CITY OF YAKIMA, WASHINGTON
BUSINESS MEETING OF THE CITY COUNCIL
MARCH 19, 2002 - 2:00 P.M.
COUNCIL CHAMBERS - CITY HALL
1. ROLL CALL
Present:
Council: Mayor Mary Place, presiding, Council Members Clarence Barnett,
Lynn Buchanan, Paul George, Larry Mattson, John Puccinelli, and
Bernard Sims
Staff: City Manager Zais, City Attorney Paolella and City Clerk Roberts
2. INVOCATION /PLEDGE OF ALLEGIANCE
An invocation was given by Council Member Puccinelli; followed by the Pledge of
Allegiance led by Council Member Mattson.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS / SPECIAL RECOGNITION
Paul George read a proclamation declaring March 19, 2002 as Mule Deer Awareness
Day. George Justice accepted the proclamation.
B. REVIEW OF NATIONAL LEAGUE OF CITIES CONFERENCE
Mayor Place described activities and meetings attended while at the National League
of Cities Conference in Washington D.C. She said she attended meetings on
transportation, racial profiling, telecommunications, and also met with Representative
Hastings and his advisors, Senator Murray, and Senator Cantwell. They attended
meetings with the Environmental Protection Agency, and the National Oceanic and
Atmospheric Administration (NOAA). They met with HUD to discuss our 108 -loan and
grant and Yakima's new designation as a renewal community. There were meetings
with the Department of Energy and Bob Card, the Undersecretary of Energy. It was an
extremely busy time and they were able to attend many meetings because of the
number of representatives that made the trip. They are hopeful that Yakima will
receive resources based on the contacts made during this conference.
B. STATUS REPORT ON PRIOR MEETING'S CITIZEN SERVICE REQUESTS
Although there was a request at the last meeting regarding a road paving project in the
newly annexed area, there is currently no response. The Superior Court opinion on
annexations has put responding to this request on hold until there is further information
on the impact of the annexation decision.

4. CONSENT AGENDA
Mayor Place referred to the items placed on the Consent Agenda, questioning
whether there were any additions or deletions from either Council members or
citizens present. By consensus, Item No. 13D was removed from the agenda.
The City Clerk read the Consent Agenda items including resolutions and
• ordinances by title. SIMS MOVED AND BUCHANAN SECONDED TO ADOPT
THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call
vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the
Consent Agenda handled under one motion without further discussion.)
*A. APPROVAL OF MINUTES OF THE MARCH 5, 2002 ADJOURNED AND
BUSINESS MEETINGS .
The minutes of the March 5, 2002 Adjourned and Business meetings were
approved, having been duly certified accurate by two Council members and no
one present wishing to have said minutes read publicly.
5. AUDIENCE PARTICIPATION
Jerry Maggard, 107 South 7 Avenue, expressed concern about how decisions are
being made for the City and doesn't feel public participation is encouraged. With
regard to the parking around the Capitol Theatre, he is afraid decisions have already
been made. He would like the opportunity to be involved and to give his input to help
solve the problem. Council Member Buchanan clarified that there are two separate
issues, the Capitol Theatre expansion and security at the Federal Court House.
During discussion it was noted that the Capitol Theatre Board and the Department of
Justice, not the City of Yakima, are making the proposals. Glenn Rice, Assistant City
Manager, explained that part of the reason we haven't gone further in the planning
process is the federal government needs to decide what else it may need to do for
security and in what time frame. He agreed that Mr. Maggard and the neighbors have
a right to know what is going on in their neighborhood and will be sure to include him
and the other property owners in future meetings. Mr. Rice assured Mr. Maggard that
there would be plenty of time to discuss these items. City Manager Zais explained that
all citizens and constituent groups have the right of access to the leaders of the city on
a project and how that will continue because we are interested and want to know what
people are thinking. But, these meetings do not mean the project is being launched
into a public process yet.
Lynne Kittelson, 305 North 9 Street, agreed with Mr. Maggard that businesses and
residents should to be involved with decisions that affect them. She stated that her
neighborhood should be part of the discussion on the railroad grade separation since it
would impact the traffic in her neighborhood. She also sited several traffic problems in
her neighborhood that are not being addressed.

