The City Council met in regular session, Mayor Larson, Councilman Brazier, Brown, Lambert,
Lynch, Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman
Kurbitz being out of town, it was MOVED by Robinson, seconded by Lynch that Councilman Kurbitz
be excused from this meeting: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson
voting aye by voice vote. Kurbitz absent.:!
The Invocation was given by Councilman Brazier.
The minutes of the regular meeting of January 11, 1965 having been read and certified accurate
by two Councilmen and no one wishing to have the minutes read publicly, Mayor Larson declared
said minutes approved as recorded.
Petition No.330 as filed by A. R. Friedrich and Yakima Seventh Day Adventist Church requesting
rezone of property located at 11 & 15 North 11th Avenue, it was MOVED by Robinson, seconded by
Lynch that said petition be referred to the Planning Commission for study and recommendation:
carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz
absent.
MOVED by Lynch, seconded by Lambert that Ordinance No. 611 an Ordinance relating to regulations
regarding meter readings on irrigation water be passed as read: carried, Brazier, B_own, Lambert
Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent. Mr. David Hoge, repre-
senting the Water Department was present.
ORDINANCE NO. 611, AN ORDINANCE PROVIDING for an irrigation rate for domestic water used during
the irrigation season; specifying such irrigation rate; defining "irrigation season" ;
establishing discount rates for payment of domestic water service charges on or before the
date when due; amending Sections 7.68.252 and 7.68.267 of the City of Yakima Municipal Code.
This being the time fixed by the City Council for the meeting with the signers of the Notice
of Intention to commence annexation proceedings for property located South of Nob Hill and
West of 44th Avenue as filed by Chester S. Meyer and wife, and John G. Fairbrook and wife with
the City Clerk on January 5, 1965, and the initiating parties being present and indicating that
they would assume their share of the city's existing indebtedness, it was MOVED by Robinson,
seconded by Lynch that said annexation be accepted by the City of Yakima and that the area to
be annexed be required to assume its shape of the city's existing indebtedness; carried,
Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent.
Petition No. 331 having been filed with the City Clerk on January 18, 1965, by Chester S. Myer
and wife , and John G. Fairbrook and wife, praying for the annexation of certain property
located South of Nob Hill and West of 44th Avenue, it was MOVED by Lynch seconded by Lambert
that said petition be referred to the.City Manager and the Planning Commission for study and
reoommendation; carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye by
voice vote. Kurbitz absent.
Moved by Lambert, seconded by Brown that Ordinance No. 612 , An Ordinance correcting the legal
description as set forth in Ordinance No. 602 providing for the Kurbitz annexation be passed
as read; carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call.
Kurbitz absent.
ORDINANCE NO. 612, AN ORDINANCE, providing for the annexation by the City of Yakimaof certain
property contiguous to the City, and amending Section 1, of Ordinance No. 602, passed on Dec.
28, 1965, entitled 'An Ordinance providing for the annexation by the City of Yakima of certain
property contiguous to the city of Yakima and zoning the same as B -3, General Business Zone',
and declaring an emergency .
MOVED by Robinson, seconded by Lambert, that Ordinance No. 613 and Ordinance relating to
working hours, overtime and compensatory time for city employees be passed as read; carried,
Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent.

ORDINANCE NO. 613 , AN ORDINANCE relating to working hours and authorizing overtime pay and
compensatory time for certain employees of the City of Yakima, adding Section 2.22.040 as a
new section, and amending Section 2.40.100 both of the City of Yakima Municipal Code.
Moved by Lynch, seconded by Robinson that Resolution No. D -767, a resolution authorizing the
settlement of pending condemnation proceedings as to certain parcels of property on Lenox Avenue
be passed as read: carried, Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on
roll call. Kurbitz absent.
RESOLUTION NO. D -767, A RESOLUTION authorizing the settlement,-as to certain parcels, of
pending condemnation proceedings for the Lenox Avenue Street Improvement project.
MOVED by Lambert, seconded by Lynch, that Resolution No. D 768, a resolution authorizing
payment of $42.00 Mark L. Kranz in settlement of damage claim be passed as read; carried,
Brazier, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Kurbitz absent.

section of Fifth Avenue and Fruitvale Blvd. be passed as read; carried, Brazier, Brown, Lambert,
3larson, Lynch and Robinson voting aye on roll call. Kurbitz absent.

MOVED by'Robinson, seconded by Braz that February-15, 1965 be set as the time of hearing
by the City Council on the matter o .the rezone of real property located at 1302 S.16th
Avenue as petitioned by J. J. Bechtel, per petition No. 316 and that the City Clerk give
notice of such hearing as required by law; carried, Brazier, Brown, Lambert, Larson, Lynch,
and Robinson voting aye by voice vot. Kurbitz absent.

Under new business, Councilman Lynch asked about the traffic congestion at the intersection
of the Lenox Avenue Overpass and South First Street, and wondered if the lighting system was
coordinated properly to allow for the free flow of traffic and whether this problem was being
investigated. Public Works Director Mayo stated that they are aware of this problem, that
Mr. Ed Rumsey, Signal Supervisor, is trying to work the problem out. Mr. Mayo indicated that
the light system is adequate, but that the heavy snow fall has curtailed the use of 4 lanes
to 2 lanes and this is felt to be the contributing factor to the problem. He also informed
the council that approximately 10,000 cars a day are using the South First Street Overpass
route.
Manager Smith passed out copies of Public Works Director Mayo's summary of the 1962 Street
Bond Progam to the Council and pointed out the additional projects accomplished over abd
above the original plan„
MOVED by Robinson, seconded by Lambert that the City Manager be authorized to engage Ralph Korn
as an independent land appraiser for the purpose of Appraising certain parcels of property
to be acquired by the city in the Lenox Avenue condemnation, that the parcels to be appraised
are those which have not heretofore been appraised by Ben Lombard, and that the City Manager
be authorized to pay Ralph Korn his regular fee $100 per day for his service; carried, Brazier
Brown, Lambert, Larson, Lynch, and-,Robinson voting aye by voice vote. Kurbitz absent.
Mayor Larson appointed Councilman Lynch to represent the city council on the Chamber of Commerce
Committee for Highway 82 project.
There being no further business to come before the meeting, it was MOVED by Brazier, seconded
by Lynch that.we do now adjourn at the hour of 9:30 p.m.: carried, Brazier, Brown, Lambert,
Larson, Lynch and Robinson voting aye by voice vote. Kurbitz absent.
