Forty -five and No /100 ($45.00) Dollars, and the Mayor, E. B. Said. agreement to b e entered into shall also contain suitable provision requiring any buildings, upon .said. premises to be insured at the expense of the second parties in a solvent insurance company satisfactory to first party as its_ interest may appear and shall contain a provision that in case of d'estruction of or damage to a.nv buildings or improvements on said premises sixth damage or loss shall be the loss .of .second parties and shall not be aground for rescission of said contract; and said. contract shall_ also contain a suitable provision providing for forfeiture thereof upon failure cf second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture 4o be for 30 days and service thereof to be by serving same person - ally upon second. parties or by mailing to them at Yakima., Washington, and t: further provision shall be placed. therein that upon final payment of said. principal and interest and taxes and a s s e ssment s the first party shall convey said premises to second parties by a good and sufficient suit Claim Deed conveying all the interest said City of Yakima has now in s aid premises; and the further provision shall be contained in said. con- tract against the'ass:i;gnment of second parties without the consent of first n_arty had and obtained.
