RESOLUTION NIO. C -197, A RESOLUTION authorizing the sale of Part of the South ! of the
Northeast 114 of the Northeast 1/4 of Section 26, Township 13 North, Range 18 E. W. M.,
beginning 360 feet west and 337.6 feet north of the Southeast corner, thence west 130
feet; thence north 42.2 feet; thence east 130 feet; thence south 42.2 feet to beginning,
WHEREAS the City of Yakima is the owner of the. following described
real property situated in Yakima, Yakima County, Washington, to -wit:
Part of the South 1 of the Northeast 1/4 of the Northeast
1/4 of Section 26, Township 13 North, Range 18 E. W. Its.,
beginning 360 feet west and 337.6 feet north.of the southeast
corner, thence west 130 feet- thence north 42.2 feet; thence
east 130 feet;:'thence south 42.2 feet to beginning,
according to the official plat thereof now on file and of record in _the office of the
Auditor of Yakima C:ouhty, Washington, by reason of a deed therefor issued by the Treas-
urer of the County of Yakima, State of Washington, to said City of Yakima, on sale of
said property for delinquent assessments, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to JOHN D. HINDS and ADA C. HINDS, husband and wife, upon
the terms and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMP't%iISSION OF THE CITY
OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby author-
ized to be sold to JOHN D. HINDS and ADA C. HINDS, husband and wife, for the total sum
of Four Hundred Eighteen and 25/100 ($419.25) Dollars, payable as follows: the sam of
One Hundred_ Eighteen and 25 /100 Dollars incash upon the execution of the contract here-
in authorized and the balance of Three.Hundred and No /100 ($300.00) Dollars in Monthly
payments of Nine and No /100 ($9.00) Dollars, beginning August 20, 1936, and continuing
until the entire amount has been paid. All deferred payments to bear interest at the
rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said. prem-
ises, and the Mayor. and City Clerk of said City are hereby authorized and directed to
enter into a contract in duplicate with said purchaser under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable pro-
visions requiring any buildings upon said premises to be insured at the expense of the
second parties in a solvent insurance company satisfactory to first party as Its inter-
est may appear and shall contain a provision that in case df destruction of or damage
to any buildings or improvements on said premises such damage or loss shall be the loss
of second parties and shall not be a ground for rescission of said contract; and said
contract shall also contain a suitable provision providing for forfeiture thereof upon
failure of second party to make any payment of principal, interest, taxes or assess-
ments therein provided for when same shall become due or delinquent, notice of such
forfeiture to be for 30 days and service thereof to be by serving same personally upon
second parties or by mailing to them at Yakima, Washington, and a further provision
shall be placed therein that upon final payment of said principal and interest and taxes
and assessments the first party shall convey said premises to second parties by a good
and sufficient Quit; Claim Deed conveying all the interest said City of Yakima has now in
said premises; and the further provision shall be contained in said contract against the
assignment of second parties without the consent of first party had and obtained..

days of the date of the Washington State Fair which begins September 14th and ends

City Clerk authorized to issue warrants as follows: Park Dept. 1567-56; Cemetery
$$75.60; Cemetery Care $402.75; Street Dept. $487.45; Sanitation 29.00; Secondary

RESOLUTION.NO. C -1G8, BE IT RESOLVED BY THE CITY C01JtMISSION OF THE CITY OF YAKIMA, WASH-

INGTON:
That it is its intention to construct an irrigation system to serve
all the lots, blocks and parcels of land included within the real estate hereinafter
described, said improvement to consist of the acquiring of the necessary water rights,
right of way easements, and the completion of the necessary laterals, service.connection
and other appurtenances for the purpose of delivering water for irrigation purposes to
each lot and tract of land within the proposed district.
That the district to be served by and assessed.for the above de-
scribed Improvement is described as follows, to -wit:
Beginning at the intersection of Eighteenth
Avenue North with Summitview Avenue; thence
west to the east line of Lot 7 of Colton
Orchard Tracts; thence north to the north
line of Lot 7; thence west along the north
line of Lots 7, 8, 9 and 10 to the east line
of 21st Avenue North; thence north along
21st Avenue North to the north line of Lot
26, Nob Hill Home Acres; thence southeasterly
along said north line of Lot 26 to the east
line of same; thence south to the north line
of Lot 17, Nob Hill Home Acres; thence east
along the north line of Lots 17, 16 and 3 of
Nob Hill Home Acres to 18th Avenue North;
thence south along 18th Avenue North to the
point of beginning;
the above irrigation system to be constructed in full accordance with the plans and
specifications to be prepared by the City Engineer and filed with the City Clerk:.
All persons who may desire to object to said proposed improvement
are hereby notified to appear and present such objection, if any,. at a meeting of the
City Commission to be held at its office in the City Hall in the City of Yakima, Yakima
County, Washington, at the hour of ten_ o'clock A. rd., on Monday, the 10th day of August,
1936, which time and place are hereby fixed for the hearing of all matters relating to
said proposed improvement or objections thereto, and for determining the method of pay-
ment therefor; and the City Clerk is hereby directed to give due notice of said hearing
and of the intention to make the aforesaid. improvement.
The cost and expense of said improvement shall be borne by and
assessed against all of the -property legally and properly assessable therefor as pro -
vided by law and as above described; and the City Engineer is hereby directed to submit
to the City Commission at or prior to the date fixed herein for said hearing, all of
the data and other information required by law to be by him submitted.

the City Treasurer is hereby authorized to give notice of said roll by publication as

ORDINANCE NO. B -150, entithdd, "AN ORDINANCE confirming the assessment roll covering
Local Improvement District No. 508, as created and established by Ordinance No. B -138
of the Ordinances of the City of Yakima ", was introduced by Washburn and read by the
City Clerk.
