Moved by Coonse, seconded by Hedges, that this being the time -for receiving bids for paving Blocks 32 and 52, the following were received; Block 32, R.A.Geary in the sum of- .�.•2644.63 and A.S.ffilson, $2882.87; Block 52, R.A.Geary, ?42503•.90. The bid of R.A.Geary on Block 32 for2644.h3 and Block 52 $42503.90 being the lo,r,iest and. best bids, said con- tracts were awarded. to him and. the Mayor and. B =103 6 , BF IT RESOLVED BY THE, CITY C OIUMI SSI ON OF TIM CITY OF YAKILIA , yIASH INGT ON : That it is the intention of the City Commission of the City of Yakima ,Vlashington, .to improve . the east side of South Fourth Street from Maple Street to a line 150 feet south of Beech Street, all in the City of Yakima,,7ashington, by. the construction of a one course Portland cement concrete sidewalk six feet. in width, excepting in frontodf Lotc:12, Block 96 where a concrete sidewalk has been heretofore constructed, and by doing all: such other - work as may be necessary in connection therewith, all in accordance with plans, profiles anc specifications therefor to be. prepared by the City Engineer and. filed with the City Clerk. All. persons who may desire to object to said. proposed improvement are hereby notified to-appear and present such objections-at a meeting of the City 'Commissi on to be held at its office in the City Office Building-in the City -of Yakima,Wasliington, at the hour of nine o'clock A.M. on I116nday, the 19th day of Septernber,1927, ;,vhich time and place are hereby fixed for the hearing of all matters relating to said.. proposed improvement, all objections thereto, and. for determining the method. of payment therefor, and. the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. UQ ;SOLUTION NO.B- 1037,'iYHEREAS, McHugh & Coluccio have addressed a communication to the Mayor and City Commissioners of the City of Yakima, `lashington, which said. communication is as follows: to -wit: "The undersigned, 11cHugh & Coluccio, Ino . , pursuant to paragraph six of the General Stipula- tions included in the Specifications and proposal for municipal water system -does hereby appeal to your Honorable body. from certain decisions and. conclusions of the -City Engineer relative to the work done under the contract covering Schedule B of the system which conclu- sions and decisions are. as follows: In the February,1927, estimate given to the contractors by the city engineer,-he failed. to give them an estimate for the material excavated., at station 776 plus 89 falling under the term of rock excavation as defined by Subdivision 26 of the specifications.being pages 7 and 8 thereof. The engineer alloyed 14 yards of r -oak 'excavation for boulders encountered`1btt. has declined to allow an additional 14 yards of rock excavation tivhich was done at -that station by contractors and. so computed by the contractor and. the engineer in charge of the work for the city. In his June estimate the engineer classified. t_,b.e rock excavation he claimed. t-he contractors had done to the date thereof which included. iri .the total all other estimates made t o date arid. gave a total classified of 1198 cubic yards of .rock excavation which- estimate was .short 773.61 cubic yard.s. Subsequently an error ,vas .r'ecogni ae.d. im the su i of .$181.17 cubic yards which has corrected in latter estimates, leaving,a shortage up to the time of said estimate in the sum of $592.54. This amount includes the foregoing paragraph. in the July estimate, the engineer classified 384.2 cubic yards as rock excavation between stations 727 plus 11 to 731 plus 90. The propex arioun' of rock excavation between these two stations is 1090.92 cubic yards, or a shortage.cxf 706.72 cubic yards. We-insist that the yardage of excavation as above set forth falls within the term of rock .excavation as defined in subdivision 26. The excavation was made in a type of formation that could not be readily loosened with pick and. ',shove 1 and would. require drilling and blastinE for its economical removal and, would. not include it ose.gravel. We ask that the decision of the engineer in making these estimates be modified and that a supplemeintal estimate be given u-s including the classification of rock excavation based upon the foregoing figures.
