HISTORY • August 2018 Detective Durbin was directed to present to the Public Safety Committee a diagnostic report of the issues related to domestic violence in oL.r community. Prosecutor Cynthia Martinez was directed to report on domestic violence prosecution efforts. • November 2018 Prosecutor Cynthia Martinez was directed to conduct a survey of the City ofYakima Domestic Violence Response. The survey indicated a lack of an organized city response to Domestic Violence. • City Council funded a system based legal advocate to assist with victim outreach in City ofYakima Prosecution domestic violence cases. • YPD and the City Prosecutor's Office were tasked with improving the response. • Lack of Data • Disconnect between City prosecutors and police on DV cases • No formal agreement on howYPD could utiize the DV advocate. • No change in response,however,❑etective Durbin suggested increased patrol responses which included additional mandates and staffing. Prosecutor recommended the formation of a City Coordinated Community Response Team. For various reasons at the time,these effort were not implemented. WHAT IS THE CHALLENGE? IPV-TBI • Unlike normal and obvious injuries such as breaks, bruises or cuts. • Undetectable to the naked eye. • Injuries manifested in: • Cognitive, behavioral and psychological symptoms • Headaches, nausea,forgetfulness, insomnia, poor concentration, dizziness,feeling depressed or anxious, irritable or easily angered. • Directly impacts their ability to respond appropriately to help (law enforcement). (daily meeting) • Tracking progress of cases referred for prosecution to identify procedural/training needs. CONTI NU ED • Restructure of Prosecution Unit — Once we are fully staffed, the Division will form a Family and Community Violence Unit. The attorneys in this unit will receive specialized training and have a smaller caseloads to allow more time per case. • GOA — (Gone on Arrival) increase victim safety by expedited review and warrant requests for gone on arrival perpetrators. Expedited service of GOA warrants. • Proposal of new city ordinances to address specific conduct. • Prosecution policies and services that line up with case leveling. WHAT WE ARE EXPLORING • ChulaVista and City of Spokane Model • Has resulted in a 20% to 24% reduction in DV calls for service • Wrap around advocacy services • Victims in high leveled cases receive immediate advocacy • Focused deterrent efforts for perpetrators LEVELING I PV DV • Level-I: no criminal event (referred for community LEVEL-3 OFFENDER: • Offender letter based resources) CHRONIC(5+) ' Advocate w/in 24hrs AND/OR • 3 day follow-up • Level-2:first arrest or no lethality issues. (processed as I Case staffing usual with communitybased diversion efforts). HIGH VIOLENCE r ) Detective assigned • 3-day follow up with a police officer • Contact with an advocate LEVEL-2 OFFENDER: • Offender letter Advocate 2hrs • Level-3:Wrap around services from police, REPEAT STATUS w/in folio • prosecutors, advocates, and probation.. 1-5 PRIOR OFFENSES 3 day follow up • Case staffing • Triaged by all parties within 24 hours of incident • Detective (discretionary) (excluding weekends) _ • Follow up with a police officer within 72 hours of incident. LEVEL-1 OFFENSE: • Warning letter • • Immediate contact with detective,advocate and NON-CRIMINAL Advocate w/in 7 days probation officer (if on probation). VERBAL ONLY • Case staffing (optional) • Immediately processed for arrest warrant if offender was gone on arrival (GOA project).
