Councilman Brazier gave the invocation. The minutes of the regular meeting of November 2, 1964 having been read"and certified accurate with certain additions and corrections and no one present wishing to have the minutes read, Mayor Larson declared said minutes approved as recorded. Petition No. 311 having bESen filed November 4, 1964 by Jack Milton Lines requesting the rezone of property located at 924.South 16th Avenue, it was MOVED by Robinson, seconded by Munger that said petition be referred to the City Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Petition No. 312 having bE;en filed with the City Clerk on November 6, 1964 requesting the forma- tion of a local improvement district for the construction of sewers on Walnut Street to Tieton Drive and South 44th Avenue to South 45th Avenue, it was MOVED.by Munger, seconded by Robinson that said petition.-be referred to the City Manager and staff for study and recommendation: carry Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Petition No. 313 having bE:en filed with the City Clerk on November 9, 1964 by Albert B. Kurbitz praying for the annexation of certain property located North of Fruitvale Boulevard and East of Wright Avenue, it was MOVED by Brazier, seconded by Munger that said petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Petition No. 314 having been filed with the City Clerk on November 9, 1964 by William R. Baker and others praying for the annexation of certain property located South of Congdon Canal and West of Edgecliff Manor Subdivision, it was MOVED by-Brazier, seconded by Munger that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert,, Larson, Munger and Robinson voting aye by voice vote. Moved by Robinson, seconded by Lambert that Ordinance No. 585.relating to the operation of Tahoma Cemetery and prescribing rules and regulations and prescribing fees and charges for cemetery property and services and amending the Yakima Municiipal Code, be passed as read: carried, Brazier, Kurbitz, Lambert,, Larson, Munger and Robinson voting aye on roll call. Lynch absent. ORDINANCE NO. 585, AN ORDINANCE relating to the operation of Tahoma Cemetery; prescribing rules and regulations applicablE� thereto;'specifying a schedule of fees and charges for Cemetery propert and services; amending Section 7.04.090 of the City of Yakima Municipal Code and repealing Section 7.04.100 and Section 3.04..0$0 of the City of Yakima Municipal Code. Moved by.Munger, seconded by Lambrt that Ordinance No. 586 relating to traffic regulations and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Lambert, Larson, Munger,:( and Robinson voting aye on roll call. Discussion indicated that this ordinance added certain parking restrictions on Summitview Avenue and Lenox Avenue and provides for one way traffic in the north -south direction of the tee alley between lst Street and 2nd Street and Yakima Avenue and Chestnut Street as requested by M. J. Herberg and others on Petition No. 276 as filed June 24, 196;. ORDINANCE NO.. 586) AN ORDINANCE relating to traffic regulations; regulating and restricting the stopping, standing and parking of motor vehicles; designating certain streets and alleys for one - way traffic; and amending Section 9.36.070 and Section 9.28.230 of the City of Yakima Municipal Code. Moved by Lambert, seconded by Robinson that Ordinance No. 587 fixing the time of delinquency of i stallments and prescribing; the issuance of installment notes for the payment of the unpaid portio of L.I.D. No. 912, Cliff Plat and others Domestic Water, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye on roll call. Lynch absent. ORDINANCE1NO. 5$7, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 912, and providing for the issuanCES of Local Improvement District Installment Notes for the payment of the unvpaid portion thereof. Moved by Munger, seconded by Lambert that Ordinance No. 5$$ fixing the time of delinquency of in- stallments and prescribing; the issuance of installment notes for the payment of the unpaid portion of L.I.D.,No. 914, South !�lst Avenue Domestic Water District„ be passed as read: carried, Brazier Kurbitz, Lambert, Larson,, Munger and Robinson voting aye on roll call. ORDINANCE NO. 5$$, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 914, and providing for the issuancE: of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. Moved by Robinson, seconded by Lambert that Resolution No. D -748 requesting Planning Assistance from the State Department of Commerce and Economic Development and authorizing the City Manager to carry out a Planning Program for the Central Business District of the City of Yakima, be passed as read: carried, Lambert, Larson, Munger and Robinson voting aye on roll call. Brazier and Kurbitz voting no on roll call. Manager Smith reviewed the 701 project to this point, indicating that we must take advantage of the $4,000.00 in the 1964 Budget as no money is allowed in the 1965 budget, that the city's participation in 1965 will only consist of the staff's contribution in time which will amount to approximately $10,000.00. He indicated that no steps have been taken to collect the $3,000.00 from the interested business people, as yet. He also explained that Architects Associated, the local group of architects, who are to prepare the plans and recommendat:i