JANUARY 11, 1965 The City Council met in regular session, Mayor Larson, Councilmen Brown, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Brazier being ill and Councilman :Kurbitz being out of town, it was MOVED by Lynch, seconded by Robinson that these Councilmen be excused from this meeting.. The invocation was given by Councilman Lambert. The minutes of the regular meeting of December 28, 1964 having been read and certified accurate b two Councilmen and no one wishing to have the minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the hearing on Resolution No. D -757 being a resolution of intention to improve certain properl-ly, fully described in said resolution, by the construction of pipe sewer and there being no protest in writing or otherwise to said improvement, it was MOVED by Lambert, seconded by Robinson that Ordinance No. 606 providing for said improvement and creating L.I.D. No. 933, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call Brazier �nd_.Kurbitz absent. Yakima Gospel Hall, Inc. filed application for trac and vacation of Ateasemeni-, in connection with their property. ORDINANCE NO. 606, AN ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. A Notice of Intention to Commence Annexation Proceedings having been filed with the �'ity Clerk on January 5, 1965 by Chester S. Meyer and others and none of the signers of said notice bang presen it was MOVED by Robinson, seconded by Lynch that January 18, 1965-- regular evening meeting of the City Council, be fixed as the time for a meeting with the initiating parties, namely Chester S. Meyer, Lillian Meyer, Mar Jean Fairbrook and John G. Fairbrook: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. Moved by Lynch, seconded by Lambert that Ordinance No. 607 declaring the buildings at 1009 South Naches Avenue to be a nuisance and requiring the abatement and removal of same within 30 days, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting ave by voice vote. Brazier and Kurbitz absent. City Attorney Andrews advised that he has on this date received a letter from Mrs. Lyons, the property owner and that he will be negotiating with her in regard to his earlier request for permission to burn debris and buildings. Building Inspector, Mc Coy and Fire Marshall Schoonover reported that the bui.lding3 are open to unauthorized entry and constitute a fire hazard. ORDINANCE NO. 6072 AN ORDINANCE declaring buildings at 1009 South Naches Avenue, within the City of Yakima, to be a nuisance; requiring the abatement and removal of the same; providing for serv- ing of Ordinance; and directing the City Attorney of the City of Yakima to commence an action for abatement of said nuisance, and declaring an emergency. An ordinance declaring the building at 1110 South Naches Avenue to be a nuisance and requiring the abatement and removal of same, having been read, it was MOVED by Lynch, seconded by Robinson that said ordinance be passed. Discussion with Mr. Chavers the father of the property owner, Gary W. Chavers, indicated that his son is in Walla Walla working, that he has only recently received titl to this property from an estate and that-he now has a contract with Crescent Builders to rebuild and repair the building on said property. The Building Inspector and Fire Marshall indicated that while the building is not open to'unauthorized entry it is a fire hazard.-and the building needs a foundation under it. All persons having been heard it was MOVED by Robinson, seconded by Lynch that this matter be continued to February 8, 1965. Moved by Brown, seconded by.Robinson that Ordinance No. 608 declaring the building at 916 South 6th Street to be a nuisance and requiring the abatement and removal of same within 30 days, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent. Mr. Henry R. Lense who holds the deed on said property, but who also has sold said property on contract-to a Mrs. Fry, indicated that he has done some work on the hous located on the front of the lot, namely putting in windows and that he has a renter for it when the work is completed. The Building Inspector and Fire Marshall indicated that this building has been open to unauthorized entry, that it constitutes a fire hazard, that it will take some $2500.Oi to put it in shape to meet with building standards of the City and that the building on the back of the lot is not hooked up to the sewer. ORDINANCE NO. 60$1 AN ORDINANCE declaring buildings at 916 South 6th Street, within the City of Yakima, to be a nuisance; requiring the abatement and removal of the same; providing for serving of Ordinance; and directing the City Attorney of the City of Yakima to commence an action for abatement of said nuisance, and declaring an emergency. Moved by Lambert, seconded by Brown that Ordinance No. 609 declaring a nuisance to exist at 1410 Swan Avenue and requiring the abatement and removal of same within 30 days, be passed as read: carried,. Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent. Mr. Paul R. Thompson, who at one time, was part owner of this property, was present and indicated that he no longer has any interest in the property, that it belongs to Mr. H. L. Dick who hives at 1409 Jerome and that he has two pieces of machinery stored in the building. He also explained that much of the material around the building is lumber and timbers used in Mr. Dicks contracting business. ORDINANCE NO. 609, AN ORDINANCE declaring a nuisance to exist at 1410 Swan Avenue, within the City of Yakima; requiring the abatement and removal of such nuisance; providing for service of. a copy of this Ordinance on the owner of such property; directing the City Attorney to commence an action to abate said nuisance; and declaring an emergency. Moved by Lambert, seconded by Brown that Ordinance No. 610 declaring a nuisance to exist at 1402 swan Avenue and requiring the abatement and removal of same within 30 days,be passed as read carried, Brown, Lambert, :Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent. Mr. Paul R. Thompson explained that he has been cleaning up his property but his job and the inclement weather has made it impossible to complete it. He also indicated that the cabins located on the west line of his property belongs to Mr. H. L. Moved by Robinson, seconded by Lambert that Resolution No. D -762 authorizing the execution of -a Lease. Agreement with_J. S. Jenkins and wife for the space in the Central Building at the Yakima Municipal Airport, be passed as read: carried, Brown, Lambert, Larson, Lynch and.Robinson voting aye on roll call. Brazier and Kurbitz absent. RESOLUTION NO. D =762, A RESOLUTION authorizing the City Manager and �i.ty Clerk of the City of Yakima to execute a. Lease Agreement with J. S. Jenkins and Betty May Jenkins, husb.ank and wife, for space in the Central building at the Yakima Municipal Airport. Moved by Lynch,.seconded by Brown that Resolution No. D -763 authorizing the payment of $369.76 to Richard C. Smith in payment of damage claim as now pending in Superior Court of the State of Washington, being Cause N6.47211, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent._ RESOLUTION NO. D =7631 A RESOLUTION authorizing the payment of $369.76 to Richard C. Smith as full settlement of a claim against the City of Yakima. Moved by ,Lambert, seconded by Brown that Resolution No.. D -764 authorizing payment of $171.66 to Ronald D. Zerr for damages sustained as a result of a break in a City Irrigation Pipeline in the basement of a residence located at 3003 Summitview Avenue, be passed as read: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye on:roll call. Brazier and Kurbitz absent. RESOLUTION NO.. D 764, A RESOLUTION authorizing the payment of $171.66 to Ronald D. Zerr. Moved by Robinson, seconded by Lynch that Resolution No. D -765 being a resolution of intention to create a local improvement district for the construction of sanitary sewers on North lst Street, andrfixing:- the:­.date of hearing on said: matter for the lst day of February, 1965, be passed as read: .carried,' Brown, Lambert., Larson, Lynch and Robinson voting aye on roll call. Brazier and Kurbitz absent. RESOLUTION NO. D -7652 A RESOLUTION of intention to create.a local improvement district. Moved by Lynch, seconded by Robinson. that Resolution No. D -766 ratifying and approving the hiring of snow removal equipment from independent contractors without calling for bids, be passed as read carried, Brown, Lambert, Larson, Lynch.and Robinson voting aye on roll call. Brazier and Kurbitz absent. RESOLUTION NO. D =7661 A RESOLUTION ratifying and approving the hiring of snow removal equipment without calling for bids, and authorizing the payment of rental for the same. Moved by Lynch, seconded by Lambert,that Petition No. 318 as filed by United Builders and others, Petition No. 320 as filed by W. E. Guthrie and others and Petition No. 325 as filed by Sparkman & Mc Lean and others, be approved as meeting the requirements of law /; that the City Manager and the Mayor be authorized to obtain waivers of meetings of Review Boards as authorized by law, in each instance; and