The City Commission met in regul. =r session, Mayor Mogren and Commissioners Sanford and
Clarkpresent on roll call:
Moved by Mogren, seconded by Sanford that the minutes of the regular meeting of Monday
February 4th., 1946 be approved as read.; carried, Mogren, Sanford and Clark voting aye
on roll call.
Moved by Mogren, seconded by Sanford that this being the time for receiving bids for
the purchase of an aerial Truck Ladder for the Fire Department the following were re-
ceived; Peter Pirsch & Company $21,785.00; American La. France Foamite Corporation
x$21,250.00; Howard Cooper Inc., $21,595.00; the bid of Howard Cooper Inc., being ac-
cepted as it is the lowest and best bid in the sum of $21,585.00; carried, Mogren,
Sanford, and Clark voting aye on roll call.
RESOLUTION NO. c -674, TRANSFER RESOLUTION AND REQUEST FOR THE DIRECTOR OF HIGHWAYS TO
- PERFORM CERTAIN WORK
Resolution No. C -674
.Before the City Commission of City of Yakima, Washington
IT IS HEREBY RESOLVED, by the City Commission that the Director of Highways is author-
ized and directed to prepare.the °bid documents and advertise for bids for the�lmprove-
ment of South First Street.from East B Street to Lenox Avenue. Based on 1% of
estimated Cost.to the amount of Eleven Hundred and no /100 ($1100.00) Dollars, ,and
THE STATE AUDITOR IS HEREBY AUTHORIZED AND DIRECTED to reserve from monthly fuel tax
allotments the above specified sum, being an amount not in excess of the money reason-
ably anticipated to accrue to the credit of the City of Yakima in the Motor Vehicle
Fund during the current biennium;.and
Upon notice to said auditor from the Director of Highways that the aforesaid work ha.e
been completed, and a statement of cost has been furnished the commission of City of
Yakima of the cost of all-labor, equipment, material, supplies, and engineering, the
State Auditor is further authorized and directed to effect reimbursement to the Depar
ment of Highways in the amount of such cost from the funds reserved, however, not to
exceed the above specified sum with any unexpended-balance to be released to the City
Commission of Yakima and to be included in the next succeeding.warrant covering fuel
tax allotments;.all in accordance with Section 11, Chapter 82 of the Session Laws of
1943.
Adopted by the City Commission of Yakima this 11th day of.February, 1946.

RESOLUTION NO. C -679 WHEREAS, the Department of Highways of the State of Washington,
acting as Agents of and for the Public Roads Administration of the Federal Works Agency
of the United States of. America, As desirous of constructing Federal Aid Project
F 105(9) & U105(7) throught,the City of Yakima and is desirous of routing the traffic
on said improvement through said .City of Yakima over First Street from "-B" Street
to Beech Street F.A. .No. F -105 (9) and First Street from Beech Street to Lenox Avenue
(South corporate limits) F.A. No. U 105(7) and crossing other certain intersecting
streets and public thoroughfares, and,
WHEREAS, the Department of Highways of the State of Washington is
desirous of receiving Federal .funds for the improvement of said First Street from 11811
Street to Beech Street and Beech Street to Lenox Ave.,, and
WHEREAS, the Public.Roads: Administration of,the Federal Works.
Agency of the United.States of America „will not participate in the construction of said
First Street from "BI' Street to Beech Street and from Beech Street to Lenox Avenue unti
and unless the City of Yakima will agree to refrain from permitting encroachments upon
the right of way of, -said above mentioned streets, and until and unless-the City of
Yakima will agree to refrain from passing ordinances or laws affecting the free flow
of traffic on said above mentioned.streets or that will give preference to local routes
which intersect with said streets, other than by the erection or installation of "slow”
and/or "caution" signs or signals, or that vAll unreasonably hinder or delay traffic on
said above mentioned streets, "and until and unless the City of Yakima will agree, by
suitable ordinance, to adopt the grades of the improvement as the grades of the city
streets that are involved and agree to protect the State of Washington against any and
all claims for damages on account of any changes of grades and the construction of this
improvement, and until and unless the City of Yakima will agree to maintain said
improvement within the corporate limits of the City of Yakima after the improvement has
been completed;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of City
of Yakima, that for and in consideration of the Department of Highways of the State of
Washington and the.Public Roads Administration of the Federal Works Agenncy of the
United States of America constructing said First Street from "B" Street to Beech Street
and Beech Street to -Lenox Ave., and routing Traffic on the same through the City of
Yakima over and crossing other certain intersecting streets and public thoroughfares,
it hereby agrees with the Department of Highways of the State of Washington and the.
Public Roads Administration of the Federal Works Agency of the United States of America
that it will not, in the future,.permit encroachments on the right of way of the said
above mentioned streets, nor will it pass any ordinances or laws affecting the free
flow of traffic on said above mentioned streets or that will give preference to local
routes which intersect with said streets, other than by the erection.or installation
of "slow" and /or "caution "_signs or signals, or that will slow up, unreasonably hinder,
or delay traffic on said above mentioned streets, and that it will, by suitable
ordinance,-adopt the grades of the improvement as the grades of the city streets that

are involved, and hereby agrees to protect,the State of Washington against any and all
claims for damages, account changes of grades and the const.ruction of this improvement,
and hereby further agrees to maintain-said improvement within the corporate limits of
the City of Yakima after this improvement has been completed.
PASSED by the City Commission of the City of Yakima County,.Washington,
this 13th day of February A..D, , 1946.
