Mayor and City Clerk are hereby authorized to.execute a contract for and on behalf of the City of Yakima with Mrs. A. B. Coleman for the removal of night -soil from said city for-the sum of $80.00 per month; said con- tract to terminate at the will of either party thereto, and for such other and :Further agreement as are provided for therein: carried, Stratton, Washburn and Clark voting aye on roll call.. RESOLUTION NO. 0-93) BE IT REMEMBERED that on this 17th day of September, 1934, the petition of Fred G. Redmon for the vacation of an alley extending in a north and south direction on the following described real property, to -wit: Block 274, Ker's Addition to the City of .Yakima, formerly North Yakima, and Block 274, Lund's Ad- dition to the City of Yakima, formerly North Yakima, according to the official plat thereof on file and of record in the office of the Auditor of Yakima County, Washington, was filed; now, therefore, BE IT RESOLVED that a hearing be had upon said petition on the 5th day of November, 1934; and BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, directed and instructed to post printed notice of such hearing in three of the most public places of the City of Yakima and a fourth notice in a conspicuous place on the portion of the alley petitioned to be vacated.. C -941 A RESOLUTION authorizing the sale of Lot 11, Block 77, Town of North Yakima to C. A. Neville, a_widower. WHEREAS, the City of Yakima is the owner of the following described real property situated in Yakima, Yakima County, Washington, to -wit:- Lot 1.1, Block 772 Town of North Yakima, now Yakima, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasurer of the County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent taxes, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to C. A. Neville, a widower, upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COh.MISSION OF TIME CITY OF YAKIMA, WASHINGTON: That said above described premises'be and they are hereby author- ized to be sold to C. A. Neville, a widower for the total sum of Fourteen Hundred and nd /100 ( $1, 400.00 ) Dollars, payable as follows: the sum of Ten and No /100 ($10.00) Dollars in cash upon the execution of the contract herein authorized and the balance of Thirteen Hundred and Ninety and No /l00 Dollars in monthly payments of Ten and No /100 Dollars including interest beginning October 1, 19342 and continuing until the entire amount has been paid. All deferred payments to bear interest at the rate of Six per cent per annum payable monthly with principal payments. The purchaser under said contract shall also agree to pay all assessments against said premises falling due under any Local Improvement Distract or Districts hereafter created or arising from levies hereafter placed against said prem- ises,.and the Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. a Said agreement to be entered into shall also contain suitable pro`®: 95 9F J September 24, 1934 visions requiring any buildings upon said premises to be insured at the expense of the second parties in a solvent insurance company.satisfactory to first party as its interest may appear and shall contain a provision that.in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss,of sec- ond parties and shall not be a ground for rescission -of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest,,taxes or assessments therein provided .for when- same shall become due or delinquent, notice of such forfeiture to be for 30 days and service thereof to be by serving same personally upon second party or by mailing to them at Yakima, Washington, and a further provision shall be placed therein that upon final payment of said principal and interest and taxes and assessments the firs party shall convey said premises to second party by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the further Provision shall be contained in said contract against the assignment of second party with- out the consent of first party had and obtained.
