An emergency was declared to exist on December 21, 1964 , due to a heavy snow fall and the
regular evening meeting of the City Council scheduled for 8 o *clock on that date was cancelled
The City Council met in regular session, Acting Mayor Brazier, Councilmen Brown, Kurbitz,
Lambert, Lynch and Robinson were present on roll call. It was MOVED by Robinson, seconded by
Lynch that.Mayor Larson be excused from this meeting: carried, Brazier, Brown, Kurbitz,
Lambert, Lynch and Robinson voting aye by voice vote. Larson absent.
Councilman Lynch gave the invocation.
The Minutes of the regular meeting of December 14, having been read and certified accurate
by two councilmen and :no one present wishing to have the minutes read publicly, Acting Mayor
Brazier declared said minutes approved as recorded.
Moved by Robinson, seconded by Lynch that Item 4a on the agenda, Frates rezone, beheld until
Mr. Velikanje, Attorney representing John Frates and others appeared at this meeting: carried,
Brazier, Brown, Kurbitz,'Lambert, Lynch, and Robinson voting aye by voice vote. Larson
absent.
This being the time for the hearing on Petition No. 313, praying for the annexation of
property located at the Northeast Corner of Fruitvale Blvd, and Wright Avenue as filed by
Albert Kurbitz, it was MOVED by Lambert, seconded by Robinson that Ordinance No. 602, pro-
viding for said annexation and zoning said property to B -3, General Business Zone, be passed
as read: carried, Brazier, Brown, Kurbitz, Lambert, Lynch, and Robinson voting aye on roll
call. Larson absent.
ORDINANCE NO. 602, AN ORDINANCE providing for the annexation by the City of Yakima of certain
property contiguous to the city of Yakima and zoning the same as B -3, General Business Zone.
This being the time set for the hearing on Petition No. 314 praying for the annexation of
property located West and adjacent to Edgerly Manor and South of the Congdon Canal, as filed
by Baker, Udell and ot'hers,,it was MOVED by Lambert, seconded by Kurbitz, that Ordinance No.
603 providing for said annexation and zoning of said property to R -1, One Family Zone;bxcept
for that portion described in Section 3 of said Ordinance to R -3 Multiple Family zone be
passed as read: carried, Brazier, Brown, Kurbitz, Lambert, Lynch, and Robinson voting aye on
roll call. Larson absent. Mr. Ernest Falk whose property is included in the annexation
was present at this meeting.
ORDINANCE NO. 603 , AN ORDINANCE providing for the annexation by the City of Yakima of
certain property contiguous to the city of.Yakima and zoning said property.
This being the time set for the hearing on Petition No. 299, as filed by John Frates and
others, requesting the rezone of property located at 414 South 30th Avenue, it was MOVED
by Kurbitz, seconded by Brazier that an ordinance rezoning said property from R -3, Multiple
Family Zone to B -1 Modified Business Zone be passed as read: In discussion, Fred Velikanje
Attorney representing John Frates and others stated that the parking arrangement for the
proposed clinic had been revised to meet the requirements of the city Ordinance and showed
the Council a plan of the new parking arrangement. Mr. Velikanje further stated that his
client is willing to place a restrictive covenant in the deed which would not allow any
other type of business; in the building. He asked the council to approve the rezone, stating
that it is desirable to have this clinic near the hospital. Planning Director Gast reiterates
the Planning Commission's reason for denying this rezone, stating that this was spot zoning
and it would set a precedent if approved. _ Rouncil indicated at this time that there is
a need for revising our zoning ordinances. Mr. Gast further stated that the proposed parking
plan as shown to the Council by Mr. Velikanje at this meeting is still not satisfactory as
some of the cars would still have to back into the streets and that the removal of the lawn
from both the front,of the property and in the court would detract from the appearance of
the property. After full discussion of the matter, Acting Mayor Brazier asked for a roll
call vote on the original motion: Brazier and Kurbitz voting aye; Brown, Lambert, Lynch,
and Robinson voting Nay: Motion lost for want of a majority vote. Larson absent.
It was MOVED by Robinson, seconded by Lynch, that Resolution No. D -758 affirming the recom-
mendation of the Planning Commission and denying a petition to rezone property at 414 South
30th Avenue, Yakima, Washington, from R -3, Multiple family Zone, to B -1, Modified Business
Zone, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye; Brazier
and Kurbitz voting Nay. Larson absent.
RESOLUTION NO. D -758 , A RESOLUTION affirming the recommendation of the Planning Commission
and denying a petition to rezone property at 414 South 30th Avenue, Yakima, Washington,
from R -3 Multiple Family Zone, to B -1 Modified Business Zone.
MOVED by Lynch, seconded by Lambert, that Ordinance No. 604 an'ordinance appropriating the
sum of $2,600.00 from the unappropriated monies in the City Garage Fund Account to Main-
tenance and operations classification for expenses incurred on account of snow removal
operations, said ordinance declaring a non - debatable emergency, be passed as read: carried,
Brazier, Brown, Kurbitz, Lambert, Lynch, and Robinson voting aye on roll call. Larson
absent.
