Moved by Buck, seconded by Bishop that the minutes of the regular meeting of Monday, May 26, 1947 and adjourned meeting thereof be; approved as read: carried, Buck, Bishop and Clark voting aye on roll call. Moved by Bishop, seconded by Buck that the:_ resignation of Marie Donelson, as Deputy City Clerk.is hereby accepted, and Evadelle Peterson appointed to fill said vacancy; said appointment to begin, June 2, 1947 and to continue during the pleasure of the City Commission: carried, Luck, Bishop and Clark voting aye on roll call. Moved by Bishop, seconded by Buck that the following payrolls be allowed and the City Clerk authorized to issue warrants as follows: Sanitation Dept. $2135.40• Street Dept. $3266.40; Cemetery -Dept. $1061.10; Irrigation 4247.80; Parking Meters 4206.85 and Water 42340.35: carried Buck, Bishop, and Clark voting aye on roll call. Moved by Clark, seconded by Bishop that the lease between the Northern Pacific Railway - Company with the City of .Yakima for the bicycle lot, heretofore entered into on the 18th day..of June, 1941, is hereby cancelled and terminated as of this date: carried, Buck, Bishop and Clark voting aye on roll call. Moved by Clark, seconded by Bishop that the City Engineer having reported the completion of the sewer district in Brackett Park in the sum of '$10,752.67, said report is hereby accepted and the City Engineer instructed to prepare an assessment roll for said dis- trict and the City Clerk authorized to give notice of hearing on said roll for. C -736, WHEREAS the City Commission has heretofore decided to resurface Yakima Avenue with asphaltic concrete, and in connection therewith it is necessary to lay a 12 -inch water main and a concrete storm drain along the north side of Yakima Avenue and to have such water pipe and drain laid in advance of said resurfacing; AND WHEREAS the engineering department has heretofore considered doing the said work on the concrete drain by contract but it has now been decided that it will be to the best interests of the city to have said drain laid by the water de- partment at the same time that the water pipe is laid and such change in plans has created an emergency requiring the purchase of concrete pipe and asphalt concrete; NOW THEREFOR, BE IT RESOLVED BY THE CITY COMMISSION of Yakima, Washington that anemergency exists with reference to the purchase of concrete pipe and asphalt concrete`and that therefore the purckia.sing; agent be and he is hereby authorized to purchase the said pipe and concrete upon such terms as will be for the pest interests of the city in the. open market. Tl,e authorization hereby given is for the purchase of not, more than 24 feet of 21" concrete pipe, 1600 feet of 18" concrete. pipe, 450 feet of 15" concrete pipe, and 185 tons of asphalt concrete, to comply.with specifications sub- mitted by the city engineer. of June, 1947. B -786, amending Ordinance No. B -293 entitled "AN ORDINANCE regulating and restricting the location of trades and industries; regulating and limiting the use of buildings and premises; and the height and size of buildings; providing for yards, courts and other open spaces; establishing districts for said purposes, and providing for a board of adjustment, and repealing Ordinances Nos. B -22, B -35, B -43, B -51, B -71, B -1260 B -147, and B- 17211. Moved by Clark, seconded by Bishop that Ordinance No. B -786 be passed as read: carried Buck. Bishop and Clark voting aye on roll call. ADJOURNED MEETING, THURSDAY JUNE;. 5th, 1947 10 A.M. The .City Commission not pursuant to adjouri2rent, Mayor Buck and Commissioners Bishop and Clark present on roll call. This being the time for the hearing on resolution No. C -731, the purpose of giving the property owners a chance to be heard on the matter of the resurfacing of Yakima .Avenue, including installation of-curbs, gutters, and storm sewers. On account of the attend= ance the hearing was adjourned to the Chamber of Commerce. About 75 property owners were in attendance and a general discussion was had relative to whether or not any re- surfacing should be undertaken and if so the kind of• material to be used. An expression of opinion was invited on the two matters and about 25 indicated opposition to any such improvement. On the issue of whether asphaltic concrete or cement should be used there we-r.e four who expressed themselves as being in favor of cement® The meeting was then adjourned to the City Hall and again adjourned until June 6, at which time an ordinance was introduced establishing a local improvement district and fixing the.amount of the City's participation in the cost of the improvement. This amount was based upon the assumption of 30% of the cost of resurfacing and 70% of the cost of the storm sewer by the City upon the estimate of the city engineer. The amount of the Cityls participation also took into consideration the payment of approximately 9,000, the estimated balance of the $35,000 fund in the hands of the City for reriov- ingr:ails and for payment of the Yakima Valley Transportation Company's share of the pavement between the rails. The adoption of the ordinance was moved by Buck and seconded by Clark and unanimously carried. Moved by Buck, seconded by Bishop that Ordinance No. B -787 be passed as read: carried Buck, Bishop and Clark voting aye on roll call.
