The City Cormaission met in regular session, Mayor Dudley and. C'Coniiiissioners Hedges and
Coonse voting aye on roll call.
Moved. by Dud.ley,seconded. by Hedges,,that the minutes of the regular meeting of Monday,
January 3rd,1927-, be approved as read.; carried.,Dudley,Hedges and Coonse voting aye on roll
call.
Moved.. by Coonse, seconded by Dudle >-, that the Mayor and. City Clerk are hereby authorized.
to enter into a contract with Harry Boyer,Son and Company for constructing Secheule "D"
of the municipal Water System, and. the bond of said Harry Boyer,Son and Company in the
suc1 of $155,739.00 is hereby anpraved and said bond and contract placed. on file with the
City Dlerk;carried, Dudley,Hedges ar:d. Coonse voting aye on roll call.
Moved by Coonse, seconded. by Hed.�`ea, that the certified check of I +.E.Peterson contractor,
in 'the surn of $9,000.00 placed, on file wit h bid. on Schedule "D" of the Municipal Mater
System be returned. to.-said. Peterson;carried,Dudley,Hed.ges and Coonse voting aye on roll
call.
Moved by Hedges, seconded. by Dudley, that the following claims be allowed. and the City

Coonse voting aye on roll call.
Moved by Coonse, seconded by Hedges, that Harry Boyer,Son.and. Company is permitted. to sublet
to King Bros-Boiler Works a corporat ion of Portland., Oregon, contract as hereinafter set out
all in accordance with Section 29 of the general stipulations in - proposal and specific ations
of the Municipal eater System; it was further moved and. seconded that written permission to
sublet said. work be giv _,n innacco- rdance with Section 29 of General Stipulations; carried,
Dud.ley,Hed.ges and Coonse voting aye on roll call.
THIS AGRT'iTENT made and entered into this 20th day of December,1926, by and.
between King Brothers- Boiler Works, a corporation of Portland, Oregon, party of the first
part, and Harry Boyer, Son and Company, a co- partnership of Yakirna,'dias hington,_ party of the
second pa rt ,
WITNESSETH: Whereas, the party of the second part has entered. into a written
contract with the City of Yakima, Yakima Count y,Washington, to furnish all materials and.
labor in connection with the construction under Schedule D of the Municipal 111ater System,
City of Yakirna.,lilashington, according to the plans and specifications thereof, and. which said
plans and. specifications are made a part of this agreement; a.nd.
Whereas, the party of the second part has sublet to the party of the first part
the furnishing of material and labor for the installation of the pile and. the material for
the tank (built complete) ladders, all structural steel for regulating' tower including roof,
NOS77, THEREF01:2, in consideration of the payments to be made as hereafter pro -
vided the said, party of the first part does b-, these presents agree to furnish Arc - Welded
Steel Pipe, delivered. on site and welded in the ditch and tested out complete,includ.ing all
openings in the pipe as follows:
3702 lineal feet more or le.s,s of 24 inch 3/16 inch dipped and. wrapped. @ $3.15
per lineal foot.
2080 lineal feet more or less of 18 inch 3/16 inch dipped and. wrapped @ $2.�5
per lineal foot.
763 lineal feet more or less of 12 inch 3/16 inch d.i,,ped, and wrapped @ x$1.52
per lineal foot.

The party of the first part further agrees to install all valves in the main
pipe lines, valves to be furnished by the City of Yakima-delivered on the site.
Party of the first part further agrees to furnish the tank built complete and the
material fabricated for all ladders and all structural steel for the regulating tower*
including roof,party of the first part to do all riveting or arc-welding, all delivered on
the site and all to be furnished. in accordance with the plans and specifications'as herein -
before set fortL-I, at the agreed price of Eight Hundred and. ninety nine dollars ($£ 99.00 )
It is further agreed and understood that payments are to be made on monthly
esti-mates as provided for in said specificat.�'ons.
Tree party, of the first part further agrees to raise the tank into place, the
party of the second part to furnish the additional labor and equipment at their oven cost.
The party of the first part further agrees to pay its proportionate share of the
bond of the party of the second part, said proportionate share being one hundred and thirty,
eight.dollars ($138.00).
Time is of the essence of this agreei:ient and all labor is to 'be p'erfonried and
material to be furhished as in said specifications provided.
In case suit or action is instituted-.to enforce this contract or any part thereof
it is agreed by the parties hereto that the court allow to the prevailing party in such
suit or action a reasonable sum as attorneyos fees in addition to the taxable costs.
IN WITMSS WHERDOF, the parties hereto have hereunto set their hands the .day and
year first above written.
