Moved by Mogren, seconded by White that the minutes,of the regular meeting of Monday, July 31, 1944 be approved as read: carried; Mogren, White and Clark voting aye on roll call. t. RESOLUTION NO. C -634, A RESOLUTION authorizing the sale of beginning 27 feet east and 115 feet south of the Northwest corner of the Northeast 1/4 of the Northwest 1/4 of the Northeast 1/4 of Section 24, Township 13 North, Range 19, E.W,M., thence east,105 feet, south 58 feet, west 105 feet, north 58 feet to beginning. (City Tract 194 -b) WHEREAS, the City of Yakima is the owner of the following describ- ed real property.situated in Yakima, Yakima County, Washington, to -wit: Beginning 27 feet east and 115 feet south of the northwest corner of-the Northeast 1/4 of the Northwest 114 of the Northeast 1/4 of Section 24, .Township 13 North , 'Range 19, -E. W. M._, thence east 105 feet, south 58 feet, west 105 feet, north 59 feet to beginning, (City Tract 194 -b) - according to the official plat thereof now on file and of-record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasurer of the City of Yakima, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for delinquent assessments,-and WHEREAS, it appears to be for the best interest of said City of Yakima to sell said premises to E. W. Tanner and Katherine fanner, husband and wife, upon the terms and p:onditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY -THE CITY COMMISSION OF THE CITY OF YAKIMA, WASHINGTON: That said above descirbed premises be and they-are hereby author- ized•to be sold to E. W. Tanner and Katherine Tanner, husband and wife, for the total sum of One'Hundred Fiftv and no/100($150-00) Dollars, payable as follows: the sum of Thirty and no /100 ($30.00) Dollars in cash upon the execution of the contract herein authorized and the balance of One Hundred Twenty and no /100 ($120.00) Dollars in monthly payments of Five and no /100 05.08) Dollars, beginning September l,'1944, and continuing until the entire amount.has been paid. All deferred payments to bear interest at the rate of six per cent per annum1payable monthly with principal payments. The purchaser under said'contract shall also agree to pay all assessments against said premises falling due under any Local Improvement District or -Districts hereafter created or ariging from levies hereafter placed against said premises, and the Mayor and City Cle:°k of said City are hereby authorized and directed to enter into a contract in duplicate with said purchaser under the terms hereinabove set Porth. Said agreement to be entered into shall also contain suitable pro- visions requiring any buildings upon said premises to be insured at the expense of the second parties in,a solvent insurance company satisfactory to first party as its in- terest may appear�&nd shall contain'a provision that in case.o'f destruction or or dam- - age to any building's or improvements on said premises such damage or. loss shall be the loss of second parties and shall not be ground 1br rescission of said contract; and said contract shall also contain a suitable provision providing for forfeiture thereof upon failure of second party to make any payment of principal, interest, taxes or assessments therein provided for when same-shall become.due or delinquent, notice of such forfeiture to be for 30.. days and service the.reof to be -by serving' same personally upon second parties or by mailing to them at Yakima, Washington, and a further.provision shall be 'placed therein that upon final.pa.yment of said principal and interest and taxes and assessments the first party shall convey said premises to second parties by a good and sufficient Quit Claim Deed conveying all the interest said-City of Yakima has now in __staid premises; and the further provision shall be contained in said contract against _ the assignment of second parties without the consent of first party had and obtained. -. _. C -635, A RESOLUTION authorizing the Cale of Lot 18; Block 45, Tennant and Miles' New Modern Addition to North Yakima (now Yakima). WHEREAS, the City of Yakima is the owner of the following de- scribed real property situated in Yakima County, State of Washington, to -wit: Lot 18, Block 45, Tennant & Miles'.New Modern Addition to North Yakima (now Yakima), according to the official plat thereof now on file.and of record in the office of the Auditor of Yakima County, Washington, by reason of a deed therefor issued by the Treasurer of Yakima.County, County of Yakima, State of Washington, to said City of Yakima, on sale of said property for real estate taxes, and WHEREAS, it appears to be for the best interest of said City of Yakima to -sell said premises 1:o Oscar W. Lee and Alta M. Lee, husband and wife, NOW, THEREFORE, BE IT RES -OLVED BY CITY COMMISSION OF THE ;.OLHE CITY OF YAKIMA, WASHINGTON: That said hbove described premises.be and they are hereby author- ized to be sold to Oscar W. C -636, A RESOLUTION providing for the loan of a sum of money from the Cemetery Trust Fund to the Cumulative Reserve Fund for Municipal purposes; providing for the rate,of interest for said loan and the repayment thereof. WHEREAS, the City of Yakima has heretofore, by Ordinance No. B -60 created a "Cumulative Reserve Fund for Municipal Purposes" pursuant to Chapter 60,,.laws of 1941 of the State of Washington, for the purpose, among other things, of providing for the accumulation of funds -for the construction of a new;City Hall and the acquisi- tion of a new building site, and WHEREAS, the City of Yakima has located abd arranged for the purchase of six lots of property located on North Second Street, to -wit, Lots 17, 18, 19, 20, 21 and 22, in Block 49, original townsite of North Yakima (now Yakima)according to the official .plat thereof now on file and of record in the office of the Auditor of .Yakima County, Washington, which purchase requires • the -payment of the purchase price in cash, and r WHEREAS, there is not sufficient funds accumulated in said -- "Cumulative Reserve Fund for Municipal Purposes ", but said fund has source of revenue from other sources to enableit to repay a loan in the amount hereinafter authorized, - end - 1. WHEREAS, the Cemetery Trust Fund ha.s surplus funds which are available for, and. in need of investment, and.the City Commission deems it to be'for the best interest of the City of Yakima that said Cemetery-Trust Fund make the loan hereinafter provided for: NOW, THEREFORE, BE IT.RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA, that the Cemetery Trust Fund transfer and loan to the 10Cumulative Reserve Fund for Municipal Purposes. ", the.sum of Thirty -three Thousand Eight hundred dollars ($33;900.00 said_loan,to draw interest at the rate of two per cent per annum, payable annually, and said.loan to be repayable as funds are available for the repay- ment thereof in said "Cumulative Reserve Fund for Municipal Purposes1D. BE IT FURTHER RESOLVED that the City of Yakima does hereby bind and obligate itself.to include in its budget each year a sum of money f orjsaid "Cumulative Reserve Fund for Municipal Purposes ".for the purpose of repaying said loan as rapidly as possible and for the.lpayment of interest thereon as.the same becomes due. _- BE IT FURTHER RESOLVED that the'City.Treasurer make the necessary transfer from the Cemetery Trust.
