2. DISCUSSION REGARDING STORMWATER MANAGEMENT PROJECT
A. PROJECT STATUS REPORT
John Knutson, utilizing Power Point, began the presentation on stormwater
management with a status report on the development project. He described the
three phases of the project:
• Phase 1 of the project includes a preliminary stormwater program assessment
• Phase 11 would be to develop the stormwater management program
• Phase 111 would be to finalize the program definition, identify capital
improvement projects, funding, and regulatory compliance

Mr. Knutson provided the following facts about the status of the tasks:
• The cooperative planning interlocal agreement is in place
• Work is proceeding on the field and GIS work, gap analysis /program
assessment, NPDES Response, and public education /involvement
• The capital improvement project needs assessment is in its initial review stage
• The consultant did a case study and looked at other cities
Mr. Knutson spoke about the public notification and involvement strategy. He
identified the Executive Committee as being comprised of elected officials from
Yakima County (Jim Lewis), City of Yakima (Mary Place, Larry Mattson and
Clarence Barnett), and Union Gap (Aubrey Reeves, Kim Owen, and Dan Olson).
B. FOCUS OF NEAR TERM EFFORTS

Mr. Knutson reported that the state is lagging behind in getting ready for the
March 10, 2003 NPDES permit deadline, but we still have the Federal
requirement to do something before that deadline. We have been working with
DOE since they have authority over the Clean Water Act. We considered the
possibility of submitting one regional permit; however, some requirements are
done locally and some regionally, so local governments will have to have their
own permits. In October, we received a permit application form from the
Department of Ecology (DOE). The question is what will we do with this
application? DOE provided it so if the local government feels a need, they have
the option to submit that permit application. We will submit something by the
federal deadline, possibly modeling the Eastern Washington guidelines. Council
Member Sims asked if a map of the NPDES covered area is available.
Mr. Knutson stated that one exists, but he doesn't have it with him. Council

Member Barnett asked if we were going to be given some relief from dry wells?
Mr. Knutson responded that Washington State DOE gave their assurance that
they want to take a different tact for new versus existing wells, and not follow
Oregon's lead.
Mr. Knutson commented that we still have to adopt a manual locally or adopt one
adapted from the DOE manual. Chris Waarvick commented that a manual for
Eastern Washington, different from Western Washington, may be adopted due to
less rainfall, but it may not necessarily be less expensive to follow its
requirements.
Mr. Knutson advised that a single application submittal would be made; however,
each jurisdiction will submit its own application.
Regulatory "Gap" Analysis: What Is It? Process. Core Regulatory Requirements.
Results.
Joe Simmler told the group that they are doing a different analysis for each
agency. Once they do that inventory they will compare it with the different
NPDES requirements and the underground injection program. There is a lot of
overlap between the two programs. One of the major differences is that NPDES
has an emphasis on eliminating illicit discharges. John Knutson briefly spoke
about public involvement/education, commenting that a high level of involvement
is necessary.
Regional Consolidation Interlocal Agreements
Staff reviewed the bullets in the PowerPoint presentation.

• Approach based on results of Regional Consolidation Study
• Four - phased approach
• #1 Yakima regional Stormwater Management Cooperative Planning
Project (completed /approved)
• #2 NPDES Permit: Administrative services provided by the County
• #3 NPDES Permit: Consolidated programs

• To be reviewed in five years for further consideration
Permit Administrative Services
• County leads permit negotiations; provides assistance for annual
administration, reporting and renewal process
• Each agency:
• Supports the permitting process
• Shares costs
• Appoints lead contact person
• Provides needed information
• Solely responsible for permit implementation
• Guided by Technical Steering Committee

