Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Satur- day, Feburary 4th, 1939 be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Washburn that the City Engineer having reported the.com- pletion of the Pitcher Street Water District, Loca.l.Improvement District No. 542, in the sum of $2,293.21; said work is hereby accepted and the City Engineer authorized to prepare an assessment roll for said district and the City Clerk is hereby instructed to give notice of 'hearing on said. roll for Monday, March 6th, 1939 at 10 o' clock A. M. carried, Riley, Washburn and Clark voting aye on roll call. Moved by Clark,.seconded. by Washburn that this being the time for receiving bids for material for the South Nob Hill Sewer System, Local Improvement District No. 545• the following were awarded: Yakima Cement Products, Items 1, 2, 3, 4, 6 and It $10 474.10; A. B. Fosseen & Co., Items 9 and 10 $737.25;. Arrowsmith.Iron.Works; Item!7-1' $884.95• carried, Riley, Washburn and Clark voting aye on roll call.. RESOLUTION NO. C -377, WHEREAS, by ordinance it is provided that on the first Monday in February of each year, the City, Commission of the City of Yakima, Washington, shall pass a re- solution prescribing the form of contract for the city advertising for.the ensuing year; NOW, THEREFORE, BE'T'IT RESOLVED, by the City of Yakima, that the form of contract for the city advertising for the ensuing year shall be in substan tially the form hereto attached and made a part hereof, and the City Clerk is hereby directed to give notice for sealed proposals for a contract for doing the city adver- tising for the ensuing year by publishing the same in the newspaper doing the city advertising, for two successive issues, which notice shall contain a general statement of the terms of the contract to be let, together with the time and place when said bidb,.! will be opened, and providing that any and all bids may be rejected. C -378, A RESOLUTION authorizing the sale of the north 93 -1/3 feet of the east 108.4 feet and the south 140. feet of the east 108.4 feet of Lot 5 , Ker's Villa Lots, according to the official.pla.t thereof now on file and of record in the office of the Auditor of Yakima County, Washington. WHEREAS, the City of Yakima is the owner of the following de- scribed real property situated in Yakima., Yakima County, Washington, to -wit The north 93 -1/3 feet of the east 108.4 feet .and the south 140 feet of the east 1.08.4 feet of Lot 54, Ker's Villa Lots, according to the officila plat thereof now on file and of record in the office.of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treas- urer of Yakima County, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent taxes, and WHEREAS, it appears to be for the best interest of said City of Yakima. to sell said premises to A. W. PJIOGREN, a married man whose wife's name is Alma Mogren, upon the germs and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF-THE CITY OF YAKIMA, WASHINGTON: That said above described. premises be and they are hereby author- ized to be sold to A. W. MOGREN, a married.man, for the total sum of Six Hundred Seven- ty -five and No /100 ($675.00) Dollars, payable.as follows: the sum of Seventy- five'and No /100 ($75.00) Dollars in cash upon the execution of the contract herein authorized and the b alance.of-Six Hundred and No /100 (600.00) Dollars in monthly payments of Ten and No /100 ($10.00) Dollars, beginning March 6, 1939 and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of six per cent per annum payable monthly with.principal payments. The purchaser under said contract shall also agree to pay all assessments, including curb and gutter assessments, against said premises falling due under any Local I,,,provement District or Districts hereafter created or arising from levies hereafter placed against said premises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contrast in dun licate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable a provisions ny buildings upon said premises to be insured at the expense of the second parties in a. solvent insurance company satisfactory* to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall_ be the loss of second parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and, service thereof to be by serving same person- 52-15 February 6, 193Q ally upon second party or by mailing to them-at Yakima, Washington, and a. further pro - vision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the first party,shall convey said premises to second party by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima, has now in said premises; and the' further provision shall be contained in said contract against the assignment of second party without the consent of first party had and obtained. W. M., thence south 54 feet, thence west 65 feet, thence northwesterly to a. point due .vest of beginning, thence east 85 feet to beginning. (Tract 194 -e). The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against s,39.d.prem- ises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth.
