The City- Commission inet in regular session, Mayor- Rovig and Commissionersa Fraser and Marble voting aye on roll call. Moved by Rovig, seconded by Fraser, that the minutes of the regular meeting of Tuesday, *February 13th,1923, be approved as read; carried, Rovig,Fraser and Marble voting aye on roll call. Moved by Fraser, seconded by Marble, that claims on.the Current Zxpense, and Garbage Dispos Funds be allowed and the City Clerk authorized to issue, wdrrant•s therefor; carried, Rovig, Fraser and Marble - voting aye on roll call. Moved by Marble, seconded by Rovig, that 'the street payroll on the Current Expense Fund from February 5th to February 17th,1923, in -the sum of $586:56 and Cemetery Fund in the sum of $x;188.00 be allowed andrthe City Clerk authorized to issue warrants ,therefor; carried, Rovig,Fraser and Marble voting aye on roll call. Moved by Marble, seconded by Fraser, that the claim of F.M..Dixon, in the sum of $26.29 for damages alleged to have been sustained by reason of open se:v.er connection and the filling of gravel and other debris is hereby rejected; carried, Rovig,Fraser and Marble voting aye on roll call. Moved. ,by Rovig, seconded.by Fraser, that the bid of the Republic Publishing Company for doing the City printing for the ensuing year is hereby accepted; carried, Rovig,Fraser and Marble voting aye on roll call. Moved by Marble, seconded by Fraser, that this being the time and place for the continued hearing on Resolution No.B -824 to construct an irrigation system on Pacific Avenue et al, Sub- District No-4 and sufficient protests be presented by property owners, the establish-' ment of a Local Improvement District is hereby abandoned; carried,-Rovig,Fraser and Marble voting aye on roll call. Moved by Marble, seconded by Fraser, that this being the time and place for the continued hearing. on Res-olution..No.B -825 to construct a pavement on West 1Z.ple Streetet a1, and a sufficient number of property owners objecting thereto, it is hereby ordered that the establish ^'.meat of Local Improvement District be abandoned; carried, Rovig,Friser and Marble voting aye on roll call. RESOLUTION NO.B- 827,_,,' REAS, by Ordinance No;.4-594, creating and establishing Local Improve- ment District No. 3.08, providing for the construction of a general water system, it was provided that whenever it was deemed expedient by the City Comrrniss.ion.- to.install additional pike lines, laterals and service connections to deliver water to individual lots, tracts and parcels of land within the limits of said District, such other-Local Improvement Distric' would be established as might be deemed necessary and the cost and expense to be.incurred in furnishing and supplying such property with water for irrigation- and domestic uses would be paid bl,.T levying special assessments upon property within such district in the manner provided by law, and WHEREAS, it is now deemed expedient by the City Commmission that a Local Improvement District be formed for the purpose of constructing the necessary-pipe lines and appurtenance and acquiring necessary water rights and. rights of way in order to-supply various lots and tracts of land with water for irrigation and domestic purposes. NOW TI-Hr!jEFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE .CITY OF YAKIMA,1,VASHINGTON: That it is the intention of the City Commission to construct water mains.and laterals for the purpose of supplying water for irrigation and domestic uses to the property within the limits of the following described boundaries: Beginning at the intersection of Pacific Avenue and Fair Avenue, thence south along Fair Avenue to a line 466.7 feet north of Washington Street, thence test along said line to a line 436.7 feet tiniest of Fair Avenue, thence south along said line to Washington Street, thence west along Washington Street to the east line of Fairchild's Acre Tracts, thence sofAth along said east line to Central Avenue, thence east along Central Avenue to.the east line of Rhine's Fairview Addition, thence south along said--east line to Lenox Avenue, thence west along Lenox Avenue to the west line of Fairchild's Acre Tracts, thence north along said west line to `gshington Street, thence east along Washington Street to-South Naches Avenue thence north along South Naches Avenue to Pacific Avenue, thence east along Pacific Avenue to the point of beginning. This improvement is to consist of the acquiring of the necessary rights of way, dater and water rights for furnishing water for irrigation and .domestic purposes to all the property within the above described boundaries, and the construction of lateral pipe lines, connecting with the main pipe line of the General Mater System of the City. of Yakima, as provided for by Ordinance No.A -590 of the Ordinances of the City