The City Commission met in regular session, Mayor Temple and Commissioners Washburn
and Clark present on roll call.
Moved by Temple, seconded by Clark that the minutes of the regular meeting of 'Tuesday,
September 7, 1937 and adjourned meetings thereof be approved as read: carried, Temple,
Washburn and Clark voting aye on-roll call.
Moved by Clark, seconded by Temple that the City Engineer having reported the comple-
tion of-the improvement in Local Improvement District No. 514, by the contractor in
the sum of $2,397.06; it is ordered that said improvement and every part thereof be
accepted and the City Engineer authorized to prepare an assessment roll for said dis-
trict and the City Clerk is hereby authorized to give notice of hearing on said roll
for Monday, October 4, 1937 at 9 o'clock A. M: carried, Temple, Washburn and Clark
voting aye on roll call.
Moved by Clark, seconded by Temple that the following payrolls be allowed and..t,he City
Clerk authorized to issue warrants as follows: Cemetery $168.00; Cemetery Care $294.
00; City Street Dept. $1,356.44; Parks $310.38; Sanitation $630.50; City Street;; Projects
$1,638:54 :' carried, Temple, Washburn and Clark voting aye on roll call.
ORDINANCE'NO.'B -238; entitled;^ "AN ORDINANCE amending Sub - section (b) of:-Section 3 ;
Section: 45, Section 46;.Section:56, Section 59, Section 67,.Section.69,� Sub - section (b)"
of Section 72, Section 92, Section 94 and Sub - section (a) of Section 108, of Ordinance
No. B -131, passed and approved February 26, 1936, and entitled: "AN ORDINANCE relating
to and regulating traffic, travel and transportation and their incidents upon the
streets and other ways open to the public; prescribing the powers and duties of officers
and others in relation thereto; defining offenses; providing penalties and repealing
certain ordinances concerned with or relating to the subject matter of this ordinance,
and declaring an emergency ", and declaring an emergency ", was introduced by Temple
and read by the City Clerk.
Moved by. Clark, seconded by Washburn that Ordinance No. B -239 be passed to its second
reading and read by title only: carried, Temple, Washburn and Clark voting aye on
roll call.
Moved by Clark, seconded by Washburn that Ordinance No. B -238 be passed to its third
reading and read in full: carried, Temple, Washburn and Clark voting aye on roll call.
Moved by Clark, seconded by Washburn that Ordinance No. B -239 be passed as finally'
read: carried, Temple, Washburn and Clark voting aye on roll call.
ORDINANCE NO. B -239, entitled, "AN ORDINANCE relating to health and sanitation; pro -
viding for and regulating the collection and disposal of garbage, refuse and dead
animals in the City of Yakima; regulating the operation of the City Dump and the City
Incinerator; providing penalties for the violation hereof; repealing Ordinance No.
A -619 and - Section 103 of Ordinance No. A -205, and all other ordinances and parts of
ordinances in conflict herewith.
Moved by Clark, seconded by Washburn that Ordinance No. B -239 be passed to its second
reading and read by title only: carried, Temple, Washburn and Clark voting aye on
roll call.
Moved by Clark, seconded by Washburn that Ordinance No. B -2.39 be passed to its third
reading and read by title only: carried, Temple, Washburn and Clark voting aye on
roll call.
Moved by Clark, seconded by Washburn, that Ordinance No. B -239 be passed as finally
read: carried, Temple, Washburn and Clark voting aye on roll call.

The City Commission met pursuant to adjournment, Mayor Temple and Commissioners Wash-
burn and Clark present on roll call.
RESOLUTION NO. C -277, A RESOLUTION authorizing the sale of Lot 16, Block 272, Ker's
and Capitol Additions to North Yakima (now Yakima), according to the official plat
thereof now on file and of record in the office of the Auditor of Yakima County,
Washington.
WHEREAS, the City of Yakima is the owner'of the following de-
scribed real property situated in Yakima, Yakima County, Washington, to -wit:
Lot 16, Block 272, Ker's and Capitol
Additions to North Yakima (now Yakima),
according to the official plat thereof now on file and of record in the office of the
Auditor of Yakima County,. Washington, by reason of a deed therefor issued by the
Treasurer of Yakima County, County of Yakima, State of Washington, to said City of
Yakima, on sale of said property for delinquent taxes, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to GUST GUSTAFSON, a married man, upon the terms and con-
ditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON.
That said above described premises be and they are hereby author -11

ized to be sold to GUST GUSTAFSON, a married mans. for the total sum of Twelve Hundred
Ninety and No /100 ($1290.00) Dollars, payable as follows: the sum of Two Hundred Fifty-
eight and No /100 ($255.00) Dollars in cash upon the execution of the contract herein
authorized and the balance of Ten Hundred Thirty -two and No /100 ($1032.00) Dollars in
monthly payments.of Thirty and No /100 ($30.00) Dollars;, beginning October 14, 1937,
and continuing until the entire amount has.been paid. All deferred payments to bear
interest at the rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said prem-
ises, and the Mayor and City Clerk of said City are hereby authorized and directed to
enter into a contract in duplicate with said purchaser under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon.said premises to be insured at 'the expense of
the second parties in a solvent insurance•company satisfactory to first party as its
interest may appear and shall contain a provision that in case of destruction of or
damage to any buildings or improvements on said premises such damage or loss shall be
the loss of second parties and shall not be a ground for rescission of said contract;
and said contract-shall also contain a suitable provision providing for forfeiture
thereof u.00n failure of second party to make any payment of.principal, interest, taxes
or assessments therein provided for when same shall become due or delinquent, notice
of such forfeiture to be for 30 days and service thereof to be by serving same person-
ally upon second party or by mailing to them at Yakima;: Washington, and a further pro-
vision shall be placed therein that upon final payment.of said principal and interest
and taxes and assessments the first party shall convey said premises to second party
by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima
has now in said premises; and the further provision shall be contained in said contract
against the assignment of second party without the consent of first party had and ob-
tained.

& Miles' New Modern Addition to North,Yakima fnow Yakima), according to the official
plat thereof now on file and of record in the office of the Auditor of Yakima County,
WHEREAS, the City of Yakima is the owner of the following de-
scribed real property situated in Yakima, Yakima County, Washington, to -wit:

ing to the official plat thereof now on file
and of record in the office of the Auditor of
Yakima County,

linquent assessments, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said-premises-to CALLIE WHITNEY, a married woman upon the terms and
conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby author-
ized to be sold to CALLIE WHITNEY, a married woman, for the total sum of One Hundred
Seventy -five and No /100 ($175.00) Dollars, payable as follows: the sum of Thirty -
five and No /100 (035.00) Dollars in cash upon the execution of the contract herein
authorized and the balance of One Hundred Forty and No /100 ($140.00) Dollars in monthly
payments of Five and No /100 ($5.00) Dollars, beginning October 16, 1937, and continu-
ing until the entire amount has been paid. All deferred payments to bear. interest at
the rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