*6. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH YAKIMA VALLEY CONFERENCE OF GOVERNMENTS FOR
PROFESSIONAL GMA SERVICES
RESOLUTION NO. R- 2002 -23, A RESOLUTION authorizing and directing the City
Manager to execute a technical planning services agreement with the Yakima Valley
Conference of Governments for planning services related to the update of the GMA
Comprehensive Plan.
*7. CONSIDERATION OF RESOLUTION APPROVING GRANT REQUEST FROM THE
GREATER YAKIMA CHAMBER OF COMMERCE TO ASSIST WITH JOB FAIR 2002
EXPENSES
RESOLUTION NO. R- 2002 -24, A RESOLUTION approving a $5,000 grant request
from the Greater Yakima Chamber of Commerce, Worksource Yakima, and the
Workforce Development Council to be made from federal CDBG funds to assist with
the costs of renting the Yakima Convention Center and associated costs pertaining to
"Job Fair 2002."
*8. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF TROLLEY
CAR LEASE EXTENSION AGREEMENT WITH THE CITY OF ISSAQUAH
RESOLUTION NO. R- 2002 -25, A RESOLUTION authorizing and directing the City
Manager of the City of Yakima to execute an extension of a trolley car lease
agreement (City Contract # 2000 -79) between the City of Yakima and the City of
Issaquah.
*9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT
WITH KITTELSON ENGINEERING FOR DESIGN REVIEW OF ROUNDABOUT AT
FRUITVALE BLVD. AND NORTH 5 AVENUE
RESOLUTION NO. R- 2002 -26, A RESOLUTION authorizing and directing the City
Manager to execute a professional services agreement between the City of Yakima
and Kittelson Engineering for the purpose of evaluation of engineering design of
roundabout construction at North Fifth Avenue and Fruitvale Boulevard.
ORDINANCES
*10. CONSIDERATION OF ORDINANCE REQUIRING PROOF OF RABIES
VACCINATION
ORDINANCE NO. 2002 -11, AN ORDINANCE relating to Public Safety and Morals;
requiring proof of a rabies vaccine for all dogs in the City of Yakima, and amending
section 6.22.030 of the City of Yakima Municipal Code.

*11. CONSIDERATION OF ORDINANCE AMENDING THE MUNICIPAL CODE TO
PROHIBIT ON- STREET PARKING ON WALNUT STREET BETWEEN SOUTH 1
AND 3 STREETS AND ON THE EAST SIDE OF SOUTH 3 STREET AND THE
NORTH SIDE OF CHESTNUT STREET ADJACENT TO FEDERAL COURTHOUSE
ORDINANCE NO. 2002 -12, AN ORDINANCE relating to traffic; prohibiting parking on
the east side of South 3rd Street and the north side of East Chestnut Street adjacent to
the Federal Court House, and prohibiting parking on both sides of East Walnut Street
from South 1 Street to a point one hundred sixty feet east of South 3` Street; and
amending Sections 9.48.565, 9.50.050 and 9.50.060 of the City of Yakima Municipal
Code.
*12. CONSIDERATION OF LEGISLATION REGARDING AFSCME TRANSIT
COLLECTIVE BARGAINING:
A. RESOLUTION AUTHORIZING EXECUTION OF COLLECTIVE BARGAINING
AGREEMENT
RESOLUTION NO. R- 2002 -27, A RESOLUTION authorizing and directing the City
Manager of Yakima to execute the 2002 -2003 collective bargaining agreement with the
Washington State Council of County and City Employees representing Local 1122
Uniformed Transit Employees of the American Federation of State, County and
Municipal Employees, AFL -CIO.
B. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION
PLAN FOR TRANSIT EMPLOYEES
ORDINANCE NO. 2002 -13, AN ORDINANCE relating to City personnel adopting a
classification and compensation plan for City employees to be effective April 21, 2002;
amending Subsections 2.20.100 A, 2.20.100 D, 2.20.110 A, 2.20.110 B, and
2.20.110 D, all of the City of Yakima Municipal Code.
C. FIRST READING OF ORDINANCE AMENDING THE 2002 BUDGET AND
APPROPRIATING FUNDS FOR AFSCME TRANSIT COLLECTIVE
BARGAINING SETTLEMENT
An Ordinance amending the 2002 budget and appropriating funds for the AFSCME
Transit Collective Bargaining settlement, was read by title only, and laid on the table
until April 2, 2002 for a second reading.
*13. CONSIDERATION OF AMENDMENTS TO THE 2002 BUDGET (NO ACTION REQUIRED
ON THE FIRST READINGS AT THIS MEETING; SECOND READING SCHEDULED 4/2/02):
A. SECOND READING OF ORDINANCE APPROPRIATING FUNDS FOR YEAR-
END 2001 ENCUMBRANCES
An Ordinance amending the 2002 budget and appropriating funds for year -end
2001 encumbrances, previously having been read by title only, was brought
before the Council for a second reading.

