The City Comr.,iission met in -re,�ular stession , Mayor Temple and Commissioners Washburn
and Clark present on roll call.
Moved by Temple, seconded by Washburn that the minutes of the regular meeting of Monday,
August 3rd, 1936 and adjourned meetings thereof be approved as read: carried, Temple,
Washburn and Clark voting aye on roll call.
(.roved by Washburn, seconded by 'Temple that the following payroll be allowed and the City
Clerk authorized to issue warrants as follows: Secondary Highway $997.50: carried,
Temple, Washburn and Clark voting aye on roll call.
Moved by Washburn, seconded by Temple that this being the time for the hearing on
Resolution No. C -198 to construct an irrigation system on 18th Avenue, Park Avenue, and
other streets in the City of Yakima and there being insufficient protest in writing or
otherwise to said proposed improvement or any part thereof; it is ordered that the or-
dinance creating a local improvement district be passed: carried, Temple, Washburn and
Clark voting aye on roll call.
ORDINANCE NO. B -152, entitled, "AN ORDINANCE providing for the improvement of property
in the City of Yakima, Washington, by constructing the necessary pipe lines and appur-
tenances and acquiring the necessary ,rater and water rights to supply various lots and
tracts of land with water for irrigation purposes; establsihing a local improvement
district, providing for the method of payment therefor and creating a, special fund,"
was introduced by Washburn and read by the City Clerk.
Moved by Temple, seconded by Washburn that Ordinance No. B -152 be massed to its second
reading and read by title only: carried, Temple, Washburn and Clark voting aye on roll
call.
Moved by Temple, seconded by Washburn that Ordinance No. B -152 be passed to its third
reading and read in full: carried; Temple, Washburn and Clark voting aye on roll call.

Moved by Washburn, seconded by Temple that this bein, the time for the hearing on the
assessment roll in Local Improvement District No. 50, and there being no protest in
writing or otherwise to said assessment roll or any part thereof; it is ordered that
the ordinance confirming said assessment roll and every part thereof be passed as finally
read: carried, Temple, Washburn and Clark voting aye on roll call.
ORDINANCE NO. B -153, entitled, "AN ORDINANCE confirming the assessment roll covering Lo-
cal Improvement District No. 506, as created and established by Ordinance No. B -1.18 of
the Ordinances of the City of Yakima ", was introduced by Washburn and read by the City
Clerk.

call.

RE'SOLUTIO'N NO. C -203, A RESOLUTION authorizing the sale of a strip 12 feet wide and
lying west of Lot 12, Block 27, Elberta Addition to North Yakima (now Yakima) in the
Southwest I of the Southeast l of the Southwest q of Section 13, Township 13 North, Range
18 E. W. M., according to the official plat thereof now on file-and of record in the
office of the Auditor of Yakima County, Washington, (City Tract No. 127)
WHEREAS, the City of Yakima is the'owner of the following describe
real property situated in Yakima, Yakima County, Washington, to -wit:
A strip 12 feet wide and lying west of Lot 12 Block 27,
Elberta Addition to North Yakima ( now Ya. kimaj in 'the
Southwest i of the Southeast 4 of the Southwest 4 of
Section 13, Township 13 North, Range 18 E. W. M..(City
Tract No. 127)
according to the official plat thereof now on file and of record in the office of the
Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasur
er of the City of Yakima, County of .Yakima, State of Washington, to said City of Yakima,
on sale of said property for delinquent assessments, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said. premises to I. L. LUISI and LUISA LUISI, husband and wife, un_on
the terms and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby author-
ized to be sold to I: L. LUISI and LUISA LUISI, husband and wife, for the total sum of
Forty -five and No /100 ($45.00) Dollars, payable as follows: the sum of Ten and No /100
($$10.00) Dollars in. cash upon.the execution of the contract herein authorized and the
balance of Thirty -five and No /100 ($75.00) Dollars in payments of Fifteen and No /100
Dollars on August 8, 1936 and Ten and No /100 ($10.00) Dollars, on September 10, 1936,
and $10.00 on October 10, 1936. All deferred payments to bear interest at the rate of
six per cent Der annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all

assessments againsttisaid premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said. premises
and the Mayor and City Clerk of said City are hereby authorized and directed to enter
into a contract in duplicate with said purchaser under the terms hereinabove set; forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured at the expense of
the second parties in a solvent insurance company satisfactory to first party as its
interest may appear and shall contain a.- provision that in case of destruction of or
damage to any buildings or improvements on said premises such damage or loss shall be
the loss of second parties and shall not be a ground, for rescission of said contract;
and said contract nshall also contain a suitable provision providing for forfeiture there
of upon failure of second party to make any payment of principal, interest, taxes or
assessments therein provided for when same shall become due or delinquent, notice of
such forfeiture to be for 30 days and service thereof to be by serving same personally
upon second parties or by mailing to them at Yakima, Washington, and a further provision
shall be placed therein that upon final payment of said principal and interest and taxes
and assessments the first party shall convey said premises to second parties by a good
and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now
in said premises; and the further provision shall be contained in said contract against
the assignment of second parties without the consent of first party had and obtained:
