The minutes of the regular meeting of Monday, December 22, 19474, be approved as read: IJioved by Bishop, seconded by Buck that the payrolls for the month of December, 1947, be allowed and the City :Clerk authorized to issue warrants as follows: Various Depts. $5743.10; Police Dept. $10,923.45; Fire Dept. $11,990.00; Health Dept. $1268.38; Engineering Dept. $3183.00; Irrigation $935.00; Library $1889.40; F. R. & P. $1997.30; P. R. & P. #310.00; Cemetery $230.00; Street Dept. $100.00 and Water'Dept. $7416.90; carried Buck, Bishop and Clark voting aye on roll call. Moved by Bishop, seconded by .Clark that this being the time for receiving bids for gas, oil, grease, etc. for the year 1948, and the bids of the Tidewater Asstd; Standard Oil, Fine Oil Co., Union Oil Co... and Shell Oil Co. having submitted bids; It is ordered that the bid of the Tidewater Associated Oil Co. be accepted as the best bid: carried Buck, Bishop and Clark voting aye.on roll call. Moved by Bishop, seconded by Buck that the resignation of Earl M. Fisher, as chairman of the Planning !Commission be and the same is hereby accepted with regrets: carried Buck, Bishop and 'Clark voting aye on roll call. The name of George M. Lemon was suggested by George W. Clark as a member on the.•Plann- ing Board to fill the vacancy caused by the resignation of E. M. Fisher; said confir- mation was approved and Mr. Lemon appointed until August 16, 1948s carried Buck, Bishop and Clark voting aye on roll call. Moved by Bishop, seconded by Buck that the City Engineer having reported the completion of the improvement of the construction of resurfacing Yakima Avenue from Naches Avenue to Seventh Avenue in L.I.D. 627; said work is hereby accepted: carried Buck, Bishop voting aye on roll call. Clark not voting. Moved by Buck, seconded by Bishop that the 'City Engineer having reported the completion of the Alley Paving in Blocks 1 and 2 Loma Vista Addition, L.I.D. No. 638, said work is hereby accepted: carried Buck, and Bishop voting aye on roll call. Clark not voting. RESOLUTION NO. cC -766, RESOLUTION fixing time and place for hearing. WHEREAS, Beulah Mae Teal, a widow, John W. Morken and Mary Mork husband and wife, and W. F. Byrd and Pearle L. Byrd, husband and wife, have petitioned the Mayor and the City Commissioners of the City of Yakima, for the vacation of a por- tion of a street in said city, described as follows, to -wit: North Front Street between Johnnie Walker Auto Court on the south, and Bartlett Place Street on the north. WHEREAS, it is necessary to fix the time and place for hearing said petition. NOW THEREFORE, be it resolved that said hearing be held at the City Hall, Yakima, Washington, on the 19th day of January, 1948, at 10 o'clock A.M. on said date, and BE IT FURTHER RESOLVED that the City Clerk be and she hereby is authorized and directed to post notice of said hearing in three of the most public places in the City of Yakima, and a like notice in a conspicuous place in the portion of said street above described. The above resolutions were duly and regularly proposed, passed and adopted by the City Commissioners of the City of Yakima, Washington, in a regular meeting duly and regularly called and held on the 29th day of December, 1947. RESOLUTION NO. C -767, WHEREAS; the Departme: acting as Agents of and for the Public Roads of the United States of America, is desirous FAP. No. U- 105(8) through the City of Yakima said improvement through said City of Yakima north City Limits and crossing other certain fares, and, at of Highways of the State of Washington, Administration of the Federal Works Agency of constructing Federal Aid Project No. and is desirous of routing the traffic on over First Street from North Avenue to the intersecting streets and public thorough- WHEREAS, the Department of Highways of the State of Washington is desirous of receiving Federal funds for the improvement of said First Street from North Avenue to North City Limits, and WHEREAS, the Public Roads Administration of the Federal Works Agency of the United States of America will not participate in the construction of said First Street from North Avenue to north City Limits until and unless the City of Yakima will agree to refrain from permitting encroachments upon the right of way of said above mentioned streets, and until and unless the 'city of Yakima will agree to refrain from passing ordinances or laws affecting the free flow of traffic on said above mentioned streets or that will give preference to local routes which intersect with said streets, other than by the erection or installation of "slow" and /or "caution" signs or signals, or that'will unreasonably hinder or delay traffic on said above mentioned streets, and until and unless the City of Yakima will agree, by suitable ordinance, to adopt the grades of the improvement as the grades of the city streets that are involved and agree to protect the State of Washington against any and all claims for damages on account of any changes of grades and the construction of this improvement, and until and unless the City of Yakima will agree to maintain said improvement within the 5. V 1 December 29, 1947 corporate limits of the City of Yakima after the improvement has been completed; NOW, THEREFORE, BE IT RESOLVED by the Mayor and 'Commissioners of City of Yakima that for and in consideration of the Department of Highways of the State of Washington and the Public Roads Administration of the Federal Works Agency of the United States of America constructing said First Street from North Avenue to north City Limits and routing traffic on the same through the City of Yakima over and. cross- ing other certain intersecting streets and public thoroughfares; it hereby agrees with the Department of Highways of the State of Washington and the Public Roads Admi.nistra- tion,of the - Department of Agriculture of the United'States of America °that it will not, in the future, permit encroachments on the right of way of the said above mentioned streets, nor will it pass any ordinances or laws affecting the free flow of traffic on said above mentioned streets or that will give preference to local routes which inter- sect with said streets, other than by the erection or installation of "slow" and /or "caution" signs or signals, or that will slow up, unreasonably hinder, or delay traffic on said above mentioned streets, and that it will, by suitable ordinance, adopt the grades of the improvement as the grades of the city streets that are involved, and hereby agrees to protect the State of Washington against any and all claims for damages account changes of grades and the construction of this improvement, and hereby further agrees to maintain said improvement within the corporate limits of the City of Yakima after this improvement has been completed. C -768, W�IEREAS there is in the Track Removal and Repair Fund the sum of $10,050.31 remaining after the expense of removing car tracks, and WHEREAS the said fund was created for the purpose of paying the expense of said removal and the Yakima Valley Transportation Company's share of the resurfacing of Yakima Avenue, and WHEREAS it is desired to apply this balance to the City's por- tion of the expense of resurfacing Yakima Avenue, which is to be paid out of the Street Fund; NOW, THERE 'ORE, BE IT RESOLVED BY THE CITY (COMMISSION of the City of Yakima, Washington, that the City Treasurer be and is hereby authorized. to transfer the above- mentioned amount from the said Track Removal and Repair Fund to the said Street Fund. day of December, 1.947, ATTEST: PEARL BENJAMIN City Clerk ADOPTED BY THE CITY COMMISSION, signed and approved this 29th ( SEAL) N. B -845, fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 617, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Clark, seconded by Buck that Ordinance No. B -845 be passed as read: carried Buck, Bishop and Clark voting aye on roll call.
