Moved by Clark, seconded by Washburn that the following payrolls be allowed and the City Clerk authorized to issue warrants as follows: Street Dept. $1126.57; Cemetery $72.45; Cemetery Care $37.80; Park $150.00; Water $535.00: carried, Temple, Washburni and.Clark voting aye on roll call. Moved by Clark, seconded by Washburn that the improvement petitioned for by property owners of the district for constructing a sewer system on Lincoln Avenue and other streets in the City of Yakima,, initiated by Resolution No. 0-101, is hereby approved and ratified and the City Attorney is hereby authorized to prepare an ordinance creating. a local improvement district in due course of time: carried., Temple, Washburn and Clark voting aye on roll call., RESOLUTION NO. 0-119, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASH- INGTON: That it is its intention to construct an irrigation system to serve all the lots, blocks and tracts of land included within the real estate herein- after described, said improvement to consist of acquiring the necessary water rights and rights of way, the construction of a main pipe line connecting with the main line of the Maclaren Street Water` System, beginning at the intersection of Maclaren Street and the alley east of Pleasant Avenue; thence south along said alley to Washington Street, also along Washington Street from Twelfth Avenue South to the alley east of Eleventh Avenue South, together with the necessary laterals, service connections and other appurtenandes for the purpose of delivering water for irrigation purposes to each lot and tract of land within the proposed district. That the district to be served by and assessed for the above de- scribed improvement is described as follows, to -wit: Beginning at the intersection of Washington Street and the alley east of Eleventh Avenue South; thence south along said alley and said alley extended to Lenox Avenue; thence west along Lenox Avenue to Pleasant Avenue; thence north along Pleasant Avenue to the south line of Lot 10, Block 3, Capitol Hill Garden Tracts; thence west along the south line of said lot to Queen Avenue; thence north along Queen Avenue to the south line of Lot .9, Block 4, Capitol Hill Garden Tracts; thence west along the south line of said lot to Twelfth Avenue South; thence north along.Twelfth Avenue -South to Washington Street; thence east along Washington Street to the point of beginning; situate in Yakima, Yakima County, Wash- ington the above described irrigation system to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvement, } are hereby notified to appear and present such objection, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A. M., on Monday, the 22nd day of .April, 1935, which time and place are hereby fixed for the hearing of all matters relating to said proposed im,r ovement or objections thereto, and for determining the method of pay- ment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement shall be borne by and assessed against all of the property legally and properly assessable therefor as pro vided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission. at or prior to the date fixed herein for said hearing, all. of the data and other information required by law to be by him submitted. RESOLUTION NO. 0-119, A RESOLUTION authorizing the sale of Fractional lots 7 and 8, Block 167, _ Gra.fton's. Addition to North Yakima, (now Yakima) Washington, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington, to Jacob Bernard and Aurelia Bernard, husband and 'rife. WHEREAS, the City of Yakima is the owner'-of the following describ- ed reel property situated in Yakima County, State of Washington, to-wit: Fractional lots 7 and 8, Block 167, Grafton's Addition to North Yakima, (now Yakima) Wash- ington according to the official plat there- of now on file and of record in the office of the Auditor of Yakima County, 137 by reason of a deed therefor issued by the Treasurer(of the City of Yakima to said City of Yakima on sale of the property for delinquent assessments, and WHEREAS, it appears to be for the best interest of said city fo sell.said premises to Jacob Bernard and Aurelia Bernard, husband and wife, NOW, THEREFORE) BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby author- ized to be sold to Jacob Bernard and Aurelia Bernard, husband and wife, for the total sum of Two Hundred Sixty and no /100 ($260.00) Dollars, and the Mayor, H. C. Temple, is hereby authorized to execute a deed to said premises, and the City Clerk, Pearl Benjamin, is hereby authorized and directed to attest the same for and on behalf of the City of Yakima. RESOLUTION NO. 0-120, A RESOLUTION authorizing the sale of Lot 17, Block .9, Boulevard Addition to North Yakima, (now Yakima) to A.. B. Crawford