Clark present on roll calla
Moved by Mogren, seconded by White that the minutes of the regular meeting of Monday,
December 11th, 1944, be approved as read: carried, Mogren, White and Clark voting
aye on roll call.
Moved by White, seconded by Mogren that the following payrolls be allowed and the
City Clefik authorized to lissue,warrants as follows: Cemetery $246.00; Sanitation
$1,281.00; Street $1,515.00: carried, Mogren; White and Clark voting aye on roll call
Moved by White, seconded by Mogren that the following claims be allowed and the City
Clerk authorized to issue warrants as follows: Current Expense $2,679.77; Cemetery
$136.85; Street, $1,165.- 3; Water $2,!+33.89; F. R. & P. $22.00; P.R. & P.- $176.24 and
Irrigation $33.43; Park 1279.85;
Moved by Mogren, - seconded .by White that the City Commission hereby favors the sponsor -
ship of a. bill to be introduced at the 1945 legislature to make available to cities
and towns a retirement plan for municipal employees; it berg understood that the plan
will be absolutely optional, or voluntary with each municipality, setting up machinery
only for town that wish to utilize the same: carried, Mogren, White and Clark voting
aye on roll call.
Moved:by' "Mogren., seconded by White that the City Commission hereby favors the sponsor -
ship''of°Fa "bill to be introduced at the 1945 legislature, providing for a civil service
enabling act to-authorize* cities other than first class, or those not now having the
authority, to establish their own merit, or civil-service systems on a. home -rule basis;
it being understood that the plan will be absolutely voluntary or optional with each
municipality: carried, Mogren, White and Clark voting aye on roll call.
RESOLUTION N0. C -641 BE IT RESOLVED BY THE CITY COMMISION OF THE CITY OF YAKIMA,
WASHINGTON:
That it is its intention to improve the property lying within
the following described district by constructing .pipe sewers with the necessary wye
branches, manholes, flush tanks with water connections therefore, and also by the
construction of an 8 inch domestic water main on 35th Avenue North, and by the instal-
lation of ten (10) fire hydrants in that part of the district, lying North of Summit -
view all of said improvement to be constructed in full accordance with the plans and
specifications to be prepared by the City Engineer and filed with the City Clerk.
The district to be served and assessed for the above described
improvement and the boundaries thereof are described as follows:
Beginning at the intersection of the center line of Grandview
Avenue, City of Yakima, with the South line of Flagg Addition;
Thence North along the center line of Grandview Avenue, 465
feet more, or less to the center line of Lincoln Avenue: thence
West along said center line to a. point 262.4 feet West -of the
West line of Hillcrest Avenue; thence South-130 feet;-thence
East and parallel with the - center line of Lincoln'Avenue, 125
feet; thence South and parallel with the center fine of Hillcrest
Avenue 311 feet; thence West 50 feet; thence South 871.4 feet to
the center line of Summitview Avenue; thence Westerly-along said
center line of Summitview Avenue to the 'center line of Glenn
Drive; thence South' along -said center line of Glenn Drive to
the South line of Lot 6, Nagle's Nob Hill.Half Acres; thence
Easterly to the Southeast corner of said Lot 6; thence South to
the Southwest Corner of Lot 3, Nagle's Nob Hill Half'Acres;
thence easterly along the South line of said Lot 3 extended East!-;''
eriy to the center line of Hillcrest Avenue; thence Northerly
along said centerline of Hillcrest Avenue to the center line of
Barge Street; thence Easterly abng the center line of Barge Street
to Grandview..Avenue; thence Northerly along the centerline of
Grandview Avenue to the center line of Summitview Avenue; thence
Westerly along the center line of Summitview avenue ' to -the center
line of 35th Avenue North; thence Northerly along the center line
of 3.5th Avenue North, to the South line of Flagg Addition, thence;,,
Easterly along the South line of Flagg Addition to the point of
beginning.
All persons who may desire tocbject to said proposed improvement
are hereby notified to appear and present such objections, if any, at a meeting of
the City Commission to be held at its office in the City Hall in the City of Yakima,
Yakima County, Washington, at the hour of 10 :00 o'clock A.M., on Monday -the 22nd day
of January, 1945, which time and place are hereby fixed for the hearing of all matters..
relating to said proposed improvement or objections thereto, and for determining.the
method of payment for.said improvements, and the City Clerk is hereby directed to
give due notice of said hearing and of the intention to make the aforesaid improve-
ment.
