Moved by Temple, seconded by Washburn that the minutes of the regular meeting of Mon- day, October 26, 1936 and adjourned meetings thereof be approved as read: carried, Temple;. Washburn and Clark voting aye on roll call. Moved by Clark, seconded by Washburn that the City Engineer having reported the comple- tion of the improvement in Local Improvement District No. 510 by the Contractor in the sum of $4,392.93, it is hereby ordered that said improvement be accepted and the City Engineer instructed to prepare an assessment roll for said district and the City Clerk is hereby instructed to give notice of hearing on said roll by publication as required by law for Monday, November 30th, 1936 at 9 o'clock A. M,: carried, Temple, Washburn and Clark voting aye on roll call. Moved by Temple, seconded by Clark that we do-..now adjourn to meet Thursday, November 5th, 1936 at 10 o'clock A. M: carried, Temple, Washburn and Clark voting aye on roll call. ADJOURNED MEETING, THURSDAY, NOVEMBER 5, 1936, 10 A. M. The City Commission met pursuant to adjournment, Mayor Temple and Commissioners Wash- burn and Clark voting present:: °onl.roll call. RESOLUTION NO. C -217, WHEREAS, the City of Yakima is the owner of the following real estate, situated in Yakima County, ':State of Washington, to -grit: Beginning 30,feet south and 252.43 feet west of the northeast corner of the northwest quarter of Section 30, Township 13 North, Range 19, E. W. M., thence south 24°18' east 167.42 feet to the true point of beginning; thence south 24015' east 100 feet; thence southwesterly at right angles a distance of 285.3 feet to the easterly line of South First Street; thence northwesterly along the easterly line of South First Street a distance of 100 feet; thence northeasterly at right angles a distance of 285.3 feet to the point of beginning; and WHEREAS, it appears to-be for the best interest of said City of Yakima, a. municipal corporation, to sell said premises to STATE LUMBER CO., INC., a Washington corporation, upon the terms and conditions hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That the above described premises be and they are hereby author- ized to be sold to STATE LUMBER CO., INC., a Washington corporation, for the total sum of X3,550.00, of which the sum of 50.00 shall be paid down upon the execution of con- tract of sale therefor, the further sum of $58.00 to be paid November 1, 1937, and a like amount to be paid on the 1st day of each and every month thereafter until said purchase price shall have been paid in full; all deferred payments to bear interest at the rate of six per cent. per annum, payable November 1, 1937, and monthly there- after, in addition to said monthly payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any local improvement district or districts hereafter created or arising from levies hereafter placed against said premi- ses, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable provisions requiring any buildings upon said premises to be insured at the expense of the second party in a solvent insurance company satisfactory to first party as its interest may appear, and shall contain a provision that in case of destruction of or damage to any building or improvements on said premises such damage or loss shall be the loss of second party and shall not be a ground for rescission of said contract; and shall also contain a suitable provision providing for forfeiture thereof upon fail- ure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfei- ture to be for 30 days and service thera-f to be by serving same personally upon second party or by mailing to it at Yakima, Washington, and a further provision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the first party shall convey said premises to second party by good and sufficient bargain and sale deed conveying all the interest said City of Yakima now has in said premises; and the further provision shall be contained in said contract against the assignment of the same by second party without the consent of first party first had and obtained. C -218, WHEREAS, the City of Yakima is the owner of the following real c IIestate, situated in Yakima County, State of Washington, to -wit: Beginning 30 feet south and 252.43 feet west of the northeast corner of the northwest quarter of Section 30, Township 13 North, Range 19, E.W.M., thence south 240181 east a distance of 50 feet to the true point of be- ginning; thence south 24 -181 east 117,42 feet; thence southwesterly at right angles a distance of 160.3 feet; thence north 24018' west 100 feet; thence northeasterly at right angles a distance of 20.3 feet; thence north 24419' west 17.42 feet; thence northeasterly at right angles 140'feet to the point of beginning; and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to STATE LUMBER CO., INC., a Washington corporation, upon the terms and conditions hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That the above described premises be and they are hereby author- ized to be sold to STATE LUMBER CO., INC., a Washington corporation, for'the total sum of $1,450.00, of which purchase price the sum of $250.00 is to be paid down upon the execution of contract of sale therefor, the further sum,of $100.00 to be paid one month from the date of such contract, the further sum of $100.00 to be paid tow months from the date of such contract, $30.00 to be paid three months from the date of such con- tract snd a like amount'to be paid each and every month thereafter until the full pur- chase price shall have been paid; said purchase price to bear interest at the rate of six per cent per annum, same to be computed on deferred monthly balances and to be paid monthly in addition to said monthly payments. RESOLUTION NO. 0-219, WHEREAS, the City of Yakima is the owner of the following real estate, situated in Yakima County, Washington, to -wit: The east 470 feet of the south 700 feet of the west half of the southwest quarter of the north- east quarter of Section 20, Township 13 North, Range 19, E. W. M., and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to E. J. Hardison and Genevieve Hardison, husband and wife, upon the terms and conditions hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That the above described premises be and they are hereby author- ized to be sold to E. J,`HARDISON and GENEVIEVE HARDISON, husband and wife, for the total sum of One Hundred Ten and No /100 ($110.00) Dollars, to be paid in cash upon de- livery of deed therefor. That the Mayor and City Clerk of said City of Yakima be and they are hereby authorized and directed to execute a good and sufficient quit claim deed fl for said described premises -to said purchasers, and to deliver said deed upon full pay- ment of said purchase price.
