C -1551 A RESOLUTION authoirizing the sale of Lot 6, Block 2, Grandview Addition.to North Yakima jnow Yakima) according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington to Mahldn Beeghly a bachelor. WHEREAS, the City of Yakima is the owner of the following described real property situated in_Yakima, Yakima County, Washington; to -wit: Lot 6, Block 2, Grandview Addition to North Yakima (now Yakima) accorVing to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington by reason of'a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent assessments, and WHEREAS). it appears to be for the 'b est interest of said City of Yakima to sell said premises to Mahlon Beeghly, a bachelor,-upon the terms and conditions hereinafter set forth. NOW, THEREFORE, -BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby authorize to be sold to Mahlon Beeghly, a bachelor, for the total sum of Three Hundred Ten and No/ 100 Dollars, payable as follows: the sum of Twenty Five and No /100 Dollars,in cash upon the execution of the contract herein authorized and the balance of Two Hundred Eighty - five and No /100 Dollars in monthly payments of Ten and No /100 Dollars,.beginning November 20, 1935, and continuing until the entire amount has'been paid. All deferred payments to bear interest at the rate of six (6%) per cent per annum payable monthly with princi a payments. p The purchaser under said contract shall-also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said premises and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable pro- visions requiring any buildings upon said premises to be insured at the expense of the second parties in a solvent- insurance company satisfactory to first party as its interest may appear and shall contain a'provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of second parties and shall not be a ground for 'rescission of said contract; and said con- tract shall also contain a suitable provision providing for forfeiture thereof .upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and service thereof to be by 'serving same personally upon second party or by mailing to them at Yakima, Washington, and a further provision shall be placed therein that upon final payment of said - principal and interest and taxes and assessments the first party shall convey said premises to second party by a good and sifficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained in said contract against the assignment of second party without the consent of first party had and obtained. The City Commission met pursuant to.adjournment, Mayor Temple and Commissioners Washburn and Clark present on roll call. RESOLUTION NO. C -156, WHEREAS, The City of Yakima, a municipal corporation of the first class of the State of Washington, is desirous of entering into an agreement with the Department of Highways of the State of Washington, relative to the application by said State Highway Department for funds from the Emergency Relief Appropriation Act of 1935 for the improvement of First Street in Yakima, Washington, from Lenox Avenue to North Avenue, and for the maintenance of such street when and if improved by said City of Yaki- ma, now therefore; BE IT RESOLVED BY THE CITY OF YAKIMA:' That H. C. Temple, Mayor and Pearl Benjamin, City Clerk, be, and they are hereby-authorized, empowered and direct- ed to enter into such agreement with said State Highway Department. RESOLUTION NO. _C -157, WHEREAS- the City of Yakima, a municipal corporation, is desirous of securing from the Emergency R lief Appropriation Act of 1935 funds for the improve- ment of First Street in Yakima, Washington, from Lenox Avenue to North Avenue, and WHEREAS, it is necessary to submit detailed plans and specifica- tions for the improvements to be made on said street, and WHEREAS, it is deemed that such plans,_ specifications, blueprints and tracings can-be most economically prepared, and the field work necessary therefor can be most satisfactorily carried out by the Director of.-Highways of the State of Washington, now therefore, BE IT RESOLVED, BY THE CITY OF YAKIMA: That the Director of-High- ways of the State of Washington be, and he is hereby authorized, empowered and directed to immediately perform the necessary field work, prepare plans, specifications, blue- prints and tracings necessary" -for such application:to be made for funds to be secured from the Emergency Relief Appropraition Act of 1935, at a cost to the City of Yakima not to exceed the sum of $$350.00., -BE IT FURTHER RESOLVED, that such charge to said City of Yakima, in a sum not to exceed $350.00, shall be deducted from and paid out 6f the apportion - ment' of the State Motor Vehicle Fund, allotted and to be allotted to the City 'of Yakima.
