Mead Ave. Yakima, WA 98908 I have filed three complaints against the property at 1409 S. 80th Ave. Yakima, WA 98908. The first complaint on approximately June 1, 2011, the second on approximately July 12, 2011 and the third on August 30, 2011. For some unknown reason, that property was included in the Creekside Development neighborhood, houses that are accessible from Plath Ave. off of S. 80th Ave. Plath Ave. is the only ingress /egress from that neighborhood. The houses are all from seven to ten years of age and are very well maintained. The house at 1409 S. 80th Ave. goes from frontage on 80th Ave. all the way back to 79th Ave., the lot on which the mailboxes for the neighborhood are situated. The neighbor on the Northeast corner of 79th Ave. and Mead Ave. would go over to the back lot of 1409 S. 80th Ave. and spray Roundup on it monthly which_kept the weeds at bay. When they moved, nothing was done. I became so frustrated about the shabby way the lot looked that I worked on it, clearing the lot of weeds three times a season, placing the weeds in yard bags and placing the bags in the back yard of 1409 S. 80th Ave. My husband informed me that I had no right to trespass on someone else's property and alter it in any way or to put chemicals on it. He is also concerned as I have a back condition as a result of two back surgeries. About 2 -3 months ago, I wrote what I considered a civil note and taped it to the occupants of the house (no one was home). The resident called later and spoke to my husband and told him that I had offended his girlfriend. Nothing was done to correct the condition of the property. Approximately a month later, I took another note to the property and found a man in a truck in the driveway. I asked him if he lived in the house at 1409 S. 80th Ave. and he replied that he did. I handed him the envelope containing the note and without another word, I walked home. My telephone was ringing when I got home and it was the man I had handed the letter to. He was extremely angry (again, I took care to make the note civil), he swore at me and dropped a number of F- bombs on me over the phone. He informed me that this issue was up to . his landlord. At that point, I contacted the Code Enforcement Department at City and filed my first complaint. The code office sent a certified letter to the owners of the property; Travis and Terry Summer, to 1409 S. 80th Ave. The Summers' address is 13413 Tieton Dr. Yakima, WA 98908. The letter was returned "Unclaimed ". Another letter was sent to the Summers on July 15, 2011, again to 1409 S. 80th Ave. and again, no action was taken. I returned to the Code Enforcement Department on August 30, 2011, and filed another complaint. On September 4, 2011, we passed the lot in our car and saw the resident raking weeds. He had evidently taken a weed whacker and taken the weeds down and then raked. He also took out some dead pyramidals. The weeds are still there, they are approximately 1" to 3" high. The lot looks better, however I would like to see the lot completely cleared of weeds with river rock on fabric weed barrier on the surface of the ground. Behind the dead pyramidals, there is garbage; a Dish TV satellite, some kind of Coke machine and a few other objects. The front of the house had the same issue; dead weeds that were overgrown. The tenant had taken his weed whacker to that area much earlier. It looked better however the weeds are growing again. I do not mean to brag or boast, however I do put my effort where my mouth is. My volunteer activities include: *Volunteer coordinator, Tree Top Bicycle Racing Classic *Organizing committee member for 21 of 25 years for the Valley of the Sun Triathlon *Yakima County Juvenile Court: Truancy Boards *Yakima County Juvenile Court: Community Accountability Boards *Yakima River Canyon Marathon *Yakima County Humane Society *Grant writer, Yakima Valley Pet Rescue *Two Yakima School District Levy Committees *One Yakima School District Finance Committee *I take care of the Rose Garden and entry to the West Valley Community Park If I was supplied with the Roundup and given permission by the owners of 1409 S. 80th Ave., I would be more than willing to spray the back lot once a month. I believe you all think that this is a matter where I'm overreacting and beating a dead horse, however I challenge all of you, think how you would feel with a house like this in your neighborhood. The concern we received deals with the tall, weedy vegetation, dead arborvitaes, shredded vehicle canopy, and any other miscellaneous items on the subject property, that are a nuisance and could create a potential fire hazard. The subject property is identified as Yakima County Assessor parcel number 181329 -33428 (photographs attached). The City of Yakima Code Administration Division addresses weeds and or vegetative debris as a fire hazard starting April 1 of each year. We would very much appreciate an effort on your part to prevent fire fuel in the way of tall, weedy vegetation, and other vegetative debris from accumulating on the subject property. Please abate the nuisance violations located on the subject property by cutting overgrown grass and weeds to not more than three inches; remove the dead arborvitaes, shredded tarps over the vehicle frame, and any other miscellaneous items from the yard. Should the conditions remain after July = 1,'2 01=1, the city may take more formal action to have the matter resolved. Any person convicted of violating any provision or of failing to comply with any requirement of Title 11 YMC can be punished by a fine not to exceed $250.00 or by imprisonment in the city jail facility for not more than ninety (90) days or by both such fine and imprisonment. (Yakima Municipal Code 11.01.010.) Should these violations remain after a follow -up inspection on August116' 01, the City may inunediately move forward with proceedings to force abatement at your expense. A title search will be requested (typical cost is $324.60), a public hearing will be scheduled and the notice filed in the Yakima County Auditor Office (typical cost $64). The cost of the title search and filing fees, plus any cost incurred at the public hearing (administrative fees ranging from $200 to $1000, if the City of Yakima must abate the nuisance 'violations), contractor costs, and additional filing fees will be placed as a lien on the real property.
