MoveM by Mogren, seconded by Sanford that the minutes of the regular meeting of Monday, January 21st, 1946.be approved as read.: carried, Mogren, Sanford and Cark voting aye on roll call. Moved by Clark, seconded by Sanford,that this being the time for the hearing on Newullth and C -$67„ providing for the construction of a domestic water system on East A Street and there being insufficient protest against said im- provement or any part thereof; it is ordered that the ordinance creating a local im- provement district be passed as read: carried, Mogren, Sanford and Clark voting aye on roll call. ORDINANCE NO. B -6V , AN ORDINANCE providing for the improvement of property in the City of Yakima, Washington, by the construction of a domestic water system; establishing a local improvement district, providing for the method of payment therefor and creating a special fund. Move? by Clark, seconded by Sanford that Ordinance No. B -697 be passed as read: carried, Mogren, Sanford and. Clark voting aye on roll call. RESOLUTION NO. 0-670, A RESOLUTION directing and providing for the removal of all abandoned street railway tracks in the City of Yakima., Washington WHEREAS there exists in the City of Yakima a considerable amount of abandoned street railway tracks of the Yakima Valley Transportation Company which has either been abandoned or is no longer used in the operation of its railway system and it would be to the best interests of the City of Yakima, its streets and traffic thereon that said tracks be removed, now, therefore, BE IT RESOLVED by the City Commission of the City of Yakima, Washington: That pursuant to the provisions of.Ordinance No. 505,:;, entitled AN ORDINANCE granting to Yakima Inter- ValleY Traction Company, a corporation, itg.'successors and assigns, the right to construct, build, equip, maintain and operate a single or double track railway system upon certain streets, alleys and public grounds in the City of Yakima, for a period of forty years. and pa.rticula.rly Section 19 thereof, the Yakima Valley Trans portation Company be and it is hereby ordered and directed to immediately proceed with the removal of all abandoned street railway tracks located in the City of Yakima., eash..ington, including tracks located.on the following streets: BE IT FURTHER RESOLVED that such removal be commenced within 70 days from the date hereof and be completed within 60 days from the date hereof and that all of such removal proceedings be done and performed under the general supervision of the City Engineer of the City of Yakima. and the.Commissioner of Public Works of the City of Yakima, and-that damage to the streets caused by the removal of said abandoned tracks be repaired and replaced all under the supervision and in accordance with.the reouirements of the City Engineer and the Commissioner of Public Works of the City of Yakima. RE IT FURTHER RESOLVED.that in the event of the failure of the Yakima jalley Transportation Company to proceed, as herein provided., that said abandon- ed tracks may be removed by the City of Yakima and that the expense and cost thereof with 10% additional shall be charged against and recovered from the Yakima.
