Moved by Washburn,_seconded by Stratton.that claims on the following funds be allowed and the City Clerk authorized to issue warrants therefor as follows: Current Expense $4,151.16, Claim Nos. 29472 to 29530 inc. as listed in the claim register; Water Dept. Total 1,384.81, Claims Nos. 6o69 to 6112_ inc. as listed in the claim register; Cemetery Total 71.97, Claims Nos. 29482 to 29527 inc. as listed in the claim register; Park,. Moved by Stratton, seconded by Washburn that there being no further business to come before the Commission we do now adjourn to meet Wednesday, October 11th, 1933 at 2 o'clock P. M: carried, Stratton, Washburn and Clark voting aye on roll call. ADJOURNED MEETING, WEDNESDAY,_OCTOBER lith, 1933, 2 P. M. The City Commission met pursuant to adjournment, Mayor Stratton and Commissioners. Washburn and Clark present on roll call. Moved by Stratton, seconded by Clark that the City Clerk is hereby authorized and di- rected to write a letter to the Cascade Lumber Company relative to the disposition of the matter of the water pipe at the intersection of North Eighth and G Streets in the City of Yakima belonging.to said Company, and inclose a copy of Resolution No.-C-72 which reads as follows: RESOLUTION NO. 0-72, WHEREAS, UNDER DATE OF APRIL 19, 1911, the Cascade Lumber Company, a corporation, issued - its license for . right-of-way to the Pacific Power & Light Company, its successors and assigns, of a six -inch water main, to be laid from the corner of 10G11 Street and Eighth Street in the City of North Yakima (now Yakima), Yakima County, state of Washington, about three hundred feet in an easterly direction to what is known as the "Mill Pond ", which said pipe line was to be laid across real estate,.more particu- larly described as follows: Northwest Quarter of Southeast Quarter, Sec- tion 18, Township 13 North, Range 19, E.W.M., Yakima County, Washington; and, WHEREAS, the City of Yakima, a municipal corporation of the first class, has, succeeded to the rithts of the Pacific Power & Light Company in and -to said license for right-of-way; and, WHEREAS, the City of Yakima, in the operation of the municipal water system of the City of Yakima has no further need for said pipe line hereiiaabove referred to and has heretofore discontinued the use thereof for the purposes for which it was first designed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA that -the Cascade Lumber Company, a corporation, grantor in said license, be notified, in writing, r that the use of said pipe line has been discontinued and that the Cascade Lumber Company a corporation, shall be given the opportunity and privilege of having conveyed to them, by the,City of Yakima, said pipe line -for any use to which they may wish to put the same BE IT FURTHER RESOLVED that the City of Yakima disclaims any lia- bility for damage to persons or property which may hereafter be occasioned or result from.the presence of said pipe line. BE IT FURTHER RESOLVED that delivery of all water by the City of Yakima for uses and purposes of Cascade Lumber Company shall be madeat the eight -inch gate valve now located on the connection with the main of the City Water System in the intersection of North Eighth Street and IIG" Street, through which valve the City con- trols the flow of water to the Cascade Lumber Company.