that an order be prepared for each petition fixing January 25, 1965 as the time for public hearing by the City Council: carried, Brown, Lambert, Larson, Lynch and Robinson voting ay by voice vote. Moved by Robinson, seconded by Lynch that the report dated December 29, 1964 and submitted by Cornell, Howland, Hayes & Merryfield on the Sewage Treatment Plant Additions, be approved and that Progress estimate No. 8 in the amount of $52,431.54 be approved and payment of same be made to G. R. Leischner'- Construction Company, contractor :. carried,-Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. Gray and Osborne, Consulting Engineers for the Summitview Avenue project having submitted a report on said project together with Estimate No. 7, which is the final estimate and which reports $2500.00 withheld to cover claims and unfinished remedial work which the contractor has been un- able to complete due to the weather, it was MOVED by Lynch, seconded by Robinson that said report a dated December 28, 1964 be approved and the estimate therein set forth approved and payment author - ized. This matter was then discussed with Mr. Al De Atley, Jr., contractor who requested that the City hold his certified check in the amount of $1,500.00 to cover the unfinished remedial work and further requested that we allow their insurance adjusters to handle their claims and not with- hold payment as as been the policy. Further discussion then indicated that the additional $1000.00 withheld is for damages to City utility lines during construction and. that it has now been determined that the exact figure is $953.51 for said damages. It was the MOVED by Robinson, seconded by Lynch that the original motion to approve and pay be amended to retain $953.51 and that the certified check in the amount of $1500.00 be accepted and held until such time as the unfinished remedial work is completed, including the additional item of a manhole at 18th and Summitview as listed in a letter to the contractor dated January 8, 1965: carried, Brown, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier and Kurbitz absent. Mayor Larson then called for a voice vote on the original motion as amended and Brown, Lambert, Larson, Lynch and Robinson voted aye by voice vote. Brazier and Kurbitz absent.- Public Works.Director Mayo requesting authorization to have the Mayor sign affidavits on specific maps showing the revised Federal Aid Secondary Route through the City of Yakima as submitted by the State Highway Commission,-it was MOVED by Lynch, seconded by Lambert that said permission be granted: carried, Brown, :Lambert, Larson,. Lynch, and Robinson voting aye by voice vote. Brazier., and Kurbitz absent. Manager ,Smith requested approval of the Council on the matter of out of State travel for Sergeant Amos of the Police Department who is attending a two weeks training school in Gresham Oregon, said schooling starting on this date, January 11, 1965. He explained that this item was inadvert- ently overlooked at the December. 28th meeting and since there was no meeting of the Council on January 4, 1965, this is the first opportunity to seek approval. Also he estimated the cost of travel and expense at $275.00. Moved by Lynch, seconded by Lambert that.permission be granted foz this travel and schooling and that the expenses be paid: carried, Brown, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Brazier and Kurbitz absent.. Manager Smith also advised the City Council that Mr. C. L. Shelton has obtained a County Permit tc construct another nursing home adjacent to the city limits in the vicinity of Franklin and Engle- wood Avenue and in order to avoid similar problems to those experienced when Mr. Shelton built the Eden House at 40th and Tieton Drive, recommended that a letter be sent to Mr. Shelton immediately advising him that if he wishes to= connect to the City sewer system that it will be necessary for him to sign on Outside Agreement immediately (prior to any actual-construction) under which he would agree to construct the nursing home in accordance with all of the City Codes and purchase all of the City permits required and that the Outside Agreement be considered an interim measure and that the actual sewer connection be permitted only if the annexation be consummated. After discussion of this matter, it was MOVED by Robinson,' seconded b -j Brown that the City Manager be' and is hereby authorized to write said letter setting forth these requirements: carried, Brown, Lambert, Larson, Lynch, and Robinson voting aye by voice vote.
