Moved by Stratton, seconded by Clark that the minutes of the regular meeting of Monday, August 6, 1934 be approved as read: carried, Stratton, Washburn and Clark voting aye on roll call. 1 ORDINANCE NO. B -73, entitled, "AN ORDINANCE creating Precinct Numbers 13 and 14 in th City of Yakima, prescribing their boundaries and repealing all ordinances in conflic herewith ", was introduced by Stratton and read by the _.City Clerk. Moved by Clark, seconded by Washburn that Ordinance No. B -73 be passed to its second reading and read by title only: carried, Stratton, Washburn and Clark voting aye on roll call. REAOLUTION NO. ,^.-97, A RESOLUTION authorizing the sale of Lot 15, Block 1?, Boulevard Addition to North Yakima,,(now Yakima) to M. G. Ferry and Bessie Ferry, husband and wife. WHEREAS,, the City of Yakima is the owner of the following descri' real property situated in Yakima, Yakima County, Washington, to -wit: Lot 15, Block 12, ' Boulevard Addition to North Yakima, (now Yakima) according t-o the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington,.to said City of Yakima, on sale of said property for delinquent assessments, and. WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to M. G. Ferry and Bessie Ferry, husband and wife upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLUED.BY THE CITY COMMISSION OF THE CIT OF YAKIMA, WASHINGTON: That said above described premises be and they are hereby authorized to be sold to M. G. Ferry and Bessie Ferry, husband and wife for the total sum of Two Hundred Twenty Five and No /100 ($225.00) Dollars, payable as follows: the sum of Five and No /100 ($5.00) Dollars in cash upon the execution of the contract herein authorized and the balance of Two Hundred Twenty and No /100 ($220.00) Dollars in monthly payments of Five and No /100 ($5.00) Dollars, beginning September 15, 1934, and continuing until the entire amount has been paid. All deferred payments to bear interests the rate o� Six (bjo) per cent per annum payable monthly with principal payments. The purchaser under.said contract shall also agree to pay all assess ments against said premises falling due under any Local Improvement District or Districts hereafter oreated or arising from levies hereafter placed against said premises, and the. Mayor and City Clerk of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set forth. Said agreement to be entered into shall also contain suitable pro- visions requiring any buildings upon said premises to be insured at the expense of the second parties__in a solvent insurance company satisfactory to first party as its interest may appear and shall contain a provision that in case of destruction of or damage to any buildings or improvements on said premises such damage or loss shall be the loss of sec- ond parties and shall not be a ground for rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same shall become due or delinquent, notice of such forfeiture to be for 30 days and service thereof to be by serving same personally upon second parties or by mailing to them at Yakima, Washington, and'a further,provision shall be placed there- in that upon final payment of said principal and interest and taxes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claim Deed conveying all the interest said City of Yakima has now in said premises; and the furtherrprovision shall be contained in said contract against the assignment of sec- ond parties'without the consent of first party had and obtained. C`�­892 A- RESOLUTION authorizing the sale of Tract 2, Stean Tract, unre- corded to H,. R. Penfield and Electa Penfield, husband and-wife. WHEREAS, the City of Yakima is the owner of the following described real property situated in Yakima., Yakima County, Washington, to -wit: Be inning at he SW corner of the N2 of the SEf of the NEt of Section 19 -13 -19 thence S 890 54" E 813.05" thence N 20 05" W 261.5" to the true point of beginning, thence N 890 54 -" w 244.64" thence N 00 '41i" W 40" thence S 89'0 54i E 243.66 " thence s 20 051 E 401 to the place of beginning, according to the official plat thereof now on file and of record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by'the Treasurer of the County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent taxes, and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to H. R. Penfield and Electa Penfield, husband and wife upon the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YARIMA, WASHINGTON: That said above described premises be and they are hereby authoriz to be sold to H. R. Penfield and Electa Penfield, husband and wife for the total sum of One Hundred Fifty and No /100 ($150.00) Dollars, payable as follows: the sum of Twenty Five and No /100 ($$25.00) Dollars, in cash upon the-execution of the contract-herein authorized and the balance of One Hundred Twenty Five and No /100 ($125.00) Dollars in monthly payments of Five and No /100 ($5.00) Dollars, beginning October 1, 1934, and containuing until the entire amount has been paid. C -891 WHEREAS, on the 1st day of May, A. D. 19331 the City of Yakima, a Municipal Corporation, entered into a real estate agreement with Wm. H. Everts and Greta Everts, husband and wife, for the sale of South 50" of the North 2551 of the West 130 "of Lot 1, Ontario Land Company's Garden Lots, according to the official plat thereof, now on file and of record in the office of the Auditor of Yakima County, for the sum of $101.59, with interest at the rate of 6�o per annum, on the following basis: the sum of $6.59 in cash upon the execution of said contract and the balance of $95.00 in monthly payments of $5.00, together with interest as aforesaid, and WHEREAS, the sum of $36.59 has been paid on said contract 'leaving a balance due and owing in the sum of $65.00, and 'vUHEREAS, "said purchasers are desirous of assigning all their right, title and interest in and to said contract to Maurice L. Benoit, NOW, THEREFORE, BE IT•RESOLVED BY THE CITY OF YAKIMA, that said assignment of contract as above set forth is hereby confirmed and ratified. 84 August 13,_1934 ADOPTED by the City Commission, signed and approved this 13th day of Aug- ust, 1934.