ORDINANCE NO. 604, AN ORDINANCE appropriating the sum of $2,600.00 from the unappropriated
monies in the City Garage Fund to Account 7 -02, Part Time, Temporary, Overtime, and Special
Assignment , of the salaries and Wages classification, and to Account 7 -54, Automotive
Fuels, Lubricants and Parts, of the Maintenance and Operation classification, both of the
1964 appropriation for 34 -city Garage Fund; and declaring a non - debatable emergency.
MOVED by Robinson, seconded by Lynch that Ordinance.No. 605 An Ordinance authorizing a
temporary loan of money, not to exceed $10,(b0 from the Water Sewer Fund.to the.Street,Fund
and providing for the repaymentthereof, said ordinance declaring a non debatable emergency,
be passed as read: carried, Brazier, Brown, Lambert, Lynch and Robinson voting aye on roll
call: Kurbitz voting Nay, stating he was opposed to borrowing money from the water fund.
Larson absent.Manager Smith took this time to thank Public Works Director Mayo and the Street
Department for the excellent job they did in removing snow from City Streets. Mr. Mayo stated
that through Dec. 27, 1964 known cost for snow removal amounted to $14,713; and unknown costs
at this time were for rental of equipment. He stated all streets have been plowed once, all
arterials 3 times or more and that 2700 loads of snow have been hau163 from the C. B. D. He
also stated that removal of snow from the catch basins will be done as quickly as possible in
order to prevent flooding if a quick thaw should occur.,

ORDINANCE NO. 605, AN ORDINANCE authorizing a temporary loan of money, not to exceed $10,000.00
from 52 Water Sewer Fund, to 31 Street Fund, and providing for the repayment thereof; appropriatir
money, not to exceed $4,000 from unappropriated monies in 31 Street Fund, to Account 7 -02,
Part Time, Temporary, Overtime, and SpecT.a 1 Assignment, of the salaries and wages classification
and apropriating money, not to exceed $6,000 from unappropriated monies in 31 Street Fund, to
Account 7-31 , Rentals, of the Maintenance and Operation classification, both of the 1964
appropriation for 31 Street Fund; and declaring a non - debatable anergency.
Moved by Lynch, seconded by Lambert, that Resolution No. D -759 , a resolution authorizing payment
to Philip J. Christman and the American Insurance Companies, James A. Moore, Donald E. Ream and
H. G. Rempel in satisfaction of damage claims filed against the city of Yakima, be passed as read:
carried, Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson voting aye on roll call. Larson
absent.
RESOLUTION NO. D -759, A RESOLUTION authorizing payments to Philip J. Christman and the American
Insurance Companies, James A. Moore, Donald E. Ream and H. G. Rempel, in satisfaction of damage
claims filed against the City of Yakima.
Moved by Robinson , seconded by Lynch that Resolution No. D -760, a Resolution transferring the
sum of $3,000 with in the 1964 appropriation for Police Fund in order-to pay expenses of parts
and repair work for city police cars, be passed as read: carried, Brazier, Brown, Kurbitz;
Lambert, Lynch atad Robinson voting aye on roll call. Larson absent.
RESOLUTION NO. D -760, A RESOLUTION transferring the sum of $3,000 within the 1964 appropriation
for 21 Police °
Moved by Lambert, seconded by Robinson that Resolution No. D -761 , A Resolution transferring
the sum of $2000.00 within the 1964 appropriation for 39 Municipal Airport, in order to pay
expenses of snow removal at the Airport, be passed as read: carried, Brazier, Brown, Kurbitz,
Lambert, Lynch and Robinson voting aye on roll call. Larson absent.
RESOLUTION NO. D -761, A RESOLUTION transferring the sum of $2,000 within the 1964 appropriation
for 39 Municipal Airport.
The State Highway Commission reporting on, and billing the city of Yakima in the amount of
$75,602.90, in connection with South First Street project, it was MOVED by Robinson, seconded
by Lynch, that said report dated, November 18, 1964 be accepted and approved and the billing
therein set forth be accepted and payment of same authorized: carried, Brazier, Brown, Kurbitz,
Lambert, Lynch and Robinson voting aye by voice vote.- Larson absent.
Statewide Reitrement System having billed the City of Yakima in the amount of $3,430.88 for
Administrative Expense for the year 1964, it was MOVED by Robinson, seconded by Lambert, that sai
amount be deducted from the Released Matching Funds on deposit with said retirement system for
the city of Yakima: carried, Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson voting aye
by voice vote. Larson absent.
The City Engineer reporting the completion of L I D 909, South 38th and 40th Avenues and various
others streets, curb, gutter and surfacing district, it was MOVED by Robinson, seconded by Lamber
that the 25th 'day of January, 1966 be fixed as the date of hearing, on the assessment roll for sa
district and that the City Clerk give notice by publication and to each property owner in said
district as required by statute: carried, Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson
voting aye by voice vote. Larson absent.
City Manager Smith informed the Council-that the matter of Huza versus City of Yakima regarding t'
B & 0 Tax will come before the State Supreme Court on Friday, January 29, 1966.
Manager Smith also informed the Council that the meeting with legislators of the 14th and 15th
District is set for Wednesday, January 6, 1961r at a noon luncheon to be held'at the Turf.
There being no further business to come before the Council, it was MOVED by Kurbitz, seconded
by Brown that we do now adjourn at the hour of 4;45 p.m.; carried, Brazier, Brown,-Kurbitz,
Lambert, Lynch and Robinson voting by voice v9pe. Larson absent.