have been organizing in order that they may enter into a contract legally with the City of Yakima. Councilman Brazier explained that he is not satisfied with last planning project indicating that the city does not receive value for money spent. Councilman Kurbitz again protested the use of Federal Funds for this project, stating that it started out innocent enough to determine pheasi- bility and cost of off - street parking an a civic auditorium and now includes many other studies not needed. He read and MOVED the pass age of a resolution instructing our representatives in Congress to make every effort to change the Federal Housing Act to make funds no longer available to cities. This motion lost for the want of a second. Mayor Larson, Councilmen Lambert, Manger and Robinson spoke in favor of this project indicating that pheasibility studies are needed to determine the needs of the city and promote it's orderly growth. :--Lynch absent ions 1 1 �J 1 1 I 601 NOVEMBER 9, 1964. D748, A RESOLUTION requesting planning assistance from the State Department of Commerce and Economic Development and authorizing the City Manager of the City of Yakima to carry out a Planning Program for the Central Business District of the City of Yakima.' The Planning Commission reporting on and recommending the annexation of certain property locat-ed between 44th and 45th.'Avenues and Tieton Drive and Arlington as requested by Petition No. 294 and filed by Lester 0. Beaver, it was MOVED by Munger, seconded by Robinson that said petition be approved as meeting the requirement of law; that the City Manager and the Mayor be authorized to convene a Review Board, as required by law, for a hearing and review of this proposed annexation; and that an order be prepared fixing Novemb.er 30, 1964 as the time for a public hearing by the City. Council on said petition. carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. The Planning Commission also reporting on and recommending the annexation of certain property between East Spruce & Kiwanis Park more fully described on Petition No. 302 as filed by Mary Wakl.ey,.it was MOVED.by Robinson seconded by Munger that said petition be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to obtain waivers of a meeting of ,a Review Board as authorized by law; and that an order be prepared fixing November 23, 1964 as the time for a public hearing by the City Council on this petition: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. The Planning Commission further reporting on and recommending the annexation of certain property located between Cornell Avenue and South 8th Avenue and South King Street more fully described on Petition No. 303 as filed by Thecla Regimbal, it was MOVED by Robinson, seconded by Munger that said.petition be approved as meeting requirement of law; that the City Manager and th.e May" 'te authorized to obtain waivers of a meeting of a Review Board as authorized by law; and that an order be prepared fixing November 30, 1964 as the time for a public hearing by the City Council on this petition; carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. The Planning Commission reporting on and recommending the rezone of certain property located at 2904 Nob Hill Boulevard as requested on Petition No. 304 as filed by Timberline properties, it was MOVED by Robinson, seconded by Munger that November 23, 1964 be set as the time for a hearing by the City Council on said matter and that the City Clerk give notice of such hearing as re- quired by law: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Council noted the withdrawal of Petition No. 307 and 308 as filed by William E. Shaw and others anc Harold R. Sanford respectively which had requested the rezone of property at 1152 North 6th-Avenu( and property between Crescent and 44th Avenue, as reported on by the City Planning Commission. No further action is needed on these two petitions. Hufferd Deputy City Treasurer Bids having been received by a Bid Board on October 30, 1964 for the North 52nd Avenue and Various Other Street Paving Projects, and the City Engineer having submitted a bid summary recommending that Schedule I, widening of Broadway -Mead Intersection, be awarded to Yakima Cement and Asphalt Paving Company and that Schedule II, L.I.D. No. 929, 52nd Avenue and various others be awarded to Superior Asphalt and Concrete Paving Company, it was MOVED by Robinson, seconded by Munger that said bids be awarded as recommended by the City Engineer and that the City Manager be and is hereby authorized to enter into contracts with each of these contractors upon the fil- ing of the proper bonds and insurance by them: carried, Brazier, Kurbitz, Larson, Munger and Robinson voting aye by voice vote. Councilman Lambert voting no by voice vote and explaining that the Council's polic;T has been to award bids to the lowest and most responsible bidder and indicating that she feels that the Cityts experience with Superior Asphalt and Concrete Paving Company has not proven them to be the most responsible bidder. Councilman Munger announced that he is resigning from the City Council since he is moving outside the City limits of Yakima, thereby disqualifying himself to serve and that the next regular meet- ing of the City Council on November 16, 1964 will be his last meeting.
