The City Commission met in regular session., Mayor Temple and Commissioners Washburn and
Clark present on roll call.
Iroved by Temple, seconded by Clark that the minutes of the regular meeting of Monday,
December 30, 1935 b.e approved as reed: carried, Temple, Washburn and Clark voting aye
on roll call.
ORDINANCE NO. B -123, entitled, "AN ORDINANCE consenting to the lease, transfer and
assignment by Oregon - Washington Railroe.d & Navigation Company to Union Pacific Rail-
road Company of franchises granted by the City of Yakima and former City of North Yakima,
Washington ", was introduced by Temple and read by the City Clerk.
Loved by Clark, seconded by Washburn that Ordinance No. B -123 be passed to.its second
reading and read by title only: carried, Temple, Washburn and Clark voting aye on roll
call.
Moved by Clark, seconded by Washburn that Ordinance No. B -123 be passed to its third

RESOLUTION NO. 0-171, BE IT RESOLVED BY THE CITY COMIMISSION OF THE CITY OF YAKIMA, WASH-
INGTON: -
That it is its intention to improve Division Street from Sixteenth
Avenue South to Twentieth Avenue South, Fifteenth Avenue South from Division Street to
Washington Street, and MacLaren Street and St. Helens Street from Sixteenth Avenue South
to a point half way between Fourteenth Avenue South and Fifteenth Avenue South, 'by grad -
ing.and paving the'same with a one course concrete pavement, the pavement on Division
Street to consist of an eight foot strip on either side of the existing pavement, the
pavement on MacLaren Street to be 32 feet in width and the pavement on Fifteenth Avenue
South and St. Helens Street to be 24 feet in width; by.constructing the necessary curbs,
sidewalks, siphons and drains, and by doing all such other work as may be necessary in
connection therewith, all in accordance with the plans and specifications to be prepared
by the City Engineer and filed with the City Clerk.
The district to be served by and assessed for the above described
improvement' is described as .follows, to -wit:
Beginning at a point on the southerly line of
Division Street, said point being the north-
east
corner of Lot 1, .Block 2 of Richland
Addition, thence west'..to the west line of Six -
teenth Avenue South; thence north along the
west line of Sixteenth Avenue South to the
northeast corner of Lot 6, Block 1, Elliott
Heights Addition; thence west to the northwest
corner of Lot 19, Block 2, Elliott Heights
Addition; thence north 13.44 feet; thence west
to a point on the east line of Twentieth Avenue
South 300.5 feet north of the north line of
Division Street; thence south along the east
line of Twentieth Avenue South to the south-
west corner of Lot 6, Block 4, Hillcrest
Addition; thence east to the southeast corner
of hot 19, Block'1, Hillcrest Addition; thence
south to Washington Street; thence easterly
along Washington Street to the southeast corner
of Lot 6, Block 6, Bonnie Brae Addition; thence
north to the point of beginning.
All persons who may desire to object to said proposed improvement
are hereby notified to appear and present such objections, if any, at a meeting of the
City Commission to be held at the office in the City Hall in the City of Yakima, Yakima
County, Washington, at the hour of ten o'clock A. M., on Monday, the 3rd day of February,
1936, which time and place are hereby fixed for the hearing of all matters relaying to
said proposed improvement or objections thereto, and for determining the method of paymen
therefor; and the City Clerk is hereby directed to give due notice of said hearing and
of the intention to make the aforesaid improvement.
The cost and expense of said improvement, shall be distributed as
follows: Approximately the sum of $3,701-00 to be taken care of by Federal Funds, and
the balance thereof to be borne by and assessed against all of the property legally and
properly assessable therefor as provided by law and as above described; and the City
Engineer is hereby directed to submit to the City Commission at or prior to the date
fixed herein for said hearing, all of the data and other information required by law to
be by him submitted.

of January, 1936.

Moved by Washburn, seconded by Temple that the - following payrolls be allowed and the City
Clerk authorized to issue warrants as follows: Sanitation Dept. $429.07; Cemetery $69.30;
Water Dept. $448.45; Secondary Highway $938.53: carried, Temple, Washburn and Clark vot-
ing aye on roll call.

The City Commission met pursuant to adjournment, Mayor Temple and Commissioners Wash -
burn and Clark present on roll call.
Moved by Temple, seconded by Washburn that the petition filed by No. - -Ke Buck, ..Attorney..
for an undisclosed client, offering to purchase certain real estate owned by the City
of Yakima for the sum of $28,500.00 is hereby rejected, and the City Clerk is authorized
to notify Mr. Buck of the decision of the City Commission and return forthwith his check
in the sum of $1,000.00 earnest money accompanying said petition: carried, Temple,,Wash.
burn and Clark voting aye on roll call.