The cost and expense of said improvement, including the cost of
acquiring right of way easements, engineering, surveying, advertising inspection,
Dublication of notices and 9.11 other expenses incident thereto shall be borne by and
assessed against 9,11 of the property legally and properly assessable therefore as
provided by law and as above described.; and the City Engineer is hereby directed to
the City Commission at or prior to the date fixed herein for said hearing, all of the
data and other information required by law to be by him submitted.

hereby allowed and the City Clerk authorized to issue warrants as follows: Various

RESOLUTION NO. C- 642 ; -This Resolution, and the recitals embodied herein, are adopted
by the City Commissi.6n..of the City of Yakima this•21st day of December, 1944, the
Commission being duly assembled. for the transaction of official business, and all
members of the.Commission being present and concurring in the adoption hereof, namely:
WHEREAS Pacific Power & Light Company, hereinafter sometimes
referred to as "the Company ", is and for many years has been engaged in furnishing
electric service within the corporate limits of the City of Yakima as a public service
company, subject to regulation as to its rates, rules, practices, and service in the
manner provided by law; and said Pacific Power & Light Company is the only company or
agency engaged in furnishing such service within the City, and is the only company -
or agency in a position to furnish the City with the overhead circuit street lighting
service required b%y 'the City;; and
WHEREAS, by Ordinance No. B -609 of the City of Yakima, approved
July 11, 1944, the City of Yakima granted and electric franchise to the Company for
the term of twenty -five years from said July 11, 1944, and. Section 7 of said. ordinance
requires. the Company at its own cost and expense to construct, install, and provide
such modern and efficient system or systems for lighting the streets, highways, bridge E,
and public places of the City, and to maintain and operate such system or systems, as
the City Commission may from time to time request, 9,11 at and upon reasonable rates,
terms, and conditions; and
WHEREAS the City now desires to make provision for the present
and future overhead circuit street lighting requirements of the City, and on a basis
more flexible and more advantageous to the City than is provided under the present
under the present ten -yeas contract between the Company and the City relating to such
service, dated June 6, 1938; and the Company, in conformity with the provisions of
said Bection 7 of said Ordinance No. B-609,-has offered to enter into a new five -year
contract with the City for such overhead circuit xtreet lighting service, to be sup-
plied from fixtures attached to wood poles owned by the Company within the corporate
limits of the City, and at the reduced rates now provided for such service under a
five -year contract by the Company's tariff schedule applicable thereto(W.P.P.W.68,
Third Revision of Sheet 60, issued August 21, 1944), and on terms permitting the City
to obtain such replacements, additional installations, and removals from service of
lighting equipment as the City may from time to time desire and request; and
WHEREAS the City Commission has before it for consideration a
proposed five -year contract between the City and the Company, providing for the
Company's furnishing all such overhead circuit street lighting service required by
the City, to be supplied by lamps and fixtures attached to.wood poles; and said pro-
posed contract has been approved as to form by the City Attorney, and a copy thereof,
as so- approved by the City Attorney, has been placed on file with the City Clerk and
is identified herein by such reference; and
WHEREAS the City Commission has determined that the terms, pro -
visions,and conditions set forth in said proposed contract are just; fair, and reason-
able, and in . conformity with the provisions of Section 7 of said Ordinance No. B -609,
and with the Company's published tariff schedule applicable to overhead, circuit street
lighting service on file with the Department of'Public Service of Washington; and that
the interests of the City and the citizens and inhabitants thereof will best be served
by the City's entering into said proposed contract with the Company for such overhead
circuit street lighting service for a term of five years, beginning January 1, 1945;
NOW, THEREFORE, it is herby
RESOLVED: that it is necessary for the public peace and safety
of the City of Yakima and the residents and inhabitants thereof that provision be
made by contract with said Pacific Power & sight Company for such overhead circuit
street lighting service for lighting the streetx and public places of the City for
the term of five years beginning January 1, 1945; and
FURTHER RESOLVED: That the execution by the City of Yakima of c
a contract with said Pacific.Power & Light Company, providing for the latter's
supplying such overhead circuit street lighting service to the City upon the term
and conditions and for the five - .yeas period set forth in the copy of proposed contract
referred to and identified in the preceding`recitals hereof, be and the same is hereby
approved; and that the Mayor and. the. City Clerk of the City of Yakima be and they
hereby are respectively authorized and directed to execute and deliver such contract
In the name and behalf of said City, with the seal of the City of Yakima impressed
thereon and attested by the City Clerk.