of Yakima, passed by the City Commission October 17th,1921, and establishing Local Improvement District No. 308, and extending thence southerly along the following described routes: Along the alley east of South Naches Avenue form Pacific Avenue.to Washington Street, thence southeasterly across Washington Street and south along S.outh.Sixth Street to a point 40 fee.t north of Lenox Avenue; along the alley east of South Sixth Street from Pacific Avenue to a point 35 feet north of Washington Street; along the alley east of South Seventh Street from Pacific Avenue to Central Avenue; thence west along Central Avenue-to South Seventh Street, thence south along South Seventh Street to a-point 40 feet north of Lenox Avenue to a poilit 35 feet north. of Washington Street; also a lateral pipe .lime be ginning on Central Avenue at the alley east of South Seventh Street and extending east along Central Avenue to South Eighth -Street thence south along South Eighth Street to a point.40.feet north of Lenox*Avenue;.together with galvanized iron pipe service connections extending from said lateral pipe lines to the marginal lines of each lot or tract of land within said district abutting upon either side of the lateral pipe lines herein provided for. February 19th,1923. All of the cost and expense of the construction and installation of said pipe lines and appurtenances,- acquiring and purchasing easements and rights of way, engineering, advertising and all othe_r.expenses.lincident. thereto shall be- assessed a.gainst.all of the property within the limits of the above described boundaries in the.manner provided by law. All persons who may desire to object to the proposed improvement are hereby notified to appear at a meeting of the City Commission to be held at the City Office,,Buildin in the City of Yakima,SUashington, at 9:00 A.M.., on 'Monday, the 12th day of Xa.rch,1923, which time and place are hereby fixed for the hearing-of all matters relating to said proposed improvement; all objections thereto and for determining the- method _ -of payment therefor, and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. The cost and expense of said improvement shall be borne by and assessed'against all of the property legally and properly assessible therefor as provided bsr law, and the City Engineer is hereby directed to submit to the City Commission- at or prior to the date, fixed herein for said hearing all of the data and other information required by law to be submitted by him. RESOLUTION NO.B -828, BE IT RESOLVED BY THE CITY C0,117ISSION OF THE CITY OF YAKII:IA, WASHINGTON: That it is its intention to improve `'jest Maple Street from Seventh Avenue South to Ninth Avenue South -', Division Street from Ninth Avenue South to Tyrelfth Avenue South by grading and paving the-same with either a one-course Portland cement concrete. pavement or a pavement having a bituminous concrete wearing surface and either a Portland cement concrete base, a black base., or a crushed rock base, or with a pavement having a bitulithic wearing .urface and either a Portland cement concrete base, a black base, or a crushed rock base; all of said -pavements to be 32 feet in width excepting on that part of Division Street between Eleventh Avenue South and Pleasant Avenue Y -There the paver:2ent is to consist of the widening of the existing pavement so as to give a 75 foot radius curve at the northwest corner of the intersection of Eleventh Avenue and Division Street, this improvement to include the construction-of concrete curbs alor. -g both sides of the pavement, together with the necessary culverts, pipes and drains for drainage and irrigation .purposes and concrete walks at street intersections and by doing all such other work as may be necessary in conned ion therewith, all in accordance with plans and specifications - prepared 'gy the.City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvement are hereby- notified to appear and present such objections at a meeting of the City Commission to be held at its offices in the City Office Building, in the City of Yakiraa,Washington, at the tour of nine ofclock A.M. on Monday the 12th day of March 1923, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement,.all objections thereto and for determining the method of payment therefor, and the City. Clerk is hereby directed to give due notice of said hearing and of the.intention to.make the aforesaid improvement. The cost and expense of said improvement shall be borne by and assessed against all of the property legally and properly assessi•ble therefor as provided by law, and the City Engineer is hereby directed to submit to the City Commission -at or prior to the date fixed herein for said hearing , all of the data and other information -required, by law to be submitted by him.
