HomeMy WebLinkAbout11/30/1964 Business Meeting609 NOVEMBER 30, 1964 I The City Council met in- regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. (Council - man to fill Mr. Munger's unexpired term not yet appointed) Councilman Lynch gave the invocation. The minutes of the regular meeting of November 23, 1964 having been read and certified accurate by two Councilmen and no one present wishing to have the minutes read publicly, Mayor Larson de- clared said minutes approved as recorded. Moved by Robinson, seconded by Lambert that the matter of appointing a Councilman to fill the un- expired term of Elliott N. Munger on the City Council and the matter of Gray and Osborne's estimate, items under new business and reports and written communications, be moved from their regular place on the agenda and be considered at this time: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Moved by Robinson., seconded by Lambert that Mr. Wray Brown be appointed to the City Council to fill the unexpired term of Elliott N. Munger, resigned: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and.Robinson voting aye by voice vote. Discussion indicated that time and place for administering the oath of office will be fixed for a later date by Manager Smith. Gray and Osborne, consulting-engineers, having submitted estimate No. 6, Semi -Final on the Summitview Avenue Avenue Project in the amount of ,$56,401.38 and recommending that same be paid to Superior Asphalt & Concrete Company, it was MOVED by Lynch, seconded by Robinson that Gray and Osborne's report dated November 27, 1964 be accepted and approved and that the progress estimate therein set forth be approved and payment of same authorized: carried, Brazier, Kurbitz, Lambert Larson, Lynch and Robinson voting aye by voice vote. A Resolution establishing the annual irrigation maintenance rates and charges for the year 1965, and providing for a surcharge in certain areas within the City having been continued from the November 23, 1964 meeting to this meeting, it was MOVED by Robinson, seconded by Lynch that Resolution No. D -574 providing for said surcharge and annual irrigation maintenance rates for the year of 1965, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, and Robinson voting aye on roll call. Councilman Lynch excused for the balance of the meeting and before the vote was cast on this motion. Discussion of this matter indicated that the surcharge is being placed on certain districts, not to replace any system, but to take care of maintenance and repairs already made in some instances and to meet any emergencies which may arise in the older districts and tha conceivably there could be an emergency of such nature that the existing irrigation system would have to be discontinued and domestic water used. It was also pointed out that the surplus now shown in the budget is credited to and belongs to certain irrigation districts and can not be used by any other district. Mrs. Hattie Foley, Miss Esther Schnick, Mrs. Rice and George Farns- worth protested the possibility of combining the irrigation ,cater with the domestic water system and indicated that they together with others in their districts would rather pay more into the maintenance fund with the idea that when emergencies arise permanent replacement is made, thus eventually replacing the whole system without ,a large capital outlay being made by the property owners at a given time. Manager Smith indicated that the staff is gathering more information and investigating certain legal aspects of the problem regarding the irrigation operation as a utility and that this is the reason the City Council had not made a decision as to a dual system versus a combined domestic water and irrigation system. RESOLUTION NO. D -7549 A RESOLUTION establishing the annual irrigation maintenance rates and charges for the *year 1965 and providing for a surcharge in certain areas within the City of Yakima. This being the time for the hearing on'Petition No. 294 praying for the annexation of property in the Tri -Skool Addition as filed by Lester 0. Beaver and others and,Manager Smith requesting that the City Council continue this hearing for one week since the Review Board has not been able to hold its hearing on said petition, it was MOVED by Robinson, seconded 'by Lambert that said hearing be continued until-the next regular meeting of the City Council on December 7,.1964-;, carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Lynch absent. This being the time fixed for the hearing on Petition No. 303, praying for the annexation of property between 9th Avenue and Cornell and South of Mead Avenue and Pierce Avenue, as filed by Thecla Regeimbal, it was MOVED by Lambert, seconded by Brazier that Ordinance No. 593 providing for said annexation and zoning said property as R -2, Two Family Zone, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, and Robinson voting aye on roll call. Lynch absent. No one present protested the passage of this ordinance at this time and the Council proceded to con- sider and refer certain new petitions on the agenda for this date, after which time Mrs. Ranton made known that there were persons present who wished to protest this annexation. It was then MOVED by Kurbitz,, seconded by Robinson that this matter be reconsidered: carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Lynch absent. Mrs. Evelyn Smith and Mrs. Dorsette protested the inclusion of vacant lots owned by them and not including the'• property on which their homes are located. They also stated that they were not contacted when the petition was circulated. Mr. Lockbeam spoke for the annexation indicating that he needs city services, namely sewer. Mrs. Ranton protested this annexation in view of the fact that a larger area had voted against annexation earlier in this year. Council members pointed out to her that she does not live in the area described in and annexed by this petition and ordinance and that 760 of the property owners in the area have signed said petition indicating their desire to be annexed. All persons having been heard both for and against this matter, :'Mayor Larson _ asked that Council members again vote on the Motion to pass Ordinance No. 593 which provides for said annexation and Brazier, Kurbitz, Lambert, Larson and Robinson voted aye on roll call. Lynch absent. Motion again carriedg Petition No. 320 having been filed with the City Clerk on November 23, 1964 by W. E. Guthrie and others praying for the annexation of certain propErty fully described in said petition and located South of King Street between 16th and 18th Avenues, it was MOVEDby Robinson, seconded by Lambert that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Lynch absent. Petition No. 321 having been filed with the City Clerk on November 24, 1964 by Yakima.Gospel Hall Inc., W. E. Guthrie Chairman, requesting the formation of a local improvement district for the construction of Water Mains, it-was MOVED by Robinson, seconded by Lambert that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, and Robinson voting aye by voice vote. Lynch absent. I r 610 NOVEMBER 30, 1964 Petition No. 322 having been filed with the City Clerk on November 24, 1964 by the Yakima Gospel Hall, Inc.; W. E. Guthrie Chairman, requesting the formation of a local improvement district in Bel Air Heights for the paving and construction of concrete curb and gutters, it was MOVED by Lambert, seconded by Robinson that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. Lynch absent. Moved by Lambert, seconded by Robinson that Ordinance No. 594 relating to retirement from the Yakima Police Department and relating to the accumulation of service credits toward such retire- ment and adding a section to the Yakima Municipal Code, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by roll call. Lynch absent. ORDINANCE NO. 594, AN ORDINANCE relating to retirement from the Yakima Police Department; author• izing the recovery, retention,'preservation and accumulation of service credits toward such re- tirement; and adding Section 1.57.020 as a new section of the City of Yakima Municipal Code. Moved by Robinson, seconded by Lambert that Resolution No. D -755 extending the time for repayment of a loan of $25,000.00 from the Cumulative Reserve for Domestic Water Supply Development Fund to the Municipal Airport Fund, be passed as read: carried, Brazier, Lambert, Larson and Robinson voting aye on roll call. Kurbitz voting no on roll call. Councilman Kurbitz indicated that he would prefer that this loan be paid back as soon as possible and that he did not think that the Water Fund named should be tapped in this manner. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier that we do now adjourn at the hour of 5:15 P.M carried, Brazier, Kurbitz, Lambert, Larson and Robinson voting aye by roll call.
