Moved by Buck, seconded by Bishop that the minutes of the-regular meeting of Monday, June 2, 1947, and adjourned meeting thereof be approved as read: carried Buck, Bishop and Clark voting aye on roll call. Moved by Clark, seconded by Bishop that the City Clerk is hereby instructed to give notice to contractors for resurfacing or paving Yakima Avenue; said bid to be received on Monday,-July 7, 1947 at 10 :00 o'clock A.Ma carried Buck, Bishop and Clark voting aye on roll call. Moved by Clark, seconded by Bishop that this being the time for the hearing on Resolutio No. C -735 for the construction of a domestic water system on 22nd Avenue South and there being.no objections in writing or otherwise to said improvement or any part there- of; it is ordered that the ordinance creating a local improvement district be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B-783, providing for the improvement of property in the City of Yakima, Washington by the construction of a domestic water system; establishing a Local Im- provement District; providing for the method of payment therefor and creating a spec- ial fund. Moved by Clark, seconded by Bishop that Ordinance No. B -788 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. ORDINANCE NO. B -789, amending Section 4 of Ordinance No. B -642 entitled "Aid ORDINANCE providing for licensing and regulating the operation of certain amusement machines commonly known as "Pinball machines" and other devices and games for use by the public; providing penalties for the violation hereof; repealing ordinances in conflict here- with, and fixing the effective date of this ordinance." Moved by Buck, seconded by Bishop that Ordinance No. B -789 be passed as read: carried Buck, Bishop and Clark voting aye on roll call. RESOLUTION NO. C -737, WHEREAS, C. IV. LeMasters on April 5, 1947, filed with the City Clerk his duly verified .claim for, damages, said claim being in the amount of $249.90, and said damages have been alleged to arise from the overflow of a City sewer main on South 19th Avenue in the four hundred block on March 8, 1947; said overflow of said sewer main being caused by an obstruction therein of which'the City had notice, or in the exercise of reasonable care should have had notice, and it appearing that the claimant has offered to settle and compromise said claim and to completely release the City of Yakima from all liability therefor upon the payment by the City of Yakima to him of the sum-.of $214.90, and it being for the best interests of the City of Yakima to accept said offer of compromise settlement, Arid WHEREAS, Perry W. Rainey on April 5, 1947, filed with the City Clerk his duly verified claim for damages in the amount of $60.00; said damages arising out of the same sewer obstruction as mentioned above, and said claimant being willing to compromise his claim for damages and to fully and completely release the City of Yakima from all liability therefor upon the payment by the City of Yakima to him .bf the sum of $60.00, and it being for the best interests of the City of Yakima to accept said offer of compromise settlement, NOW, TIIEREFORE BE IT RESOLVED BY THE COMMISSION OF TI, CITY OF YAKIMA : Section 1. That the claim of C. W. LeMasters for damages aris- ing out of the overflow of a City sewer main on South 19th Avenue in the four hundred block on March 8, 1947, be compromised and settled by the payment to said claimant of the sum of 214.90, and the City Treasurer is hereby authorized and directed to draw a warrant upon the proper funds of the City of Yakima in said sum to the order of said claimant in full settlement of said claim and to deliver said warrant to the claimant upon his executing and delivering a full and complete release to the City of Yakima for said damages. Section 2. That the claira of Perry W. Rainey for damages aris- ing out of the overflow of a City sewer main-on-South 19th Avenue in the four hundred block on March 8, 1947, be compromised and settled by the,payment to said claimant of the sum of $60.00, and the City Treasurer is hereby authorized and directed to draw a warrant upon the 'proper funds of the .City of Yakima in said sum to the order of said claimant,in full settlement of said claim and to deliver said warrant to the claimant upon his executing and delivering a full and complete release to the City of Yakima for said damages.
