The City Commission met in regular session, Mayor Temple.and Commissioners Washburn
and---Clark present on roll call.
Moved by Temple, seconded by Washburn that the minutesof the regular meeting of Monday,
July 1st, 1935 and adjourned meeting thereof be approved as read: carried, Temple, Wash
burn and Clark voting aye on roll call..
Moved by Temple, seconded by Clark that the claim of Elizabeth Rehm, in the sum of
$10,734 for damages alleged to have been sustained by reason of the collapse of a portio
of the Mercy Building located on East Yakima Avenue, on the 19th day of May, 1935 is
hereby rejected: carried, Temple, Washington and Clark voting aye on roll call.
Moved by Temple, seconded by Clark that the claim of Alex Rehm in the sum of $24.,556.4o
for damages alleged to have-been sustained by reason of the collapse of a portion of
the Mercy Building located on East Yakima Avenue on the 19th day of May, 1935, is hereby
rejected: carried, Temple, Washington-and Clark.voting aye on roll call.

City Clerk authorized to issue warrants as follows: Street Dept. $1,380.49; Water Dept.
$717.48; L.I.D. No. 502 x$366.95; Cemetery $292.95; Parks x$562.91: carried, Temple,

RESOLUTION NO. C -132; BE IT- RESOLVED BY THE CITY COMMISSION OF THE CITY OF-'YARIMA, WASH-
INGTON:
That it is its intention to improve that certain property here
inafter. described, by constructing pipe sewers with the necessarywye branches, manholes,
flush tanks and water connections therefor, located as follows:
Beginning at the intersection of Lenox Avenue with
Eleventh Avenue South; thence north along Eleventh
Avenue South to West Washington Street.
Also beginning at a point on Lenox Avenue-135 feet
east of the east line of Pleasant Avenue; thence
north parallel with Pleasant Avenue to Nest Wash-
ington Street.
Also beginning at a point on Lenox Avenue 140 feet
east of the east line of Queen Avenue; - thence north
parallel with Queen Avenue to West Washington Street.
Also beginning at a point on Lenox Avenue 140 feet
west of the west line of Queen Avenue; thence north
parallel with Queen Avenue to West Washington Street.
The district to be served by and assessed for the above described
improvement is described as follows, to -wit:
Beginning at a,point on West Washington Street 125
feet east of the east line of Eleventh Avenue South;.
thence south parallel with Eleventh Avenue South to
Lenox Avenue; thence west along Lenox Avenue to Twelfth
Avenue South; thence north along Twelfth Avenue South
to West Washington Street; thence east along West
Washington Street to the point of beginning;
the above described sewers to be constructed in full accordance with the plans
and specifications to be prepared by the City Engineer and filed with the City
Clerk.
All persons who may desire to object to said proposed improvement
are hereby notified to appear and present such objection, if any, at a meeting of the
City Commission to be held at its office in the City Hall in the City of Yakima, Yakima
County, Washington, at the hour of 10 o'clock A. M., on Monday, the 29th day of .July,
1935, which time and place are hereby fixed for the hearing of all matters relating to
said proposed improvement or objections thereto, and for determining the method of pay-
ment therefor; and the City Clerk is hereby directed to give due notice of said hearing
and of the intention to make the aforesaid improvement.
The cost and expense of said improvement shall.be borne by and
assessed - against all of the property legally and properly assessable therefor as pro-
vided by law and as-above described; and the City Engineer is hereby directed to submit
to the City Commission at or prior to the date fixed herein for said hearing, all of
the data and other information required by law to be by him submitted.

Commission on the 10th day of June, 1933, providing for the sale of certain property in
the City of Yakima to Joe W. Hocker et ux, is hereby repealed and Resolution No. 0-133
adopted in lieu thereof: carried, Temple, Washburn and Clark voting aye on roll call.

WHEREAS, the
City of Yakima .is
the owner of the following described
real property situated in Yakima,

of the Northeast Quarter of Section 26, Township
13 North Range 18, E. W. M. beginning at the
Southeast corner of said subdivision thence west
360 feet and North 295.4 feet to the true place
of beginning, thence west 130 feet, thence North
42.2 feet thence east 130 feet thence south 42.2
feet to beginning,
by reason of a deed therefor issued by the Treasurer of the City of Yakima;.County of
Yakima, State of Washington, to said City of Yakima, on sale of said property for de-
linquent assessments, and
WHEREAS, it appears -b be fors the best interest of said City of
Yakima to sell ?.said premises to Joe W. Hooker and Margaret L. Hooker, husband and wife,
upon the terms and conditions hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF YAKIMA, WASHINGTON:
That said above described premises be and they are hereby authorized
to be sold to Joe W. Hooker and Margaret L. Hooker, husband and wife for the total sum
of Three Hundred and Fifty and No /100 ($350.00) Dollars, payable as follows: the sum
of Fifty and No /100 ($50.00.) Dollars in cash upon the execution of the contract herein
authorized and the 'balance of Three Hundred and No /100 ,($300,00) Dollars in monthly
payments of Six and No /100 ($6.00) Dollars, beginning August 15th, 1935, and continuing
until the entire amount has been paid. All deferred payments to bear interest at the
rate of six (6%) per cent per annum payable monthly with principal payments.
The purchaser under said contract shall also agree to pay all
assessments against said premises falling due under any Local Improvement District or
Districts hereafter created or arising from levies hereafter placed against said prem-
ises, and the.Mayor and City Clerk of said City are hereby authorized and directed to
enter into a contract in duplicate with said purchaser under the terms hereinabove set
forth.
Said agreement to be entered into shall also contain suitable pro-
visions requiring any buildings upon said premises to be insured at the expense of the
second parties in a solvent insurance company satisfactory to first party as its inter-
est may appear and shall contain a profision that in case of destruction of or damage
to any buildings or improvements on said premises such damage-or loss shall be the loss
of second parties and shall not be a ground for, rescission of said contract; and said
contract shill also contain a suitable provision providing for forfeiture thereof upon
failure of second party to make any payment of principal, interest, taxes or assessments
therein provided for when same shall become due or delinquent, notice of such forfeiture
to be for 30 days and service thereof to be by serving same personally upon second partie
or by mailing to them at Yakima, Washington, and a further provision -shall be placed
therein.that upon final payment of said principal and interest and taxes and assessments
the first party shall convey said premises to second parties by a good and sufficient
Quit Claim Deed conveying all the interest said City of Yakima has now in said premises;
and the further provision shall be contained in said contract against the assignment of
second parties without the consent of first party had and obtained.

Margaret King, Mother of above claimants for damages alleged to have been sustained by
reason of the collapse of a portion of the Mercy Building, located on East Yakima Ave.
in the City of Yakima on the 19th day of May, 1935, are hereby rejected: carried, Temple
Washburn and Clark voting aye on roll call.

$3,000.00 and Walter C. Stuart in the sum of $1,500-00, all for damages alleged to have
been sustained by reason of the collapse of a portion of the Mercy Building in the City
of Yakima on the 19th day of May, 1935, are hereby rejected: carried, Temple, Washburn
and.Clark voting aye on roll call.