and Bertha B. Crawford, husband and wife. WHEREAS, the City of Yakima is the owner of the following described real property situated_ in Yakima, Yakima County, Washington, to -wit: Lot 17, Block 8, Boulevard Addition to North Yakima, (now Yakima) ac- cording to the official plat there- of now on file and of record in the office of the Auditor of Yakima. County, Washington, by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima,,State of Washington, to said City of Yakima, on sale of said property for de- linquent assessments, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to A.. B. Crawford and Bertha B. Crawford, husband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF-_'T.HE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby authorize to be sold to A. B. Crawford and Bertha B. Crawford,.husband and wife, for the total sum of One Hundred Forty -nine and 061100 ($$149.06) Dollars, payable as follows: the sum of Fifty -nine and 06/100 ($$59.06) Dollars in cash upon the execution of the contract herein authorized and the balance of Ninety and 00 /100 ($$90.00) Dollars in monthly pay- ments of Five and 00 /100 ($$5.00) Dollars, beginning May 1st, 1935,. and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of 6% per cent per annum.payable monthly with principal payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under.a ny Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said prem- ises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable pro- visions requiring any buildings upon said premises to be insured at the expenst. of the second parties in a solvent insurance company satisfactory to first party as its inter- est may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss .of second parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and servide thereof to be by serving same personally upon second par- ties or by mailing to them at Yakima, Washington, and a further provision shall 'be Placed therein that upon final payment of said principal and interest and t axes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima -has now in said premises; and the further provision shall be contained in said contract against the assignment of second parties without the consent of first party had and obtained. B -99, entitled, "AN RODINANCE authorizing the sale of the north twenty (20) feet of Lot Ten (10), Block Fifty -seven (57), Black's Addition to North Yakima, now Yakima, Yakima County, Washington, according to ,the dfficial plat thereof now on file I 1,38 '. and of record in the office of the Auditor of said Yakima County, Washington, to E. M. Sargent and Anna Mae Satgent, husband and wife, on real estate contract. WHEREAS, the City of Yakima is the owner of the following describ- ed real property, situate in Yakima County, State of Washington, to -wit: The north twenty (20) feet of Lot Ten (10), Block Fifty -seven (57) Black's Addition to North Yakima, now Yakima, - Yakima County, Wash- ington,- according to the official plat thereof now on file and of record in the office of the Auditor of said Yakima.County, Washington, having acquired title to said property by deed issued therefor by W. J. Aumiller to said City of Yakima; and, WHEREAS, it is deemed to be for the best interests of said City of Yakima to sell said premises on real estate contract to E. M. Sargent and Anna Mae Sargent, husband and wife, for the total consideration of Fifty ($50-00) Dollars, to be paid in monthly installments; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA: That the above described real property shall be sold on real estate contract to E. M. Sargent and Anna Mae Sargent, husband and wife, for the total sum of Fifty ($50.00) Dollars, payable as follows: Two.and 50 %100 ($2.50) Dollars upon the delivery of good and sufficient real estate contract, and the further sum of Two and 50/100 02.50) Dollars each and every month thereafter until the full purchase price shall have been paid, said monthly payment to include interest on deferred balances at the rate of six per cent per annum; and The Mayor and City Clerk of said City of Yakima are hereby author- ized and directed, upon the effective date of this ordinance, or as soon thereafter as possible, to enter into real estate contract sith said E. M. Sargent and Anna Mae Sargent, husband and wife, for the sale of the above described property upon the terms hereinabove set out. Police Radio System, the following were received: Graybar Electric Co. $3,930.00 Randall McSpain 3,900-00 John H. McAulay Co. 11812. Gamewell Co. 4,406.00 The bid of the Graybar Electric Co. in the sum of $3,930.00 was considered the best bid and the contract was awarded to said company; carried, Temple, Washburn and Clark voting aye on roll call.
