The. City Commission met in regular session. Mayor Mogren, Commissioners White and Clar
Present,on roll call.
Moved, by Mogren., seconded by Clark that the minutes of the regular meeting of Monday,
February 5th, 19115, and adjourned meeting thereof be approved as read: carried,
Mogren, White and Clark Voting aye. on roll call.
Moved by Clark, seconded by White that this being the time for the hearing on
Resolution No. 0 -645 providing for paving and sewer Pipe in Lots 1 to 32, Block 9,
City of Yakima, and. there being insufficient protest against said improvement or any
part thereof: it is ordered that the ordinance creating a Local Improvement Distrct
be passed as finally read: carried., Mogren, White and Clark voting aye on roll call.
ORDINANCE N0. B -630, AN ORDINANCE providing for the improvement on.the alley in Block
9, City of Yakima, by paving the same with one course Portland cement concrete six
Inches thick and. by- constructing a•ten -inch pipe sewer with the necessary extensions
and connections; establishing a local improvement district, providing the method of
payment therefore and creating a special fund.
Moved by Clark, seconded by 1,,%.ite that Ordinance No. B -630 be passed as read: carried
Mogren, White and Clark voting aye on roll call.
Mbv0l'by Clark, seconded by White that the City Clerk is hereby authorized to give
notice to contractors for paving the alley and. constructing a sewer -pipe in Lots 1 to
32, Block 9, City of Yakima; said bids to be received on Monday, Feb, 26th, 1945 at
10 o'clock A.M; carried, Mogren, White and. Clark voting aye on roll call.
Moved by Mogren, seconded by White, that we do now adjourn to meet Friday, February
16th, 1945 at 9 o'clock A. M., carried, Mogren, White and Clark voting aye on roll
call.
ADJOURNED MEETING, FRIDAY, FEBRUARY 16th, 1945. 9 A.M.
The City Commission met pursuant to adjournment, Mayor Mogren, and Commissioners White
and Clark present on roll call.
RESOLU`T'ION NO. C -648, A RESOLUTION providing for the termination of a certain Trust
Agreement dated May 7th, 1926 involving certain u►a.ter purchased. from Frank Glaspey
and releasing the trust funds held by the Guaranty Trust Company.
WHEREAS THE CITY OF YAKIMA by Deed dated May 7th,1926,
purchased. from Frank Glaspey and anna Gla.spey three (3) cubic feet of water per second
of time, and on said date entered into a. trust agreement with the Guaranty Trust
Company pursuant to which agreement the sum of Twenty -four Hundred Dollars, ($2,400.00
being the Purchase Price of (1) cubic foot of said water right was placed. in trust
pending the possible adjudication of the ,rater rights of the- Naches River, which
adjudication was then considered probable and,
WHEREAS said, adjudication has not taken place and does not now
seem probable and.the controversy over said water rights has been settled and the
Guaranty Trust Company is being dissolved, and desires that said Trust agreement be
terminated and said trust funds released,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF YAKIMA:
That that certain Trust Agreement dated May 7th, 1926 between
the City of Yakima. as Second Party, the Guaranty Trust Company as First Party and
Frank Glaspey and Anna. Glaspey, husband and wife as Third. Parties be and. the same is
hereby terminated and the Guaranty Trust Company is hereby authorized to pay the Trust
funds held pursuant to said Trust Agreement to sRld Frank Glaspey and Anna Claspey.
PASSED AND ADOPTED BY THE CITY OF YAKIMA this 16th day of
February, 1945
