The City Commission.met in regular session, Mayor Riley and Commissioners Washburn and
Clark present on -roll call.
Moved by Riley, seconded by Washburn that the minutes. of the regular meeting of Monday,
April 3rd, 1939 be approved as read: carried, Riley, Washburn and Clark voting aye on
roll call .
Moved by Clark, seconded by Riley that the following payrolls be allowed_ and the City
Clerk authorized to issue warrants as follows: Sanitation Dent.-: $741.75; Street DP-0t.
$$1,600.13; Park Dept. $264.00; Crusher $157.50; Cemetery $147.00; Cemetery Care $$104.00;
Water Dent. $657.98: carried_, Riley, Washburn and Clark voting aye on roll call..
Moved by Riley, seconded by Washburn that the hearing on Resolution No. C --�90 and No.

RESOLUTION NO. C -393, A RESOLUTION authorizen the sale of Lot 18, Block 43, Tennant
& Miles' New Modern Addition to North Yakima fnow Yakima), according to the official
plat thereof now on file and of r ecord, in the office of the Auditor of Yakima County,
Washington.
WHEREAS, -the City of Yakima. is the owner of.the following de-
scribed real property situated'in Yakima., Yakima County, Washington, to -wit:
Lot 18, Block 433- Tennant & Miles' New Modern Addition
to North Yakima snow Yakima), according to the official
plat thereof now on file and of record in the office of
the Auditor of Yakima County, Washington.
by reason of a deed therefor issued by the Treasurer of Yakima, County, County of Yakima-,
State of Washington, to said City of Yakima, on sale of said property for delinquent
taxes, and
WHEREAS; it appears t6 be for the best interest of said City of
Yakima to.sell said premises to BERNARD E. AYERS, a single man, upon the terms and con-
ditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY C012v7ISSION OF THE
CITY OF YAKIMA, WASHINGTON.
That said. above described premises be and they are hereby author-
!zed- to be sold to BERNARD E AYERS, a single man, for the total sum of Two Hundred
and No /100 ($200.00) Dollars, payable as follows: the sum of Forty and No /100 ($40.00)
Dollars in cash upon the ?.iecution of the contract hereinf authorized and the balance of
One Hundred Sixty and No /100 ( $160.00) Dollars in monthly payments of Five and No /100
($5.00) Dollars, beginning May 10, 10,39, and continuing until the entire amount has bee
paid. All deferred payments to bea interest at the rate of six per c ent Der annum
payable monthly with principal payments.
The purchaser under said contract shall_ also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising f rom levies hereafter placed againot said
premises, and the Mc.yor and City Clerk of said City are hereby authorized and directed
to enter into a contract in duplicate with said purchaser under the terms herei.nabove
set forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured_ at the expense of
the second parties in a solvent insurance company sati *sfactory to first pa.rt,y as its
interest may appear and shall_ contain a provision that in case of destruction of or
damage to any buildings or improvementson said. premises such damage or loss shall be
the loss of second. ?aarties and shall not be a ground for rescission of said contract;
and. said contract shall also contain a, suitable provision providing for forfeiture
thereof upon fa_ilu.re of second party to make any payment of principal, interest, taxes
or assessments therein provided- for when same shall become due or delinq�_zent, notice
of such. forfeiture to be for 30 days and. service thereof to be by serving same peraon-
ally upon second tarty or by mailn?; to them at Yakima, Washington, and a further pro -
vision shall be placed therein that upon final payment of said. principal and interest
and taxes and assessments the first party shall convey said premises to second party
by a good and sufficient Quit Claim Deed conveying all. the interest said City of Yakima
has now in said premises; and the further provision shall be contained. in said. contract
against the assi:gnm.ent of second party wityout the consent of .first party I'-.ad and ob-
tained. .

Moved by Washburn, seconded by Riley that this being the time for receiving bids on
the $35,000 General obligation Bond issue for the purpose of purchasing equipment for
the Street, Fire and Sanitation Departments and construction of -the Municipal Airport
and the bid of the City of Yakima for par, $100.000 premium and 2 % interest being the
lowest and bes bid; it is ordered that said. City of Yakima, be awarded the contract
for the nurch.ase of.said bonds: carried, Riley, Washburn and. Clark voting aye on roll
call.
Moved by Riley, seconded by Washburn that we d o now adjourn until Friday, April 14th,

division, Yakima, Washington.
WHEREAS, the City of Yakima is the owner of the following de-
scribed real property situated in Yakima, County, State of Washington, to -wit:
Lot 19, Cherry Avenue Subdivision, Yakima., Washington,
according to the official plat thereof now on file and
of record in the office of the Auditor of Yakima County,
Washington,
by reason of a deed_ therefor issued by the Treasurer of the City-of Ya'_rima, Washington,,)
and the Treasurer of Yakima County, Washington, to said City of Yakima, on sale of
said prooerty for delinquent local improvement assessments and. cblinquent rea.7_ estate
