Moved by Clark, seconded by Temple that this being the 't time for the hearing on Resolu- tion No. 0-177 for vacating a portion of Pacific Avenue lying between South Second St. and. South Third Street in the City of Yakima and there being no protest in writing or otherwise to said vacation proceedings or any part thereof; it is ordered that the or- dinance vacating said property be passed as finally read: carried, Temple, 'Washburn and Clark voting aye on roll call. entitled ORDINANNCE NO. B -l3 "3; "AN ORDINANCE providing for the vacation of that portion of Pacific Avenue lying between South Second Street and South Third Street, otherwise described as: .The south 30 feet of the following described property, to -wit: beginning at a point on the south line of 150he southeast quarter of the southwest quarter of Section 19, Town- ship 13 North, Range 19, E. W. M., 40 feet west of the southwest corner thereof; thence north along the west line of South Third Street 430.22 feet to the south line of Adams Avenue; thence west along the south line of Adams Avenue.293.23 feet to the east line of South Second Street; thence southeasterly along the east line of South Second Street .455.62 feet to the south line of said subdivision; thence east along the south line of said subdivision 133.78 feet to the point of beginning; and the north 30 feet of the following described property to -wit: Beginning at a point on the north line of the northeast quarter of the northwest quarter of Section 30, Township. 13 North, Range 19, E. W. M., 40 feet west of the northeast corner thereof; thence southeasterly to a point 30 feet west and 30 feet south-of said northeast corner; thence south along the east line of South Third Street 329.69 feet to its intersection with. the east line of South- Second Street; thence northwesterly along the east line of South Second Street 363.43 feet to a point 30 feet south of the north line-of said subdivision; thence northeaster- ly to a point on said north line 173.78 feet west of the northeast corner of said sub- division; thence east along said north line 133.78 feet'to beginning," was introduced by -Clark and read by the City Clerk. Moved by Washburn, seconded by Temple that Ordinance No. B -133 be passed as finally read: carried,.Temple, Washburn and Clark voting aye on roll call. ORDINANCE NO. B -134, entitled, "AN ORDINANCE amending Part II, Section 21 sub- section (c), of Ordinance No. B -22 of the ordinances of the City of Yakima, entitled: "AN OR- DINANCE regulating and restricting the location of trades industries; regulating and limiting the use of buildings and premises and the height and size of buildings; provid- ing for yards, courts or other open spaces; and establishing districts for the said purposes", was introduced by Clark and_ read by the City Clerk. Moved by Temple, seconded by Washburn that Ordinance No. B -134 be passed to its second reading and read by title only: carried, Temple, Washburn and Clark voting aye on roll call. Moved by Temple, seconded by Washburn that Ordinance No. B -134 be passed to its third reading and read in full: carried, Temple, Washburn and Clark voting aye on roll call. Moved by Temple, seconded.by Washburn that Ordiname No. B -134 be passed as finally read: carried, Temple, Washburn and Clark voting aye on roll call. RESOLUTION NO. C -184, WHEREAS, the City of Yakima, a municipal corporation of the first class of the State of Washington, is the owner of the following described real estate, situate in the County of Yakima and State of Washington, to -wit: Lots 9 and 10, Block 254, Original Plat of the City of Yakima, Yakima County, Washington, according to the official plat thereof on file and of record in the office of the Auditor of Yakima County, Washington; and, WHEREAS, I. E..Dulude, H. D. LaTendresse, Louis Axlen and Frank - Rose, co- partners doing business as the State Products Co., are desirous of leasing the above described real estate, and have made an offer to said -City of Yakima to lease the same for a period of five years upon a monthly payment of $20.00, buildings and im- provements on said property to be maintained in good repair at the expense of lessees, and they to have the privilege of constructing additional buildings on the-.-premises if they so desire, and to remove the same at the expiration of said lease, all without in- jury to said real estate as it now esists; and WHEREAS, it is deemed to be to the best interests of said City of Yakima that said lease be entered into upon said terms; now, therefore, BE IT RESOLVED BY THE CITY OF YAKIMA: That the real estate above described be leased by the City of Yakima for the term of five .years to I. E. Dulude, H. D. LaTendresse, Louis Axlen and Frank Rose, co- partners doing business under the firm name and style of State Products Co., upon a monthly rental of $20.00 payable in advance, lessees to maintain the im- \ II L provements now located upon said real estate in good repair at their own.expense, and to have the privilege of constructing additional buildings on the premises if theyso desire, and the privilege of removing said newly constructed buildings at the expiration of the t erm' of said lease, all without injury to said. real estate as it now exists; and the Mayor and the City Clerk of said City of Yakima are hereby authorized and directed to execute and deliver to said parties a lease in customary form covering the, above de- scribed real estate upon said terms: ADOPTED BY THE CITY COMMISSION, signed and approved this 23rd day of March; 1936.
