The City Commission met in regular session, Mayor Mogren and Commissioners Sanford end
Clark present on roll call.
Moved by Mogren, seconded by Sanford that the minutes of.the regular meeting of Monday,
March 11th, 1946 be approved as read: carried, Mogren, Sanford and Clark voting aye
on roll call.
Moved by Clark, seconded by Sanford that the City Engineer having reported the
completion of the work in L.I.D. No. 596 by the Contractor, said work is hereby accept-
ed and the City Engineer authorized to prepare an assessment roll therefor, and the
City Clerk instructed to ggive notice of hearing on said roll by publication as required
for Monday, April 15, 1946.at.9 o'clock. A.M: carried, Mogren, Sanf ad and Clark voting
aye an roll. call.
Moved,byo8a.nford, seconded by Mogren that the following claims be allowed and the City
Clerk instructed to issue warrants as follows: Current Expense $300.44; Street $69.71;
Irrigation $5.00: carried, Mogren, Sanford and Clark voting aye on roll call.
ORDINANCE NO. B -695, AN ORDINANCE providing for the annexation by the City of Yakima,
Wash.ngton, of certain property contiguous to the present.bound.aries of said city.
Moved. by Clark, seconded by Mogren that Ordinance No. B -695 be passed as read: carried
Mogren, Sanford and Clark voting aye on roll call.
Moved by Mogren, seconded by.Clark that we do now adjourn to meet Thursday, March 27,

The-Ci.y Commission met pursuant to adjournment, Mayor Mogren and Commissioners Sanford
and Clark. present on roll call.
RESOLU °PION NO. C -679, This resolution, and the recitals embodied herein, are adopted b;
the City Commission of the City of Yakima this 29th day of March, 1946, the Commission
being duly assembled. for the transaction of official business, and all members of the
Commission being present and concurring in the adoption hereof namely:
WHEREAS Pacific Power & Light Company, hereinafter sometimes re-
ferred to as "the.Company ", is and.for may.years.has been engaged in furnishing electri
service within the corporate limits of the City of Yakima as a public service company,
subject to regulation as to its rates, rules, practices, and service in the manner pro-
vided by low; and said Pacific Power & Light Company is the only company or agency en-
gaged in furnishing such;service within the city,.a.nd is the only company or agency in
position to furnish the City with the special post.street lighting service required by
the City: and.
WHEREAS, by Ordinance No. B -609 of the City of Yakima, approved
July 11, 1944, the City of Yakima granted an electric franchise to the Company for the
term of twenty -five years from said July 11, 1944, and Section .7 of said ordinance re-
quired the Company at its own cost and expense to construct, install and provide such
modern and efficient system or systems for lighting the streets, highways, bridges,
and public places of the City, and to maintain and operate such system or systems, a,s
the City Commission may from time to time request, all at and upon reasonable rates,
terms and conditions; and
WHEREAS, the City now desires to make provision for the present
and future special post street lighting requirements of the City, and.the Company in
conformity with the provisions of said Section 7 of said Ordinance No. B -609, has
offered to enter into a ten -year contract with the City for such special post street
lighting service, which shall be supplied from new systems to be installed, owned,
and maintained by the Company, and from the existing Naches Avenue System to be owned
and maintained by the City, all as provided in the form of contract hereinafter referre
to; and
WHEREAS, the xity Commission has before it for consideration a.
proposed ten -year contract between the City and the Company, providing for the Company's
furnishing all such special post street lighting service required by the City, and said
proposed contract has been.approved ag to form by the City Attorney, and a. copy thereof,
as so approved by the City Attorney, ha.s been placed on file with the City Clerk and is
identified herein by such reference; and
WHEREAS, the City Commission has determined that the terms, pro-
visions, and conditions set forth in said. proposed contract are just,fa.ir, and reason=
able, and in conformity with the provisions of Section 7 of said Ordinance No. B -609,
and, with the Company's published. tariff schedule applicable to special post street
lighting service on file with the Department of Public .Utilities of Washington, and that
the interests of the City and. the citizens and the inhabitants thereof.will best be
served by the City's entering into said proposed contract with the Company for such
special post street lighting service:
NOW, THEREFORE, it is hereby
RESOLVED: that it is necessary for the public peace and safety
of the City of Yakima and the residents and inhhbita.nts thereof
that provision be made by contract with said. Pacific Power &
Light Company for such special post,-street lighting service for.
lighting the streets and public places,of the City for the term
of ten years as provided in the proposed contract referred to in
the foregoing recitals; and
FURTHER RESOLVED: that the execution by the City of Yakima of a
contract with the said Pacific Power & Light Company, providing
for the latter's supplying such special post street lighting
service to the City upon the terms and conditions and for the
ten -year period set forth in the proposed contract referred to i

the foregoing recitals hereof, be and the same is hereby approved
and that the Mayor and the City Clerk of the City of Yakima be
and they hereby are respectively authorized a.nd directed to exe-
cute and deliver such contract in the name and behalf of said
City, with the seal of the City of Yakima impressed thereonnand
attested by the City Clerk.
