RESOLUT ION- NO..B -850, '.: ETAS, a petition has been-filed. requesting the_.e.stablis-hne =nt of .a Local Improvement, District, for the .purpose of constructing. the 'necessary pipe_:. -hires and appurtenances, .,and acquiring .the- necessary water rights and rights of -way, in- _orde -r ,to supply various lots and tracts of land with water for irrigation and domestic purposes, which said Loe-al Improvement District-. is. to received its water supply through the pipe lines of Local Improvement District No. 308, and WHEREAS, it is deemed expedient by-the City Commi -ssion that a Local- Improvement District be formed for t'se purpose of constructing the necessary pipe lines and. appurtenance and acquiring the ne c-essary water rights and rights-of way in order to . supply :vario.us lots and tracts of land with -water-- for irrigation and domestic -purposes, NOVI Ti' +REBORE, BE -IT RESOLVED BY THE CITY C(MMUSSION OF Ti1E CITY OF YAKIIIIA, 71ASIIINGTON: . That the- City of Yakima intends and hereby declares -'its intention to. improve the following territory, to-wit: Beginning-at the intersection of Sixth Avenue North and Poplar Street, thence north along Sixth Avenue North to Pacific Power- and Light Company's wastetvay, thence easterly. along said. wasteway to a line parallel. with and 140 feet westerly .from the west line of First Avenue. North, thence southerly parallel with First Avenue North to the-north line of Cherry .Avenue Subdivision, thence east to the alley east of Third Avenue North, thence zouth.along -:said alley to Poplar Street,•thence west along-Poplar Street to the point of beginning, all in the City of Yakima,4`lashington. - This improvement is to.consist of the acquiring of the necessary water rights, ,easements and rights of way for pipe lines, and-the construction of lateral .pipe lines, as ,follows: A pipe. line in the alley-east of Third Avenue North from Poplar Street to the north line of . Cherry. Avenue Subdivision; A pipe line in the alley east of Fourth Avenue North from Poplar Street to the north line of Cherry, Avenue Subdivision: A. pipe. line beginning 40 feet south of south line of Poplar Street and extendinj thence north along a line 155 feet east of the east line of Fifth Avenue North.a,distance of 545 feet; Also a pipe line .beginning. 40 feet south of the south 'line of Poplar Street and extending thence north along.a line 140 feet east of the east line of Sixth Avenue North a distance of 545 feet; for furnishing water for irrigation. and domestic purposes to all of the property above described; all of said pipe lines are to be connected to and receive water through.-the main pipe lines of the General. Water System of-the City of Yakima, as provided by Ordinance No-A-594 of the Ordinances of the City of Yakima, passed.by- the City Commission, October 20,1921., and establishing Local Improvement District No. 308. All of the costs and expense of the construction and installation of said pipe lines and appurtenances, accuiring..and purcY!asing .easements and rights of way, engineering and advertising- ing-,. and.all other expenses incident thereto, -- shall.be _assessed against all of the property above .described, in the - manner provided by..law, and the new District herein provided- for, . in addition to the total costs of the proposed improvement; shall -pay. its proportionate share of the costs of said Gene.ral Water System by assessment against all of .the property above dscr.ibed, in .the.manner. provided bylaw. All persons who may desire to object to the proposed improvement are hereby notified to appear at a meeting of the City Commission .to be held -in the City Office Building in the-City of Yakima,Yakima County,T'ashington, at the hour of nine ' (9) o'clock A.M. on Monday, the;21st day of April, -1924, which time and place are - hereby fixed for the hearing of all matters relating to said proposed improvement, or objections. thereto, and for determining the method of payment therefor,and the City Clerk is hereby directed. to give notice of said .hearing, aml of - -the intention to ,make the aforesaid improvement: The costs-and expense of said improvement shall.be borne by and assessed against all of -the property legally and .properly assessible therefor, as provided by law,, sand the City Engineer is hereby directed to submit to the-City Commission, at or prior to the date fixed for said hearing, .all . of the date and other inrofmantion required by .law to be sub- mitted by him., ADOPTED by the City Commission this 1st day of April,1924.
