PEARL BENJAMIN ADJOURNED MEETING, FRIDAY,,MAY 26th, 1944., City Clerk The City Commission met in regular. session, Mayor Mogren and Commissioners White and Clark present on roll call. Moved by Mo ren, seconded by White that the minutes of the regular meeting of Monday, May 15, 194+ be approved as read: carried., Mogren, White and Clark voting aye on roll call. Moved. by Clark, seconded. by White that Monday, May 22nd., 1944, being the time for the hearing on Resolution No. 0=619, providing for a five foot sidewalk on the west side of Queen Ave., between Division Street and. Haynes Street; and the City Commission being advised that no protests were presented in writing or otherwise to said improvement or any part thereof; it is ordered that the ordinance creating a local improvement distric be passed as finally read: carried, Mogren, White and Clark voting aye on roll call. ORDINANCE NO. entitled "AN ORDINANCE providing for the improvement of the West side of Queen Avenue between Division street and Haynes Street, by the construction of a portland cement concrete sidewalk five feet in width; establishing a, local improve- ment,district; providing for the method of payment therefor, and creating a ipecial fund, wa.s intoduced by White and read by the City Clerk. Moved by Mogren, seconded by Clark that Ordinance No. B609 be passed to its second reading and read by title only: carried, Mogren, White and Clark voting aye on roll call. Moved by Mogren, seconded by Clark that Ordinance No. R -608 be passed to its third reading and read in full: carried; Mogren, White and Clark voting aye on roll call. Moved by White, seconded by Clark that the City Clerk is hereby authorized to give notice to contractors for the construction of a. Portland. B -609, entitled "AN ORDINANCE granting a non - exclusive franchise to Pacific Power & Light Company to occupy and use the streets, highways, bridges and public places of the City of Yakima with facilities for supplying electric service to the City, the inhabitants thereof, and others, for a term of 25 years, subject to Prior termination under certain conditions; subjecting such electric service at all times to regulation by public authority; requiring the Grantee to provide street lighting facilities as ma.y be renuired by the City; providing for payment to the City of compensation for the exercise of said franchise; granting the City the right to acquire the electric utility property and facilities of.the Grantee* within the City upon payment of compensation t6 be determined by agreement or arbitration, as provided in the ordinance, but reserving to the City the power to acquire such property and facilities by condemnation; a-nd. specifying other limitations, terms and conditions governing the exercise of said franchise," was introduced by Mogren and read by the City Clark. C -6201 A RESOLU'T'ION subiAitting Ordinance No. B -609 of the City of Yakima to,the electors of said City for their approval at a special election to be held on the 11th day of July, 1944; requesting the County Election Board to call, give notice of and hold such. special election in the City of Yakima on said date for the purpose of voting upon the approval of said ordinance, and specifying the form of ballot to be submitted to V-ie voters at said election. WHEREAS the City Commission of the City of Yakima ha.s dilly passed Ordinance No. B -609 of the City of Yakima entitled: "AN ORDINANCE granting a non - exclusive franchise to Pacific Power & Light Company to occupy and use the streets, highways, bridges and. public places of the City of Yakima with. facilities for supplying electric service to the City, the inhabitants thereof, and. others, for a. term of 25 ,years, subject to prior termination under certain conditions; subjecting such electric service at all times to regulation by public authority; requir- ing the Grantee to provide street lighting -facilities as may be required by the City; providing for payment to the City of compensation for the exercise of said franchise; granting the City the right to acquire the electric utility property and facilities of the Grantee within the City upon payment of com- pensation to be determined by agreement or arbitration, as pro- vided in the ord.inan,ce,•but reserving to the City the power to acquire ruch property and facilities by condemnation; and specifying other limitations, terms and conditions governing' the exercise of said franchise." WHEREAS Section 12 of said ordinance provides that the ordinance shall take effect upon its' being approved by a majority of the electors of the City of Yakima voting thereon at a. special. election to be held. on July 11, 1944; and WHEREAS the City Commission is of the opinion and hereby declares that an emergency exists requiring said ordinance to be submitted to and voted upon by the electors at a special election to be held upon said July 11, 1944, being the date of the direct primary election for the nomination of candidates for state and county offices to be voted for at the general election to be Leld November, 1944; -NOW, THEREFORE, be it resolved that said Ordinance No. B -609 be submitted to the electors of the City of Yakima for their approval at a special election to be held in said City on the 11th day of July, 1944; that the County Elec- tion Board of the County of Yakima be and hereby is requested. to call, give notice of and hold such special election in the City of Yakima on said 11th day of July, 1944, for the purpose of voting upon the approval of said Ordinance No. B -609; that the bal- lot title or proposition to be submitted to the voters at such election shall be in the form of the following question: Shall Ordinance No. B -609, granting non- exclusive franchise to Pacific Power & Light Company for electric service facilities, and providing for regulation by public authority, street lighting compensation to City, and City's acquisition of electric property by agreement, arbitration, or condemnation, all upon terms, limi- tations, and conditions specified in ordinance, be approved? that the form of ballot to be used at such special election on the on the 11th day of July, 1944, shall be substantially in the following form: BALLOT _ SPECIAL ELECTION Held in the City of .Ya.kima, Washington, on Tuesday, July 11, 1944 Y �t Mav _2 :6, 1g44 INSTRUCTIONS TO VOTERS. Every voter desiring to vote in favor of the.fol_lowing proposition shall mark an X in the square between the word 11Yes'o, and-the words, "for the ordinance "; and every voter desiring to vote against said proposition shall 'nark an X in the square between the word "No" and the words "against the ordinance ". PROPOSITION Shall Ordinance No. B -609, granting non - exclusive franchise to Pacific Power & Light Company for electric service facilities, and providing for regulation by public authority, street lighting, compensation'to City, and City's acquisition of electric property by agreement, arbitration,-or condemnation, all upon terms, 11 mi- tations,' and conditions specified in ordinance, be approved? Yes for the ordinance No ` % against the ordinance and that said County Election-Board be and is hereby requested to give notice of such election in all respects as required by law and to dola.nd perform any and all other. acts and things necessary for the holding of such election and the canvassing of the result thereof as provided by law; and BE IT FURTHER, RESOLVED that the City Clerk of the City of Yakima be and hereby is directed to certify a copy of this resolution to the - County Election Board forthwith.
