Moved by Temple seconded by Washburn that the minutes of the regular meeting of Mon"
day, February 24, 1936 and adjourned meeting thereof be approved as read: carried,

ORDINANCE NO. B -132, entitled, "AN ORDINANCE amending Section 5 of Ordinance No. B -66
of the City of Yakima, entitled "AN ORDINANCE providing for the amking of certain ex-
tensions to and betterments of the existing water works system of the City of Yakima,
Washington, for the purpose of increasing the efficiency of said system and diminishing
the cost of operation thereof; specifying and adopting the system or plan proposed;
declaring the estimated cost thereof as near as may be and providing for payment of
p3 rt of such cost by the issuance of special revenue bonds in the sum of fifty thousand
dollars ($50,000.00) and fixing; the terms thereof, said bonds to be payable only out
of a fund to be created and established for the payment of the same by-setting aside
therefor, out of the gross revenues of said water works, a fixed amount without regard
to-any fixed proportion thereof; and declaring an emergency ", and declaring an emergency
vaas introduced.by Clark and .read by the City Clerk.

notice to bidders by publication as required by law on the $50,000.00 "Yakima Water Works
Special Bond Fund Series C": said bids to be received on Monday, April 6th,. 1936 at
10 o'clock A. M. and to specify the lowest rate of interest and premium, if any, as
provided by Ordinance No. B -66 and Ordinance No. B -1.32 respectively: carried, Temple,
Washburn and Clark voting aye on roll call.
RESOLUTION NO. 0-177, WHEREAS, a petition has been filed with the City Commission of
the City of Yakima, a municipal corporation, praying for the vacation of that portion
of Pacific Avenue lying between South Second Street and South Third Street, otherwise
described as:
The south 30 feet of the following described
property, to -wit.:
Beginning at a.point on the south line of the
southeast quarter of the southwest quarter of
Section 19, Township 13 North, Range 19, E.W.M.,
40 feet west of the southeast corner thereof;
thence north along the west line of South Third
Street 430.p2 feet to the south line of Adams
Avenue; thence west along the south line of
Adams Avenue 283.23 feet to the east line of
South Second Street thence southeasterly along
the east line of South Second Street 455.62 feet
to the south line of said subdivision; thence

the 23rd day of March, 1936, at the hour of 10:00 o'clock in the forenoon of said day,
at the office of the City Commission of the City of Yakima at the City-Hall in Yakima,
Yakima County, Washington, or as soon thereafter as the matter may be heard.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF YAKIMA, WASHINGTON:
That said -above described premises be and they are hereby author-
ized to be sold to Mcpherson Roberts and Hazel Margaret Roberts, husband and wife, for
the total sum of One Hundred Fifty and No /100 ($150-00) Dollars,' payable as follows:
the sum of Thirty and No /100 ($30.00) Dollars in cash upon the execution of the contract
herein authorized and the balance of One Hundred Twenty and No /100 ($120.00) Dollars in
monthly payments of Five and No /100 ($$5.00) Dollars -, beginning April 1, 1936, and con-
tinuing until the entire amount has been paid. All deferred payments to bear interest
at the rate of six per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said pr.einises falling due under any Local Improvement- District or,
Districts hereafter created or arising from levies hereafter placed against said premi-
ses, and the-Mayor and City Clerk of said City are hereby authorized and directed to
enter into .a contract in duplicate with said purchaser under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable
provisions requiring any buildings upon said premises to be insured at the expense of
the second parties in a solvent insurance company satisfactory to first party as its
interest may appear and shall contain a provision that in case of destruction of or
damage to any buildings or improvements on said premises such damage or loss shall be
the loss of second parties and shall not be a ground for rescission of said contract;
and said contract shall also contain a. suitable provision providing for forfeiture
thereof upon failure of second party to make any payment of principal, interest, taxes
or assessments therein provided for when same shall become due or delinquent, notice of
such forfeiture to be for 30 days and service thereof to be by serving same personally
upon .second parties or by mailing to them at Yakima, Washington, and a further provision
shall be placed therein that upon final payment of said principal and interest and taxes
and assessments the first party,shall convey said premises to second parties by a good
and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now
in said premises; and the further provision shall be contained in said contract against
the assignment of second parties without the consent,of first party had and obtained.

RESOLUTION NO. 0-179, A RESOLUTION authorizing the sale of Fractional Lot. 10, Block
154, "The Home Addition to North Yakima ", (now Yakima), according to the official plat
thereof now on file and of record in the office of the Auditor of said County.
WHEREAS, the City of Yakima is the owner of the following de-
scribed real property situated in Yakima, Yakima County, Washington, to -wit:
Fractional Lot 10, Block .154, "The Home-Addition to
North Yakima", (now Yakima),. according to the
official plat thereof now on file and of record in
the office of the Auditor of said County.

($15.83) Dollars, payable as follows: the sum of Fifteen and 53.100 ($15.53) Dollars

ADJOURNED MEETING, SATURDAY, MARCH 7, 1936, 9 A. M.
RESOLUTION NO. C -180, WHEREAS, the City of Yakima has heretofore, as of date of February
29th,• 1936, called and redeemed those certain outstanding registered warrants, including
principal and interest, in the sum of $1,855.66, a complete list of said warrants, to-
gether with proper identification thereof by number, the date of issuance, and the owner
thereof, being attached hereto, labelled "Schedule B" and made a part hereof, and
WHEREAS, said warrants were redeemed from that certain fund of.
the City of Yakima known as the "Fifth Avenue Improvement Fund ", and
WHEREAS, it is necessary to reimburse said Fifth Avenue Fund for
such sums so expended in redeeming said warrants, and the Secondary Highway. Fund of
the City'of Yakima is the proper fuhd to be. charged with such reimbursement, and'
WHEREAS, the City Treasurer also has a warrant in the sum of
$350.73, which has been outstanding against the Fifth Avenue Improvement Fund on account
.1.df the refusal of Yakima County to credit the City of Yakima with sufficient funds
from the Motor Vehicle Fund under Chapter 41, of the Laws of 1933, and which is a legi-
timate charge against the,Fifth Avenue Improvement -Funds;
NOW, THEREFORE, BE IT RESOLVED BY THE C ITY OF YAKIMA :
That the proper City Officials be, and they are hereby authorized
and directed to draw a warrant upon the Secondary Hi ۥhway Fund of the_ City of Yakima,
in the sum of $1855.66 and $380.73, respectively, payable to the City Treasurer of the
City of Yakima for the reimbursement of said Fifth Avenue Improvement Fund in such sums.
Adopted by the City Commission, signed and approved this 7th day
of March, 1936.
