Moved by Riley, seconded by Washburn that the minutes of the regular meeting of Mon- day, November 25th, 1940 and adjourned meeting thereof be approved as read: carried, Riley, Washburn and Clark voting aye on roll call. Moved by Washburn, seconded by Riley that the following payrolls be allowed and the` City Clerk authorized to issue warrants as follows: L.I.D. Revolving.$245.$7; Irriga- tion $92.40 and Water $743.80: carried, Riley, Washburn and Clark voting aye on roll call. Mnvecl by Washburn, seconded by Clark that time do now adjourn to Wednesday, December 4th, 19140 at 9 o'clock A. M: carried, Riley, Washburn and Clark voting aye on roll call. ADJOURNED MEETING, WEDNESDAY, DECEMBER 4, 1940, 9 A. M. The City Commission met pursuant to adjournment, Mayor Riley and Commissioners Wash- burn and Clark present on roll call. RESOLUTION NO. C -487, A RESOLUTION authorizing the expenditure of an additional sum of money for the improvement of certain streets in the City of Yakima. WHEREAS, due to an increase in the cost of the base, the total cost of City Street Project No. 25 amounted to $7553.04 instead of $5575.42 as shown in Resolution No. C -463. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the expenditure of an additional sum of $1977.62 be and the same is hereby authorized under the provisions of Chapter 187 of the Laws of 1937• PASSED by the City Commission of the City of Yakima, Washington, this 4th day of December, 1940. RESOLUTION NO. 0-488, BE IT RESOLVED-BY THE CITY OF YAKIMA, WASHINGTON: That it is its intention to imr_,rove the following streets by the construction of concrete curbs and gutters: The north side of West Chestnut Street from Grandview Avenue to Glenn Drive; the south side of West Chestnut Street from 34th Avenue South to Glenn Drive; the west side of Grand- view Avenue from West Chestnut Street to a point 104.6 feet south of West Yakima Avenue; and Hillcrest Avenue from West Chestnut Street to the south line of Burrows Suburban Tracts. The district to be assessed is as follows: Beginning at the intersection of Grandview Avenue and West Chestnut Street; thence westerly along West Chestnut Street to 34th Avenue South; thence southerly along 34th Avenue South to the south line of the north half of the East Half of the NWI SE-1. SE$ of Section 22, Township 13 North, Range 18 E.W.M., thence westerly along said south line extended to the southeast corner of Lot 5 Martin's Addition;. thence southerly and parallel with Hillcrest Avenue to the south line of Martin's Addition; thence westerly to the southwest corner of Lot 1 Burrows Suburban Tracts; thence northerly along the west line of said addition to the southeast corner of Lot 3 of Sickenga Addition; thence westerly along the south line of said Lot 3 to Glenn Drive; thence nor- therly along Glenn Drive to the north line of Lot 3 of Gould's Acre Tracts; thence easterly along said north line extended to Hill- crest Avenue; thence southerly to a point due west of the north- west corner of Lot 1 Orchard Drive Addition; thence easterly to the northeast corner of Lot 10 of said Addition; thence northerly to the south line of Ext. West Yakima Avenue Addition; thence easterly along said south line to Grandview Avenue; thence sou- therly along Grandview Avenue to the point of beginning. Said im -orovement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improve - ment are hereby notified to appear and present such objection, if any, at a meeting of the city commission to be held at its office in the City Hall in the City of Yaki- ma, Yakima County, Washington, at the hour of ten o'clock A. M., on Monday, the 30th day of December, 1940, which time and place are hereby fixed for the hearing if all matters related to said proposed improvement or objections thereto,.and for determin- ing the method of payment therefor; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement shall be distributed as follows: The labor and a portion of the materials shall be furnished by the Works Projects Administration, and the balance thereof shall be borne by and assessed against I 71 F, 72 December 2, 1940 all of the property legally an6 properly assessable therefor, as provided by law and as above described; and the City Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other information required by law to be by him submitted. B -490, entitled, "AN ORDINANCE fixing the time of delinquency of install- ments of assessments levied for,the payment of the cost of the improvement in Local Improvement District No. 564,' and providing for the issuance of bonds with coupons at- tached for the payment of the unpaid portion thereof ", was introduced by Clark and read by the City Clerk. Hickey, and wife, in the sum of $10,500.00 for damages alleged to have been sustained by reason of-Dorothy Hickey falling into the ditch in front of 106 North Second Street o,n the 11th day of October is hereby denied: carried,Riley, Washburn and Clark voting aye on roll call. Moved_ by Clark, seconded by Washburn that the claim of Rov Derby in the sum of $7500.00 for damages alleged to have been sustained by reason of falling over a water meter and shut -off pipe in front of 111 South Fourth Street on or about, the 1st day of December, 1940 be denied: carried, Riley,, Washburn and Clark voting aye on roll call.
