Clark present on roll call.

RESOLUTION NO. C -696, BE IT RESOLVED BY THE -CITY =MMISSION OF THE CITY OF YAKIMA, WASH :
A resolution authorizing the Mayor and the City Clerk of the
City of Yakima to execute; for and on behalf of the City of Yakima, a written easement,
granted by the Oregon- Washington Railroad and Navigation Company, and the Union Pacific
Railway Company to the City of'Yakima, for the 15 inch sewer pipe across the property
of the said Companies located on the vacated portion of West Spruce Street just east of
Second Avenue South.-
Section 1. That the Mayor and City Clerk of the City of Yakima
be and they are hereby authorized and i.nstucted -to execute, in behalf of the City of
Yakima, that certain written easement heretofore prepared, wherein the Oregon- Washington
Railroad and Navigation Company and the Union Pacific Railroad Company; known as the
railroad companies, pary of the first part, and the City of Yakima, known as Licens-e.e,
is party of the second part, which said easement is for a 15 inch sewer pipe across the
property of the railroad companies, located at West Spruce Street and Second Avenue
South, in the ' City- of Yakima, 'Washington.

Resolution No. C -6952 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, WASH
That it is its intention to improve the property lying between
26th Avenue South and 30th Avenue South and between West Washington- Street and the south
right of way line of the Naches and Cowiche Canal, by constructing pipe sewers with the
necessary wye branches, manholes, flush tanks and water connections .therefor, all of
said improvement to be constructed in full accordance with the plans and specifications
to.be prepared by the City Engineer and filed with the City Clerk.
_ The district to be served by and assessed for the above described
improvement is described as follows, to -wit:

Lots 69 to 113, inclusive of Brackett Park, according to the plat
thereof on file and of record in the office of the Auditor of
Yakima County, Washington.
All persons who may desire to object to said-proposed-improvement
are hereby notified to appear and present such objection, if<-any, at a meeting of the
City Commission to be held at its office in the City Hall in the City of Yakima, Yakima
r
County, 'Aashington, at the hou_ .of 10 of clock A.M., on Monday the 16th day of September
1946, which time and place are hereby fixed for the hearing of all matters relating to
said proposed improvement or objections thereto, and for determining the method of pay -
mentfbr said improvement; and the City Clerk is hereby directed to give due notice of
' said hearing and of the intention to make the aforesaid improvement.
The cost and expense of said improvement, including the cost of
acquiring right of way easements, engineering, .surveying, advertising, publication of
notices, and all other expenses incident thereto, shall be borne by and assessed against
all of the property legally and properly assessable therefor as provided by law and as
above described; and the City Engineer is hereby directed to-submit to the City Commis-
sion at or prior to the date fixed herein for said hearing, all of the data and other
information required by lawo be by him submitted.
