Moved by Temple, seconded by Clark that the minutes of the regular meeting of Monday, February 25th, 1935 and adjourned meeting thereof be approved as read: 'carried, Temple, Washburn and Clark voting aye on roll call. Moved by Washburn, seconded by Temple that the following payrolls be allowed and the City Clerk authorized to issue warrants as follows: Street Dept. $1,103.93; Cemetery $75.60; dater $1,149.90; carried, Temple, Washburn and Clark.voting aye on roll call. RESOLUTION NO. 0-101, BE IT RESOLVED BY THE C -ITY COMMISSION OF THE CITY OF YAKIMA, WASH- INGTON: That it is its intention to improve that certain property herein- after described, by constructing pipe sewers with the necessary wye branches, manholes, flush tanks and water connections therefor, located as follows: Beginning at the existing sewer located in the alley north of Lincoln Avenue just east of the east line of Sixteenth Avenue North; thence westerly to Sixteenth Avenue North; thence southerly along Sixteenth Avenue North to Lincoln Avenue; thence westerly along. Lincoln Avenue to a point medway between Twenty- Fourth Avenue North and Twenty -Fifth Avenue North. Also beginning at the intersection of Lincoln Avenue and Twenty- Fourth Avenue North; thence southerly along Twenyt- Fourth Avenue North a distance of 285 feet. Also beginning at the existing sewer located midway between Twenty -Fifth Avenue North and Twenty- Sixth Avenue North at a point 664 feet north of the-north line of Summitview Avenue;. thence southerly parallel with Twenty -Fifth Avenue North a distance of 625 feet. Also beginning at a point on Lincoln Avenue 134 feet west of the west line of Sixteenth Avenue North; thence southerly parallel with Sixteenth Avenue North a distance of 450 feet. The district to be served by and assessed for the above described improvement is described as follows, to -wit: Beginning at the intersection of Lincoln Avenue and-Sixteenth Avenue North; thence southerly along Sixteenth Avenue North to MonroeyAvenue; thence westerly along Monroe Avenue to a point on the east line of ,Lot 15, Summitview Acre Tracts, 190 feet south of the northeast corner thereof; thence westerly paral- lel with Lincoln Avenue to a line which is parallel with and 1O.feet east of the west line of Lot 13, Summitview Acre Tracts; thence souther - ly_along said line to the southerly line of said ,Lot 13; thence westerly along the south line of Lots 13, 12 and 11 of Summitview Acre Tracts to the southwest corner of Lot 11; thence northerly along the. west line of.. Lot 11 to .the northerly boundary of Pacific Power and Light Company's Canal; thence northwesterly along said northerly boundary to the east line of Lot 23 of Cherry Orchard Addition; thence south- erly along the easterly line of said Addition to the south line of Lot 21 of Cherry Orchard Addition; thence westerly along said south line of said lot and along the south line of Lot 22 of Chareve Park to the east line of Lot 16, Chareve Park; thence southerly along the east line of Lots 16 and 15 of Chareve Park to the south line of said Lot 15; thence westerly along the south line of Lot 15 to Twenty- Sourth Avenue North; thence southerly along Twenty - Fourth .Avenue North to Summitview Avenue; thence west- erly along Summitview Avenue to the west line of the East Half of the, East Half of the Northwest Quarter of Section 23, Township 13 North, Range 18, E. W. M.; thence northerly along said sub- division line to the southerly boundary of Pacific Power and Light Company's Canal; thence southeast- erly along the.southerly boundary of said Canal to Lincoln Avenue; thence easterly along Lincoln Avenue to the point of beginning; the above described sewers to be constructed in full accordance with the plans and specifications to be prepared by t he.City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvement J 1 March 4, 1935 are hereby.notified to appear and present such objections, if.any, at .a meeting of the City Commission to be held-at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 o'clock A. M., on Monday, the 25th day of March, 1935, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of pay- ment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said_improvement shall be borne by and assessed against all of the property legally and properly assessable therefor as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. C -102, A RESOLUTION authorizing the sale of Lot 13, Block 250, Town of North Yakima, (now Yakima) according to the official plat thereof, now on file and of record in the office of the Auditor of Yakima County, Washington, to Leonie Pauline Rousseau, a spinster. WHEREAS, the City of Yakima is the owner of the following described real property situated in Yakima, Yakima County, Washington, to -wit: Lot 13, Block 250, Town of North Yakima, (now Yakima), according to the official plat thereof now on file and of - record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the! Treas- urer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent assessments, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to Leonie Pauline Rousseau, a spinster, upon the terms and conditions hereinafter set forth. ..NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON:. That said above described premises be and they are hereby authoriz ed to be sold to Leonie Pauline Rousseau, a spinster, for the total sum of Seven. Hundred Twenty -Five and 59/100 ($725.59) Dollars, payable as follows: the sum of Fifteen and no /100 ($15.00) Dollars in cash upon the execution of the contract herein authorized and the balance of Seven Hundred Ten and 59/100 ($710.59) Dollarsin monthly payments of Fifteen and No /100 ($15.00) Dollars, beginning April 1, 1935, and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of six (6 %) per cent per annum payable monthly with principal payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or Districts hereafter created or arising from levies hereafter placed against said premises and the Mayor and City Clerk of said City are hereby authorized and directed. to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable provisions requiring any buildings. upon said premises to be insuredat the expense of .the second parti"es.in a* solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of second parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture there- of upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and service thereof to be by serving same personally upon. second party or by mailing to them at Yakima, Washington, and a further provision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the first party shall convey said premises to second party by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further provision shall be contained in said contract against the assignment of second party without the consent of first party had and obtained. B -89, entitled, "AN ORDINANCE authorizing the sale of the east twenty -three (23) feet of the west one hundred fifty -five (155)-feet of the north one hundred (100) feet of the south one hundred eighty (180)_ feet of the southwest quarter of the south- past quarter of Section Thirteen (13, Township Thirteen (13) North, Range Eighteen -(18) E. W.
