May 25, 1936 —
The City Commission met in regular session, Mayor Temple and Commissioners Washburn
and Clark present on roll call.
Moved by Temple, seconded by Clark that the minutes of the regular meeting of Monday,
May 18th, 1936 and adjourned meeting thereof be approved as read: carried, Temple,
Washburn and Clark voting aye on roll call.
Moved by Clark, seconded by Washburn that the following payrolls be allowed and the
City Clerk authorized to issue warrants as follows: Sanitation and Sewers 500.10;
L.I.D. Revolving $245.00; Street Department $266.66; Sewage Disposal 214 Water
Department $223.95; Park Department $441.00; Cemetery $108.70;Cemetery Care 431.55:
carried, Temple, Washburn and Clark voting aye on roll call.
Moved by Clark, seconded by Temple that this being the time for receiving bids for the
irrigation system :in Local Improvement District No. 508, the following were received:
R. A. Geary $838.55; J. Pi. DeBlasio $712.00; three items were excluded from the speci-
fications and a contract entered into with J. M. DeBlasio for $437.50 upon his filing
a bond as required by law: carried, Temple,.Washburn and Clark voting aye on roll call.
Moved by Washburn, seconded by Temple that the bond of J. M. DeBlasio in the Burn of
$437.50 for constructing an irrigation system in Local Improvement District No. 508
is hereby approved and placed on file with the City Clerk: carried, Temple, Washburn
and Clark voting aye on roll call.
Moved by Washburn, seconded by Temple that the salary of J. 0. White, Meat Inspector
be increased from - $151 -.50 per month to $175;00; said increase in salary to become ef-
fective June 1st, 1936: carried, Temple, Washburn and Clark voting aye on roll call.
ORDINANCE NO. B -14:1, entitled, "AN ORDINANCE regulating and licensing the preparation,
marking and sale of meats intended for human consumption; defining offenses, providing
penalties and repealing Ordinance No. B -57 and Ordinance No. A -65, and declaring an
emergency ", was introduced by Temple and read by the City Clerk.
Moved by Washburn, seconded by Temple that Ordinance No. B -141 be passed to its second
reading and read b;y title only: carried, Temple and Washburn voting aye `on roll call,
Clark voting no.
Moved by Washburn, seconded by Temple that Ordinance No. B -141 be passed. to its third
reading and read in full: carried, Temple and Washburn voting aye on roll call, Clark
voting no.
Moved by Washburn, seconded by Temple that Ordinance No. B- 141'be passed as finally
read: carried, Temple and Washburn voting aye on roll call, Clark voting no.
Moved by Temple, seconded by Clark that we do now adjourn to meet Tuesday, May 26th,

said contract was awarded to the Rankin Implement Co: carried, Temple, Washburn and

RESOLUTION NO. C -189, A RESOLUTION authorizing the sale of Lot 7, Block 22, "Tennant
& Miles' Modern Addition to North Yakima", (now Yakima), according to the official
plat thereof now on file and of record in the office of the Auditor of Yakima County,
Washington.
WHEREAS, the City of Yakima is the owner of the following describ-
ed real property situated in Yakima, Yakima County, Washington, to wit:
Lot 7, Block 22, "Tennant & Miles' Modern Addition to North
Yakima ", (now Yakima), according to the official plat thereof now on file and of re-
cord in the office of the Auditor of Yakima County, Washington, according to the
official plat thereof now on file -and of record in the office of the Auditor of Yakima
County, Washington by reason of a deed therefor issued by the Treasurer of the City
of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of
said property for delinquent assessments, and
WHEREAS, it appears to be for the best interest of said City of
Yakima to sell said premises to Ray A. Luckenbach and Marguerite Luckenbach, husband
and wife, upon the terms and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIti11ISISION OF THE
CITY OF YAKIMA, WASHINGTON:

That said above described premises be and they are hereby author-
ized to be sold to Ray A.- Luchenbach and Marguerite Luckenbach, husband and wife, for
the total sum of One Hundred sjxty and 55/100 Dollars, payable as follows: thesum of
Fifty and 55/100 ($50.55) Dollars in cash upon the execution of the contract herein
authorized and the balance of One Hundred Ten and No/100 ($110.00) Dollars in monthly
payments of Five and No /100 ($5.00) Dollars, beginning July 1, 1936, and continuing
until the entire amount has been paid., All deferred payments to bear interest at the
rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said prem-
ises, and the Mayor and City Clerk of said City are hereby authorized and directed to
enter into a contract in duplicate with said purchaser, under the terms hereinabove
set forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured at the expense
of the second parties in a solvent insurance company satisfactory to first party as
its interest may appear and shall contain a provision that in case of destruction of
or damage to any buildings or improvements on said premises such damage or loss shall
be the loss of second parties and shall not be a ground for rescission of said contract;
and said contract shall also contain a suitable provision providing for forfeiture
thereof upon failure of second party to make any payment of principal, interest, taxes
or assessments therein provided for when same shall become due or delinquent, notice
of such forfeiture to be for 30 days and service thereof to be by serving same person-
ally upon second parties or by mailing to them at Yakima, Washington, and a further
provision shall be placed therein that upon final payment of said principal and interest
and taxes and assessments the first party shall convey said premises to second parties
by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima
has now in said premises; and the further provision shall be contained in said contract
against the assignment of second parties without the consent of first party had and
obtained.