ORDINANCE NO. 2002 -14, AN ORDINANCE amending the 2002 budget for the City
of Yakima; and making appropriations for 2001 Year -End Encumbrances from
Unappropriated Fund Balances within various funds for expenditure during 2002.
B. SECOND READING OF ORDINANCE APPROPRIATING FUNDS FOR SOUND
SYSTEM AND OFFICE SPACE RENOVATIONS AT THE CAPITOL THEATRE
An Ordinance amending the 2002 budget and appropriating funds for sound
system and office space renovations at the Capitol Theatre, previously having
been read by title only, was brought before the Council for a second reading.
ORDINANCE NO. 2002 -15, AN ORDINANCE amending the 2002 budget for the City
of Yakima; and making appropriations of $87,500 within the 171 Capitol Theatre Fund
for expenditure during 2002 to overhaul the sound system and renovate office space.
C. FIRST READING OF ORDINANCE APPROPRIATING FUNDS FOR TRANSIT
SERVICES IN THE NEWLY ANNEXED AREAS
An Ordinance amending the 2002 budget and appropriating funds for transit services
in the newly annexed areas, was read by title only, and laid on the table until April 2,
2002 for a second reading.
D. FIRST READING OF ORDINANCE APPROPRIATING FUNDS FOR FIRE
SERVICE TO THE NEWLY ANNEXED AREAS
This item was removed from the agenda.
E. FIRST READING OF ORDINANCE APPROPRIATING FUNDS TO PURCHASE
YAKAMA NATION GRANT - FUNDED EMERGENCY COMMUNICATION
EQUIPMENT
An Ordinance amending the 2002 budget and appropriating funds to purchase
emergency communication equipment through a grant by the Yakama Nation
Community Contribution Fund was read by title only, and laid on the table until April 2,
2002 for a second reading.
14. OTHER BUSINESS
Council Member Mattson and Mayor Place gave an update on the new jail project.
The jail is proposed to be a 6 -story facility with 970 beds. It will be built up against the
sidewalk on B and Front Street and will have a skybridge between it and the existing
jail. The next meeting of the Jail Committee is March 28` and there has been talk of
an evening open house to bring some of the design plans to the public.
Mayor Place asked Council to endorse further discussions with the City of Union Gap,
West Valley Fire District, and East Valley Fire District about joint training, a hazmat
response team, a Duty Chief roster, and automatic aid being equitably provided in the
four jurisdictions. Deputy Chief Mayo responded to questions from Council. SIMS
MOVED AND PUCCINELLI SECONDED TO APPROVE CONTINUATION OF THIS
GROUP'S DISCUSSIONS. The motion carried by unanimous voice vote.

Council Member George asked City Manager Zais about continuing to provide
services to the new 40 and 72 Avenue annexation areas after last week's Supreme
Court decision. City Manager Zais clarified that the Supreme Court's Opinion is just an
opinion at this time. It is not an order or a mandate that invalidates the annexation.
We are legally obligated to provide services to those areas and will continue to do so
until a final determination from the court is issued in the form of a mandate or an order.
He said that citizens are paying taxes in those areas, e.g. sales taxes, utility taxes,
gambling taxes and the like, to the City of Yakima that are being applied directly to the
services that we are providing. The exception is fire service because under the state
statue the fire district is responsible for providing fire protection until the end of this
year. If the annexation is invalidated the taxes will be revoked and services will have
to be withdrawn unless another alternative annexation is considered for this area. The
expenses are not being subsidized by the voters of Yakima that are inside the previous
city limits; the annexed areas are paying their share.

ACQUISITION (ALLOW APPROXIMATELY 2 HOURS)
BUCHANAN MOVED AND MATTSON SECONDED TO ADJOURN TO EXECUTIVE
SESSION FOR APPROXIMATELY TWO HOURS TO DISCUSS PENDING
LITIGATION AND PROPERTY ACQUISITION, WITH ADJOURNMENT
THEREAFTER TO APRIL 2, 2002 AT 7:30 A.M. FOR A STUDY SESSION AT THE
POLICE /LEGAL CENTER FOR AN INFORMATION SYSTEMS TECHNOLOGY
PRESENTATION. The motion carried by unanimous voice vote.
16. ADJOURNMENT
