Moved by Washburn, seconded by Clark that the hearing on Resolution No. C -101 be con- tinued to Monday, April 1st, 1935 at 10 o'clock A. RESOLUTION NO. 0-112, A RESOLUTION authorizing the sale of Lot 11, Block 4, "Anglewood ", an addition to Yakima, Washington, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington„ to W. E. Brew- ster and Emma L. Brewster, husband and wife. WHEREAS, the City of Yakima is the owner of the following de- scribed real property in the County of Yakima, State of Washington, to -wit; Lot 11, Block 4, "Inglewood" according to the official plat thereof now on file and of record in the office of the Auditor of said Yakima County, by reason of a debd• therefor issued by the Treasurer of the City of Yakima to said city on sale of the said property for delinquent assessments, and, WHEREAS, it appears'to be for the best interest of the City of Yakima to sell said premises to W. E. Brewster and Emma L. Brewster, husband and wife, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby author- ized to be,-sold to W.' E. Brewster and Emma L. Brewster, husband and wife for the total sum of Three Hundred and Forty -Two and 18 /100'Dollars, and the Mayor, H. C. C -113, A RESOLUTION authorizing the sale of Lot 122 Block 41 "Inglewood" according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, to W. E. Brewster and Emma L. Brewster, husband and wife. WHEREAS, the City of Yakima is the owner of the following de- scribed real property situated in Yakima, Yakima County, Washington, to - -wit: Lot 12, Block 4, "Inglewood ", according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for de- linquent assessments, and WHEREAS, it appears to be for the best interest of said City of Yakima, to sell said premises to W. E. Brewster and Emma, L. Brewster, husband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISS ION � OF THE CITY OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby author- ized to be sold to W. E. Brewster and Emma L. Brewster, husband and wife, for the total sum of Five Hundred. Ninety Seven and 58/100 Dollars., payable as follows: the sum of: Twenty -seven and 58/100 ($27.580 Dollars, in cash upon the e xecution of the contract herein authorized and the balance of Five Hundred Seventy ($570.00) Dollars July 1, 1935 The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said prem- ises, and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract. in duplicate with said purchaser under the terms hereinabove set forth.Said agreement to be entered into shall also contain suitable provisions requir- ing any buildings upon said premises to be insured at the expense of the second parties in a solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of second parties and shall not be a gfound for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture-to be for 30 days and service thereof to be by serving same personally upon second parties or by mailing to them at Yakima, Washington, and a further provision shall be placed therein 1 1 1 that upon final payment of said principal and interest and taxes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained in said contract against the assignment of second parties without the consent of first party had and obtained. Yakima, (now Yakima) according to the official plat thereof now on file a-rid of record in the office of the Auditor of Yakima County to D. B. Dalthorp and Inez M. Dal- thorp, husband and wife. WHEREAS, the City of Yakima, is the owner of the following describ- ed real property situated in Yakima, Yakima County, Washington, to -wit: Lot 16, Block 249, Town of North Yakima, (now Yakima) according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for de- liriquent assessments, and NHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to D. B. Dalthorp and Inez M. Dalthorp, husband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE. CITY OF YAKIMA, WASHINGTON: That said above.described premises be and they are hereby au- thorized to be sold.to D. B. Dalthorp and Inez M.,Dalthor , husband and wife, for the total sum of Two Hundred Seventy Nine and 43/100 ($279.43) Dollars, payable as follows: the sum of Ten.and No /100 ($10.00) Dollars, in cash upon the exuctuion of the contract herein authorized and the balance of Two,Hundred Sixty -nine and 43/100 ($269.43) Dollars in monthly payments of Ten and No /100 including interest Dollars; beginning April 25, 1935,'and continuing until the entire amount has been paid. All def erred payments to bear interest at the rate of six (6 %) per cent.per annum payable monthly with principal payments. Weaver and Georgia F. Weaver, husband and wife. WHEREAS, the City of Yakima is the owner of the following describe real property situated in Yakima, Yakima County, Washington, to -wit: Lot 13, Block 134, Town of ,North Yakima (now Yakima) according to the official plat thereof now on file and of record in the office of the Auditor of Yakima 133`- F, 134 March 25, 1935 by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for de- linquent assessments, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to Clarence A. Weaver and Georgia F. Weaver, husband and wife, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF. YAK IMA, . WHEREAS, the City of Yakima is the owner of the following described real property situated in Yakima, Yakima County, Washington, to -wit: Lot 14, Block 147, Eastern Addition to North Yakima, (now Yakima) accord- ing to the official plat thereof now on file and of record in the office of the Auditor of Yakima. WHEREAS, the City of Yakima is the ownerof the following described real property situated in Yakima County, State of Washington: Lots 3 and 4, Block 214, "Maple Addition to North Yakima" (now Yakima) according to the official plat thereof now on file and of record in the office of the Aud- itor of Yakima County, and WHEREAS, by reason of a deed therefor issued by the Treasurer of the City of Yakima,to said City of Yakima, on sale of the said property for delinquent assessments, and V7HEREAS, , it appears to be for the best interest of said City of Yakima to sell said premises to W. J. Aumiller, whose wife is Anna G. Aumiller. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE.