Chris Waarvick and Paul Matthews reviewed the interlocal agreement and permit
process. Mr. Waarvick stated that tomorrow morning a free workshop on the
NPDES program would be given. This training is being provided throughout the
state. He proposed that we look at stormwater management in a consolidated
approach due to the commonalities involved, and provided information relating to
_ the interlocal agreement:
• The first interlocal agreement has been completed
• A common fee throughout the region could be considered
• Each entity may have separate notes or a list added on top of the ILA
• Selah and Moxee may join us in the future
Examples of Possible Future Consolidated Programs:
Management/Administration Staffing
Maintenance Public Education
Basin Planning Emergency WQ- Response •
Development Review Funding
Capital Improvements Inspection /Enforcement
Monitoring Equipment
Repair /Replacement
Listed above are examples of what could be considered for future consolidated
programs, looking for resource savings.
C. CASE STUDY — IMPACT ON LOCAL STREET SWEEPING PRACTICES
Case Study — Impacts on Local Street Sweeping Practices
.Chris Waarvick described Yakima's street cleaning program that includes removal
of roadside litter, fall leaf, snow and ice, spill cleanup, routine cleaning and chip
seal rock removal. We have a new challenge — cleaning streets as a best -
management practice to comply with NPDES in Phase 2. The city's street cleaning
program runs from February to December. $275,000 is in the Yakima City's 2002
budget for street cleaning. NPDES requires some cities to apply for a permit to .
discharge waters into streams. It may be possible to reduce the amount of physical
improvements necessary to contain or remove pollutants in the surface water
runoff by the operation of a sweeping program that meets best- management
practices. Mayor Place and Council Member Barnett questioned staff about the
best - management practices requirement to remove very small particulates before

they reach the city's storm drains. Vern Redifer commented that he does not know
yet what will be required; from a clean air perspective it would be 2.5; however, in
the drainage system, that is what is the pollutant. Dennis Henne commented that
Union Gap has had a regenerative air sweeper for four months and is happy with it.
Council Member Puccinelli asked if staff has looked at privatizing street sweeping?
Mr. Knutson responded that that is an option that was considered and is being
done by some other cities; however, typically, they don't have the equipment we
are looking at.

D. ACTION PLAN AND SCHEDULE OF FUTURE ACTIVITIES FOR 2003
Joe Simmler reviewed future activities and commented that over the next year,
more will be heard about what it takes to achieve compliance with the permitting
program and the deadline for the application for the NPDES permit. We will also
be hearing the results of the gap analysis, especially the costs. We will be looking
at regional consolidation opportunities to provide services and share costs. We
will also be looking at additional interlocal agreements regarding:
• Administrative aspect of the NPDES permitting process
• Programmatic type of interlocal agreement for activities that are deemed to be
done more effectively in a regional manner
• Funding
E. GENERAL QUESTION AND ANSWER SESSION
Following are responses to questions raised:
• Moxee and Selah were not included in a regional approach because Moxee's
system doesn't serve 1,000 or more people and Selah has prepared its own
Stormwater Management Plan
• Gravel roads aren't required to have stormwater treatment. Asphalt roads with
no curbs and gutters don't need stormwater treatment if the water can run off
the side of the road and be absorbed or collected; however, it can't be
directed to private property.
Presentation by Tom Tebb, Washington State Department of Ecology
Mr. Tebb applauded the group's efforts to work on stormwater. He spoke about
DOE's efforts to explore funding opportunities, particularly in the area of public
involvement and education. We are trying to expand the Centennial and 319
programs further to address infrastructure. The County and cities have been very
involved in the development of the Eastern Washington Stormwater Manual and
have made it a better product. Mayor Place commented that this meeting location
was selected so that the study session could be aired on cable TV on our Yakima
Public Affairs Channel (YPAC). She asked that this be included as part of our
public involvement and education program.
Question and Answer Session Continues:
The impact on business and households for funding the stormwater regulations
has not been determined. Grants will be sought. A couple of estimates were
given; one by Chris Waarvick at approximately $3 per month calculated in the
mid -90s, and one by Council Member Barnett at $82 per year.
Following a brief comment period, the group discussed the timing for the next joint
session, settling on sometime in February or March with the Executive
Committee.
